Road tollWhen driving on many toll roads throughout Delaware and surrounding states, it’s very common to use EZPass. EZPass is an automatic way to pass through the toll assessment stations throughout Delaware and have the money owed be deducted from an account.

However, a growing number of people allege that their Delaware toll violation notices are inaccurate or assess unreasonable fees.

Those drivers may even be able to participate in a class action lawsuit investigation. If you were assessed an excessive EZPass toll violation over the course of the past four years, you may be eligible to pursue legal action against the company.

Drivers pay tolls to move through certain highways. The EZPass system is often used to allow people to pass through the toll assessment stations more quickly. A Delaware toll violation may be assessed if a person does not have enough funds on their account to cover the toll that is due.

Automated toll fee collection is a way to easily and quickly pay toll fees without actually having to stop at the booth. A driver will avoid a Delaware toll violation by purchasing an account through a provider such as EZPass. A transponder is then affixed to the driver’s windshield and then this communicates with the system as the driver passes through the toll booth.

Drivers must add money to their toll collection accounts and the toll fee will then be removed from the account each time that the driver passes through a toll area.

A driver can be assessed a Delaware toll violation if they do not have sufficient money in their account. However, drivers now argue that their Delaware toll violation notices indicate much higher penalties than the base toll fee.

A growing number of class action lawsuits have been associated with problems alleged by drivers, including those who have received notice of a Delaware toll violation.

In some of these instances, the cost for the Delaware toll violation may be ten times as much as the actual toll cost for driving on the road that other drivers paid for with cash or if they had sufficient funds on their account.

If you have already been assessed an EZPass toll violation fee, you may be eligible to participate in a class action lawsuit investigation. Consumers are getting increasingly frustrated with receiving these notices and not being informed about the high penalties associated with having insufficient funds on the account.

Although the EZPass transponder and other similar services may be a seamless way to pay your toll, it could lead to more trouble if you are not careful enough to monitor the funds inside your account and if you are assessed a costly Delaware toll violation.

Reviewing past notices received regarding violations and insufficient funds in your account can help you identify whether or not exorbitant fees have been assessed against your account. If excessive fees were charged, customers can look into options to challenge them.

  1. EB says:

DelDOT is definitely running a “legal” scam. I paid my bill and then received another bill, appealed and DelDOT never responded to the appeal, but continue to send the bills. A simple $5.60, which was paid is now up to over $88.60! How can we sue DelDOT for false charges and fraud?

  2. Steve says:

$11.75 in tolls and being charged over $700. This cant be real.

  3. Jake says:

I just got my notice in the mail I owed them 78 usd now they want 1,303 from me for tolls I thought I had paid now I’m being charged for half the states taxes. Any advice on weather I should fight it?

  4. Zell says:

First notice of a $4 toll and it’s $50 extra added to it as if I ignored a previous notice (that I never was sent). I HAVE AN EZPASS and it was properly displayed as it was read at a toll booth only a few minutes before the one in question. Sent them proof of this and they denied my appeal! Having to pay 13X the original toll because their equipment didn’t properly scan my ezpass is ridiculous. No one answers the phone and the notice was sent out 3-4months after the “toll violation” which is outside of the 60day period they can take it off of the ezpass. How ironic. This seems like a scam.

  5. Larry says:

What the hell is this? Russia? I’ve read so many of these comments as I too now supposedly owe (24) separate $91.50 tolls FOR A CAR AND TAGS THAT ARE NOT MINE!!!! Believe it folks! What a sad conclusion I’m coming to though as it appears there’s little to nothing I can do. Any advice?

  6. JP says:

    $4 toll…$54 by mail.

    1. Sarah Peters says:

I got two $4tolls and they added $50 to each roll so now they want me to pay $108.00 altogether I paid the tolls before the due date and disputed the other fees but they sent me a mail saying my dispute is denied and I must pay the admin and other fees. This is so ridiculous

      1. GiGi says:

I agree!! this is high way robbery! I received a $50 penalty for a$4 toll charge. This happened in June 26. Never received the first mail notice. I received a notice to pay $54 in October. There needs to be something done about such a criminal act!!!

  7. Timmi Kilgore says:

I live in PA and was going to Delaware so before my trip I prepared ezpass to cover tolls by plate. I got 4 violations from 1$ tolls that charged over 50$. This is ridiculous can’t get nobody on the phone.

    1. Allison Schomborg says:

I have been stuck in this ridiculous trap with DOT for 6 months. Recently have sent a appeal letter to them and their lawyer with no response but the fee notices continue to accumulate and mailed 5 days before due dates on them! I am prepared go court or do what I have to do including go to jail before I pay them the ridiculous fees they are charging me.

  8. Jim says:

Talk about extortion. 2 $4 tolls from 2+ years ago are now $183.00. First time I got this bill. That’s extremely suspect. How is inflating a bill 45x its original advertised cost, legal?

  9. David Gillespie says:

Same here. A bill for 91.50 from a collection agency, for a 4.00 toll back in 2018. This is the first I heard that I owed till money. I don’t run tolls so, no I would not have already known I owed money.

If I have to pay the bill, it will be in installments over the next 4 years. Coincidentally, The same amount of time it took them to notify me of my 4 dollar toll.

  10. Richard Bolen says:

Someone should go to jail. This is criminal. We need to write our congressmen and senators about this practice. All the money you see being raked in daily and they have the nerve to scalp us. these roads have been bought and payed for, for years. And try to contact them by phone, you can’t get through they blame it on Covid, Bullxxxx. This is a giant scam! Sounds like Russia, they think they can do anything they want. How can those responsible sleep at night. I have two works for them !
