Road tollWhen driving on many toll roads throughout Delaware and surrounding states, it’s very common to use EZPass. EZPass is an automatic way to pass through the toll assessment stations throughout Delaware and have the money owed be deducted from an account.

However, a growing number of people allege that their Delaware toll violation notices are inaccurate or assess unreasonable fees.

Those drivers may even be able to participate in a class action lawsuit investigation. If you were assessed an excessive EZPass toll violation over the course of the past four years, you may be eligible to pursue legal action against the company.

Drivers pay tolls to move through certain highways. The EZPass system is often used to allow people to pass through the toll assessment stations more quickly. A Delaware toll violation may be assessed if a person does not have enough funds on their account to cover the toll that is due.

Automated toll fee collection is a way to easily and quickly pay toll fees without actually having to stop at the booth. A driver will avoid a Delaware toll violation by purchasing an account through a provider such as EZPass. A transponder is then affixed to the driver’s windshield and then this communicates with the system as the driver passes through the toll booth.

Drivers must add money to their toll collection accounts and the toll fee will then be removed from the account each time that the driver passes through a toll area.

A driver can be assessed a Delaware toll violation if they do not have sufficient money in their account. However, drivers now argue that their Delaware toll violation notices indicate much higher penalties than the base toll fee.

A growing number of class action lawsuits have been associated with problems alleged by drivers, including those who have received notice of a Delaware toll violation.

In some of these instances, the cost for the Delaware toll violation may be ten times as much as the actual toll cost for driving on the road that other drivers paid for with cash or if they had sufficient funds on their account.

If you have already been assessed an EZPass toll violation fee, you may be eligible to participate in a class action lawsuit investigation. Consumers are getting increasingly frustrated with receiving these notices and not being informed about the high penalties associated with having insufficient funds on the account.

Although the EZPass transponder and other similar services may be a seamless way to pay your toll, it could lead to more trouble if you are not careful enough to monitor the funds inside your account and if you are assessed a costly Delaware toll violation.

    I would like to be a part of class action lawsuit. They sent me numerous violations months after the fact. I disputed and sent checks with my EZPass information. They cashed all of the checks and sent me new violations for the fees minus the payment of the toll that I paid. I am not paying these fees. Not my error your readers don’t work properly. Notices come in 9 months later. Letter is dated with one date with a due date and the envelope is post marked for a week after the due date. They want to try and deny disputes because it is after 60 days of the transaction but they don’t send a notice until 9 months after. If your readers were working properly there wouldn’t be an issue. And the fees are just ridiculous fees. I did not need an ambulance, I did not need protection from combat violent crimes, then a civil penalty, and admin fee with civil penalty surcharge. $87.50 in fees for a $1.00 toll that shows the toll has been paid. on the violation.

    I received notice for toll violations for $54 for a $4 toll from Delaware. I have read here that a lot of people had problems on this toll specifically. I was very careful, and I still can’t remember how I would have missed paying the toll. Maybe it was because GPS took me to the left and I couldn’t have gone to the right lane. I would have probably thought that I’ll get the toll on the mail like I do in NJ and PA because I used my EZ-Pass NY transponder. I never received the notices in the mail advising me that the violations existed. The first notice I received was where I had received a $4.00 toll and $54 fee. The fee that they are charging is exorbitant. I would like to be part of any on-going suit against Delaware as I strongly believe that it is unfair.

    I am a Florida resident with a valid Sunpass transponder which works at all EZ Pass toll plazas as far as I know. Back in January, my mother had passed away in New York and I had to make an emergency trip with my wife and daughter to attend her funeral. On the way there, I basically travelled all along the I-95 North corridor and never had any issues with tolls all throughout MD, NJ, NY until I hit DE where they claim I went through their Newark toll plaza on two consecutive days (total bs) without paying the tolls. How is it possible I went through the same toll plaza twice on two consecutive days when on the second day they claim I didn’t pay the toll I was actively attending a funeral and didn’t return back home to Florida until the following weekend? They send me two violation notices in the amount of $54 each for a $4 toll! They tack on these pathetic administrative fees to justify their extortion scheme, which is no different than Virginia targeting out of state drivers for false speeding violations. Typical blue state extortion!

      Yes. Today I received in the mail a tool violation just like you. $54 for a $4 toll. I have NJ ez-pass. It came today March 23rd and it’s due on the 26th. I am leaving on a cruise tomorrow. Now I have to pay it and try to dispute it when I get back. The violation is 1/2/23. I can’t believe all of these bs charges.

    My son went through the toll lane and no he did not have a ezpass, the toll was $1.00 and another toll for $4.00. It was his first time going to NY on his own and all he had was a cash app card, no change or money on him. He also received a toll violation $20.00 with a $5.00 late fee charge. Ok understandable, but Delaware tacked on junk fees not only was the administration fee was added but a fee for the ambulance fund and a combat violence fee this is ridiculous those two tickets came up to $105. Those are junk fees and it needs to be addressed. Not only that the violation notice said it was sent out the 26th of February but the postage stamp says the 8th of March and I just received yesterday the 16th of March with a must pay date of the 19th of March or late fees would be added. This is a complete rip off and I can’t believe they are saying it’s legal. This has to stop.

    Went to Philly from Md up 95 Christmas day and back 12-25-22. Received toll violation 3-10-23 for $54.00.
    Called deldot and rep said there are two violations (coming and going). I have not received that toll violation yet. Went online and paid both for $108.00 all for two $4.00 tolls. What a Scam. I am a veteran and a senior on social security and I am embarrased by Delaware. A class action lawsuit is the way to go.

    Just got a violation from Delaware DOT for Toll Violation $4.00 with $50.00 in fees. Violation date 26 December 2022, but got the violation 09March23 (with only 3 days to respond). Had to rush the appeal via USPS that cost $10.00. Are you kidding? I had a transponder and passed through tolls going from Fl to NY. All tolls captured. Coming back to FL, Delaware was the only toll that was not captured by their equipment. Not happy at all. Sent them a copy of my statement showing that there in fact were funds and a copy of my transponder. The better honor the appeal.

      To all the postings, I tell you this…write to the Attorney General Office in Delaware. I am continually harassed by Deldot for tolls that have been paid. Their accounting is atrocious and they do not keep proper records and prey on people to simply just pay them. Don’t. Fight it. They are wrong and their fees are atrocious and constitutional. I will be sending another letter to AG office. This needs to stop and class action suit filed.

    Just paid a $54 bill for a $4 toll … and I called, they said … Yes we read your transponder but it didn’t pay us. However, my transponder paid New Jersey’s toll that same day … so they claim it’s not ‘Delaware’s fault, you need to pay $54″ I was like … it’s a $4 toll! So it’s either an EZ Pass issue or a Delaware Issue, but from now on, I’m driving and stopping at the stupid toll booth making sure it accepted my payment before I drive through Delaware again! SCAM! It’s illegal to charge $50 when they claim they couldn’t take money when NJ didn’t have a problem the same day!

      Same here for a 12/22/22 violation traveling north. Notice received March 4, 2023. Tolls recorded in MD and NJ same day. $54.00. What BS!!

    I was traveling through Delaware as A PA resident. I received a bill MONTHS later and tried to pay it online and it wouldn’t allow me. I then sent a check that was “never received”. I sent another check and they cashed it for the $5.00 toll, then sent me an $80.00 bill. I refuse to pay it. I don’t even think my first invoice that I received was wishing the 60 days they gave me to pay it.

      I only have three days to pay my bill. We should all get together and file a class action suit. Either their transponder has a problem or someone who works for them is scamming everyone.

        I have a bill for 11.20 and when I went to pay it the day I received it the balance was $111.20 so I thought it was a mistake and tried calling their office. They just sent me another bill and they’re charging me $100 in fines for a $11.20 toll violation. This is wrong, I’m not paying this BS. Is there actually a class action being filed? How can we make this happen

    I have the exact same experience having received 2 bills for 54$ each. I was traveling from Maryland to Chincoteague the weekend of Mar 1 and received the bill in September. I traveled throwing the Chesapeake Tunnel that Sunday or Monday and received their bill and paid it in early May.

      and what’s worse, is they lock you out of your account so you cant pay it, turn your responder off, when you call they dont answer the phone, and then they sell your debt to a collection agency, ruining your credit, because its the only way they will actually get paid. soon needs to stop this service, and do a full blow audit of their practices. its so unlawful

    Hello all fellow ‘alleged’ Toll violators!😀
    We live in Maryland and travel up I-95 to Bethany Beach using Rt. 1. We’ve been recorded as toll violators via our MD EZPass and these violations may have been legit. However, like many of you, the additional charges are ridiculous! Administrative Fees!? Ambulance Fund!? Combat Violent Crimes!? are you kidding me!? So, I’m looking for any suggestions/recommendations as to how to combat these charges. Is there an existing Class-Action suite in place that we can join? Has anyone contacted their State Attorney General’s Office?

      I received 2 till violation bills for $90+ for a $4 toll. How can this be legal?
