Lipitor Diabetes LawsuitAnother Lipitor lawsuit has been filed under the larger Lipitor MDL by a Mississippi resident who alleged that she developed type-2 diabetes after she took the Pfizer cholesterol drug.

Plaintiff Catherine S., 59, was prescribed Lipitor in 2003 by her physician to help manage her high cholesterol. She continued to take Lipitor until about 2006, a year after she was allegedly diagnosed with type-2 diabetes.

According to the Lipitor lawsuit, “Plaintiff/Injured Party has suffered severe and permanent physical and emotional injuries including, but not limited to, the development of Type 2 Diabetes as a result of her ingestion of the prescription drug Lipitor (atorvastatin calcium). As a direct, proximate and foreseeable result of Defendants actions or inactions, Plaintiff suffered grievous bodily injury and consequently economic and other losses, including but not limited to pain and suffering, emotional distress and loss of enjoyment of life.”

In this Lipitor lawsuit, Catherine brings several allegations against Pfizer, including negligence, negligent misrepresentation, negligent design, design defect, failure to warn, breach of express warrant, breach of implied warranty, fraud and misrepresentation, unjust enrichment, and punitive damages.

This Lipitor Type-2 Diabetes Lawsuit is Case No. 2:15-cv-00745-RMG, in the U.S. District Court for the District of South Carolina, Charleston Division.

The Lipitor MDL is In re: Lipitor (Atorvastatin Calcium) Marketing, Sales Practices and Products Liability Litigation, MDL No. 2:14-mn-02502-RMG, in the U.S. District Court for the District of South Carolina, Charleston Division.

Type-2 Diabetes and Lipitor Users

Over 4,000 women have reported they allegedly developed type-2 diabetes side effects after taking the Lipitor cholesterol treatment. Many of these women have filed Lipitor lawsuits, which were later consolidated in the larger Lipitor MDL.

As a result of a large influx of Lipitor users reporting negative side effects and published Lipitor type-2 diabetes studies, the U.S. Food and Drug Administration (FDA) posted a public health notice in August 2011, requiring Pfizer Inc. to include new type-2 diabetes risk information in Lipitor marketing, advertising, and labeling. In 2012, the FDA followed this up with a general mandate to all statin drug manufacturers, requiring them to include a type-2 diabetes warning.

Subsequent Lipitor medical reports have suggested that women in particular are the group of consumers most at risk of developing type-2 diabetes after taking the Pfizer drug.

In February 2012, Lipitor finally complied with the FDA order and updated Lipitor’s drug and product labels to include a Lipitor type-2 diabetes risk warning. While this action benefits current and future Lipitor consumers, it does not affect the Lipitor side effects many women have suffered after developing Lipitor complications prior to 2012.
