Mercedes-Benz electrical drain defect class action overview: 

  • Who: A group of Mercedes-Benz drivers are suing the automaker.
  • Why: The plaintiffs say a number of Mercedes vehicles have a defect that causes the battery to drain “rapidly and unexpectedly.” 
  • Where: The lawsuit was filed in a New Jersey federal court.

A broad swath of Mercedes-Benz vehicles made between 2004 and 2022 have a defect that causes the batteries in the vehicles to drain “rapidly and unexpectedly,” a new class action lawsuit alleges.

Plaintiffs Lewis Young, Enrique Perez, Merissa Jones, Valeriu Matei, Teresa Isom, Linda Blackwell, Kia Watson, Muhammed Jackson, Levanda Gayden, Jackie Rasmussen, Siro Brenes, Carl Clark, Andrea Geoly and Keith Colwell filed the class action complaint against Mercedes-Benz USA LLC and Daimler AG Sept. 12 in a New Jersey federal court, alleging violations of state and federal consumer laws. 

This lawsuit arises out of a defect that causes the battery in Mercedes vehicles to suddenly drain, the plaintiffs say.

According to the plaintiffs, the defect arises from a common electrical system used across vehicles manufactured between 2004 and 2022, including but not limited to Mercedes Class S, C, A, CLA, CLS, G, GLA, GLK, GLC, ML, GLE, GL, GLS and E vehicles.

“In all vehicles, the [defect] causes the battery to suddenly drain, preventing the car from starting, potentially stranding the occupants and endangering their safety,” the plaintiffs alleges.

As a result, the cars are unsafe, unreliable and undesirable, the plaintiffs say.

Mercedes knew about defect but didn’t fix it, lawsuit alleges

Based on customer complaints, repair data, and other internal sources, Mercedes knew or should have known about the existence of the defect and its consequences, the Mercedes-Benz lawsuit alleges.

“Nevertheless, Mercedes has never offered to repair the Electrical Drain Defect or otherwise compensate Class Members for their injuries resulting from the defect which it has not repaired,” it says. 

Mercedes continues to market its vehicles as safe and reliable, leaving purchasers to carry the costs of dealing with the defect, the plaintiffs state.

As a result, plaintiffs overpaid for their vehicles and had expenses related to the flaw, they say. 

They’re looking to represent anyone who purchased or leased a Mercedes vehicle containing the electrical drain defect rendering them subject to any remedial- or counter-measure.

The plaintiffs are suing for fraudulent concealment, unjust enrichment, breach of warranty, breach of fair dealing and breaches of state consumer laws. 

They are seeking certification of the class action lawsuit, an injunction forcing Mercedes to treat the problem, restitution, damages, fees, costs and a jury trial. 

Meanwhile, in July, Mercedes-Benz agreed to a class action lawsuit settlement to resolve allegations its interior Burl Walnut trim is defective and can fade.

    I bought in Dec 28/21 Mercedes S 500 Model Year 2022 and constantly have problems with the car battery. Three times car engine shutoff, while driving, lose acceleration at the highway speeds. I went three times to Mercedes Dealer and now it the 4th time that I need to bring car to Mercedes Dealer.

    I have a 2008 SLK 350 Mercedes Benz I bought it with 23,000 miles on it the car was spotless it went to Mercedes because of a drain on the battery nobody can figure it out I’m being charged all kinds of money and now they want to talk to my car I’ve been stranded on the road miles from the house with my wife atmosphere multiple times please add me to the list. I haven’t been able to drive my car for over 2 and 1/2 months and the drain on the battery caused my radio my alternator and other components in the car to not work properly and all my navigation also it is thousands of dollars and upwards of almost 11,000 and I still haven’t got my car fixed I’ve already lost my job because I couldn’t get a ride back and forth please add me to the list

    Please add me to this , my 2005 Mercedes is currently at a Mercedes dealership service department and has many problems and it all started with the battery draining and causing other things to malfunction, short out or whatever happens , I am no mechanic. But I am now without a car and about to lose my home because I need transportation for work and my son ( I am a single mom ) and Mercedes is refusing to work on my car !! And I have a warranty that caps at $5,000.00 so I am completely blown away they are telling me my car is not worth fixing but I don’t have a choice I have payments on a loan for it , and this all started with the battery draining rapidly I was stranded many times alone with my young child and when I would get a new battery everything would be perfect for a little while but then eventually dead battery ….. please help

    I have a 2021 GLB and I been receiving critical warning sign everyday about the low battery ! This car has some serious electric issue. The fan big front machine fan suddenly stopped working, AC doesn’t work and the driver side light doesn’t turn on. I AM SHOCKED as this is just a year old car.
