Lipitor diabetes lawsuitA Lipitor lawsuit filed by a Mississippi woman alleges Pfizer Inc.’s cholesterol treatment caused her to develop type-2 diabetes.

According to her Lipitor lawsuit, plaintiff Lori S. began taking Lipitor to help manage her high cholesterol sometime around 2007 and stopped her Lipitor prescription in November 2010, just a month after she was diagnosed with type-2 diabetes.

Now at the age of 56, Lori filed her Lipitor lawsuit, claiming the drug caused her to develop type-2 diabetes.

According to her Lipitor lawsuit: “As a direct, proximate and foreseeable result of Defendants actions or inactions, Plaintiff suffered grievous bodily injury and consequently economic and other losses, including but not limited to pain and suffering, emotional distress and loss of enjoyment of life.”

The plaintiff brings several claims against Lipitor’s manufacturer, including negligence, negligent misrepresentation, negligent design, design defect, failure to warn, breach of express warranty, breach of implied warranties, fraud and misrepresentation, constructive fraud, unjust enrichment, and punitive damages.

The Lipitor Type-2 Diabetes Lawsuit is Case No. 2:15-cv-01498-RMG, in the U.S. District Court for the District of South Carolina. It is part of the Lipitor MDL known as In re: Lipitor (atorvastatin calcium) Marketing, Sales Practices and Products Liability Litigation, MDL No. 2502 in the U.S. District Court for the District of South Carolina, Charleston Division.

Type-2 Diabetes and Lipitor Users

To date, over 4,000 women have alleged that they developed type-2 diabetes side effects after taking Pfizer’s Lipitor cholesterol treatment. These women filed Lipitor lawsuits, the majority of which were later consolidated in the larger Lipitor multidistrict litigation (MDL) in South Carolina federal court.

Plaintiffs claim they developed diabetes anywhere from a few months to a few years after they began taking Lipitor.

Following a large number of negative news reports and published Lipitor type-2 diabetes studies, the FDA issued an August 2011 health notice requiring Pfizer Inc. to include new type-2 diabetes risk information in Lipitor marketing and labeling. The FDA followed this in 2012 with a general mandate to all statin drug manufacturers, requiring them to include a type-2 diabetes warning.

In February 2012, Pfizer finally complied with the FDA order and updated Lipitor’s drug and product labels to feature a type-2 diabetes risk warning.
