A class action lawsuit claims Chinese-made treats sold by Del Monte subsidiary Milo’s Kitchen kill dogs and make them sick.

The Milo’s Kitchen class action lawsuit was filed by dog-owner Lisa Mazur, who says her healthy 7-year-old dog, Riley Rae, suffered kidney failure and had to be euthanized after being fed Milo’s Kitchen Chicken Jerky Dog Treats. Mazur claims the only change in Riley Rae’s diet was during January 2012 when she fed the Chicken Jerky Dog Treats to her dog “on occasion.” On February 1, Riley Ray became ill and was taken to the vet, where she was diagnosed with kidney failure. Riley Rae was administered intravenous fluids for four days without improvement, forcing Mazur to euthanize her on February 5.

Mazur says she was unaware the Milo’s Kitchen chicken jerky dog treats made in China were included in a November 18, 2011 warning about dog illnesses associated with chicken jerky dog treats made in China.

“Defendants’ packaging did not warn of any dangers from feeding its content to dogs… [and] the warning is downplayed” on the Milo’s Kitchen website, the class action lawsuit says.

“Defendants knew that there was a substantial risk of death or harm associated with their dog treats. No reasonable person would feed dog treats to their dogs knowing that there was a substantial risk of death or illness from doing so,” the Milo’s Kitchen class action lawsuit continues. “Plaintiff, and other consumers, did not learn of the FDA warning, until after their dogs had consumed the treated and either became ill or passed away.

“Defendants intentionally concealed known facts concerning the safety of their dog treats in order to increase or maintain sales.”

This is not the first dog treat manufacturer to be hit with a class action lawsuit by a pet owner whose dog died after eating Chinese-made chicken jerky dog treats. A grieving pet owner filed a $5 million class action lawsuit against the makers of Waggin’ Train “Yam Good” dog treats in April 2012 after his 9-year-old Pomeranian became sick and died of kidney failure 11 days after eating the treats.

Mazur is seeking compensatory damages and punitive damages for a proposed class of all persons in the U.S. (except Louisiana and Puerto Rico) who purchased any dog treat product containing chicken jerky manufactured or sold by Del Monte or Milo’s Kitchen and containing chicken imported from China, within the past four years. She is alleging common law fraud, unjust enrichment, negligence, product liability, unfair trade, breach of warranty, failure to warn and defective manufacture or design.

    How can I join in this class action lawsuit. I had a 6 year old Doberman that ate them several times over a period of several months. This was a show dog very healthy bloodline her sire is now 11 years old. She suffered complete kidney failure out of the blue!

    Currently my 4 year old Yorkie is in ICU, we are hoping and doing everything we can to keep him alive, He is a very big part of our family and we love him very much! He did get sick in Nov, we didnt know it was from the Milos treats, he was just very toxic and there was no explantation for his sickness…. We still were giving him these treats, maybe once a week and little pieces of it…. Now, he has kidney faliure and we are praying we will be able to save him. Pls do not feed your dogs these treats!!!!

    My dog, a 6 year Rat Terrier died on November 26, 2011 within days after eating Milo’s Kitchen Chicken Jerky.

    My 10 month old Shiloh Shepherd passed away on 9/15/12, 1 month after eating Milo’s Kitchen Chicken Grillers purchased at Sam’s Club. This is a dog who only ate top of the line food (never table foods). I had no idea these treats were tainted until the day after her death when a friend alerted me to this. I am pressing suit against DelMonte and hope that others with this experience will join the class action suit and tell EVERYONE you know to stop feeding your dogs treats from China.

    I also was giving my little beagle the Milo treats for several months thinking it was a safe treat for her. She became very ill; after spending several days at the Vet hospital she could not be saved. In all the testing done my poor little dog showed kidney failure. Shame on Milo for producing such a product that is killing pets around the country.

    The lab has been eating these for several months and now I am worried sick. As expensive as Milo’s is you think they would be safe.

    My healthy dog came close to death after eating Milo’s Kitchen dog treats. Liver & kidney damage. She spent 4 days at the vet and I thought I would have to put her down. Luckily she survived but I now have a $1,300 vet bill to pay. I want DelMonte to pay. How do I find more information about the class action suit?

    I purchased a bag of the Milo’s Chicken Treats, had given my German Shepherd several of them before I saw the “made in China” on the bag. So far she seems ok, but I am terrified that I have given her something that could harm her. I am taking the bag of dog treats back to the grocery store, Publix, where they were purchased, and requesting that they pull them from the shelves. I am going to research on google everything from now on.

    I have a very active 4 year old golden. Recently I’ve noticed she’s been a little calmer than normal, almost enough I thought of taking her to the vet because she just didn’t seem right. Then about two weeks ago we witnessed what we believe was a seizure, and again over the weekend. We have also noticed some incontinence issues when she hasn’t had an accident in the house since she has been a puppy. I actually have an appointment at the vet tomorrow. A friend posted something about the Milo treats on her facebook page and I was like you know, that is the only thing I fed her that was different the past month (maybe a treat or two at the most a day). The bag is gone now, but I am going to mention it to the vet tomorrow. I was thinking the onset of epilepsy, but now I’m thinking something with the kidney’s or liver.
