 Hydroxatone “Free Trial” Is a Scam, Says Class Action Lawsuit

Hydroxatone free trial scamA class action lawsuit claims Atlantic Coast Media Group and Hydroxatone run a scam by advertising a free trial for beauty products and using the credit card information they get for the $7.95 “shipping and handling” fee to bill customers $209 for a 3-month supply.
 
According to the Atlantic Coast Media Group and Hydroxatone class action lawsuit:
 
“Defendants advertise that these products are tested as a free trial and that consumers will only have to pay for shipping and handling in order to receive this free trial. This is a lie and a breach of agreement, because instead of sending the customers a free trial, Defendants send customers a three-month supply of products, then bill the customer’s credit card for the entire three-month supply. In many cases, Defendants also send and bill for other products (such as vitamins), which the customer has not ordered. Defendants have done this to thousands of people across the country. This is illegal, and this lawsuit seeks to stop this practice and recover all of the money that defendants wrongfully took from the Plaintiffs.”
 
The Hydroxatone scam class action lawsuit is brought on behalf of all persons who participated in a free trial of any product from Atlantic Coast Media Group and Hydroxatone, for payment of only shipping and handling; provided a credit card or debit card number, and were billed on that card by Defendants more than shipping and handling, without subsequent written authorization to do so.
 
It is seeking compensatory damages, punitive damages and attorney and court fees for Breach of Contract, Fraud, Unjust Enrichment and Sending Unordered Consumer Products.

    Can I join in a class action suite being a Canadian. I also fell for this scam and was charged on my credit card plus had to pay duty. I contacted the ACMG and this fellow was trying to tell me repeatatly i gave authorization to be charged and shipped for the product for month to come. I told him you can have the stuff back, pay me the extra cost and you are NOT authorized to charge my cc for any amount you think you have a right too. This was a nerve racking conversation because the staff there is well trained to get one upset. I kept my kool. After the call of mine in which I clearly expressed this is a missleading product sell, and STOP any charge or selling of my personal information I contacted MC. As a Canadian can you also act on my behalf/

    I feel like I have been scammed because I ordered this through phone by harassed phone calls and got sucked into it when they said I just had to pay shipping and handling and then enter card info without them telling me that it was a risk free trial and you had to return within 30 days, the 30 day is a false guarantee because you have to return within 2 weeks which I dont get unless some one cares to explain that for me. Maybe I was ignorant in not hearing this part and not looking at my invoice but I believe for sure they never stated this before asking for my information.

    i also recently recieved card free wal mart 100 dollars and now going through same thing never recieved walmart card have billed me twice already going to bank hopefully to make sure not charged again wish i saw this sooner thanks1-19-2013. besides all this product sucks does not work.

    I was called advising I’d won a $100.00 gift card from Walmart. All I had to do was give them my credit card to charge a $3.95 processing fee. Told I won it for “being a good Walmart customer”

    It didn’t feel right to me, so I called my credit card company. No charge for a Walmart gift card, however, there was a charge for $6.95 from Hrlydroxatone.

    I. Called Hydroxatone and customer service advised me to ship the product back after I receive it. I told them I was not paying shipping on a product I didn’t order. Customer service was a real b*tch telling me then they would charge for the product ($140.00) if I fail to return it after I receive it.

    To date, I’ve not received a Walmart gift card ( Hydroxatone is obviously using that ploy to get credit card numbers),.

    I canceled my credit card number, and I will not be sending anything back if it happens to come unsolicited addressed to me unless Hydroxatone would like to pay return postage…..Ohhhh, AND handling charges to me :0).

    All of these “positive comments” backing the way Hydroxatone does business, I’ve no doubt are coming from Hydroxatone reps themselves.

    The gig is up boys and girls. People are utilizing the Internet to check products and the way companies do business. Your working on percentage basis to scam the public is ending.

    Read the fine print peeps. Its not that hard. RISK FREE trial hello!!! Its not a sample or free products. Nothing is ever for free!!! And if you order anything from some scammer calling and asking for your cc number you are an idiot for giving it to them! You have to read the term and conditions on anything you purchase. This company has a 30 day bottom of the jar money back guarantee as well. This company will give you your money back, all you have to do is call and get a RMA # and a return address to send the products back, they also recommend that you get a confirmation code from the post office to track your return. LEARD TO READ THE PAPERWORK THAT COMES WITH EVERTHING YOU EVER BUY!!!

    The Company Hydroxatone phone oo o800 2358 7491 are total SCAMMERS I used my visa card to purchase two products on the 17th July which
    cost $2.58 each and both were spouse to be FREE SAMPLES.
    ON THE 7TH September they took another $90.64
    17th September another $87.42
    8th October another $88.00
    12th October another $88.00
    They have used my visa card to steal money from my account and I have only received two
    products on the 17th July 2012 which were not
    free as advertised and charged me $2.58 each
    and extra cost for SHIPPING

    I DID NOT PURCHASED ANY PRODUCTS ON THE

    7TH SEPTEMBER $90.64
    17TH SEPTEMBER $87.42
    8TH OCTOBER $88.00
    12TH OCTOBER $88.00

    NOR HAVE I RECEIVED ANY OF THESE PRODUCTS THEY HAVE CHARGED ME FOR ONLY THE TWO
    CHARGED FOR ON THE 17TH JULY 2012
    WHICH WERE ADVERTISED AS FREE

    We will be going to the police on Monday and
    have already spoken to our bank and informed them to cancel our visa card asap.

    In Total they have stolen from me $354.06
    AND EXTRA COST IN SHIPMENT FOR THE FIRST
    PRODUCT

    This is most certainly a scam! Fortunately, they charged me initially for the $1.99 trail period and I received a 1oz jar. Then I had to have my debit card replaced. Afterwards they tried to charge me $130 through snail-mail…I trashed the bill. They have tried calling me 2 days in a row now offering me a 50% discount. There is no way I’m paying $65 for a worthless jar of cream and never agreed to do that. I will never pay this! I’m tired of business and bank scams. They can just eat me! Screw ’em!

    If you want anything from a “risk free” trial just pay postage and handling, send a money order for postage and handling. Once you give them your credit card number it is no longer risk free.

    Dude, this is a scam and you can’t deny it.
    No one in my family even ordered the product. We never once gave out our credit information.
    Somehow, they got it and charged us, and we argued with those bastards and we still didn’t get anything back.
    In fact, they’d charge us $20 for us to send it back.
    Thankfully, we cancelled our card so we wouldn’t be looped like everyone else.

    This IS a scam, and I’m pretty sure the last few people that have commented are the same idiot. Don’t be intimidated.

    These people need to be stopped.
