Road tollWhen driving on many toll roads throughout Delaware and surrounding states, it’s very common to use EZPass. EZPass is an automatic way to pass through the toll assessment stations throughout Delaware and have the money owed be deducted from an account.

However, a growing number of people allege that their Delaware toll violation notices are inaccurate or assess unreasonable fees.

Those drivers may even be able to participate in a class action lawsuit investigation. If you were assessed an excessive EZPass toll violation over the course of the past four years, you may be eligible to pursue legal action against the company.

Drivers pay tolls to move through certain highways. The EZPass system is often used to allow people to pass through the toll assessment stations more quickly. A Delaware toll violation may be assessed if a person does not have enough funds on their account to cover the toll that is due.

Automated toll fee collection is a way to easily and quickly pay toll fees without actually having to stop at the booth. A driver will avoid a Delaware toll violation by purchasing an account through a provider such as EZPass. A transponder is then affixed to the driver’s windshield and then this communicates with the system as the driver passes through the toll booth.

Drivers must add money to their toll collection accounts and the toll fee will then be removed from the account each time that the driver passes through a toll area.

A driver can be assessed a Delaware toll violation if they do not have sufficient money in their account. However, drivers now argue that their Delaware toll violation notices indicate much higher penalties than the base toll fee.

A growing number of class action lawsuits have been associated with problems alleged by drivers, including those who have received notice of a Delaware toll violation.

In some of these instances, the cost for the Delaware toll violation may be ten times as much as the actual toll cost for driving on the road that other drivers paid for with cash or if they had sufficient funds on their account.

    Last month, 9/23/23, I drove from Maryland to and from Philadelphia via Delaware, and not having an EZPass transponder displayed in my vehicle, I received 2 bills in the mail totaling $108 ($54 each way) and broken down as follows: Toll due ($4); administrative fee ($25); Ambulance Co Fund ($10); Combat Violent Crimes ($15). What the hell does any of the aforesaid categories have to do with my toll charge? How can this violation be allowed in the United States of America?

    Had to pass through Delaware and the toll was $4 but I received an administration fee of $25 Ambulance Co. Fee $10 and Combat Violent Crimes Fee $15 for a total of $54. Literal highway robbery. I don’t live in their stupid state so why am I paying to combat “violent crimes” in Delaware? This all computerized so exactly what is the administration fee for? Completely ridiculous. Just more ways the government steals from people. I’d rather keep cash alive and wait in line at a tollbooth than be a victim of government extortion!

    I had a notice come today about unpaid tolls from a car my ex wife was allowed sole use of during a divorce and she had gotten 21 toll violations even with the transponder in the car. The tolls are 4$ after all fees it turns into 1,981.00 for roughly 80$ in tolls. I told them and gave them the transponder number they told me call the law office back I called and they told me I needed to call ezpass basically neither place wanted to help me and it’s been over one year they just now sent me this bill.

    In June 2023, I also was sent a letter that I failed to pay a $4.00 toll even when my E-Zpass was in good standing. When my bill was for $91.50 because of all these excessive and totally unrelated charges I immediately searched on google if there were others and what to do and found this site. PLEASE include me in this lawsuit. By principle I want to not pay and fight because this is totally wrong and an injustice if we let these corrupt people try to get away with this, but at the same time, I don’t want my bill to be doubled-tripled as I try to appeal as I’m reading from everyone’s comments that appealing is just smoke and mirrors… should I just pay now and keep fighting with hopes of recovering later?

    I visited Delaware and did not have a ezpass for Delaware now they are charging all types of unnecessary charges this is crazy should I pay

    Taking my husband for cancer treatment’used his ez pass with my car and was hit with a 102 dollar bill

    $5.60 toll is now $93.10! This is completely ridiculous.

    It’s not just for EZ-Pass violations either. I went through the cash toll lane at Boyd’s Corner (50 cent toll) and tried to use the change machine there. The change machine would not work, tried multiple $1 bills. So I went though and later received the notice of toll violation ($50 in fees!), wrote back to them explaining the issue and they rejected my appeal saying I did not provide proof. (Interesting that the rejection came on DE EzPass stationary and not DelDOT). Resubmitting the appeal and will write a letter to DE’s Attorney General as mentioned above.

    I received a toll violation, had my ezpass, responded to the violation with a check for the toll and advised my account was in good standing. I was rejected by the appeals. I called and was provided an email address to send my account information to prove my account was in good standing. I received a confirmation email back saying it was passed onto appeals. 5 months later, I received a bill for $88 from a debt collector/law firm, threatening me. I literally did everything DE asked plus more for a $1 toll. I proved my account was in good standing, I proved that I drove through the tolls prior and afterwards. I immediately called, was on the phone with EZpass for almost an hour and was hung up on while they were “researching” the issue, however I was told that there was nothing they could do as it was with a debt collector. I cannot afford this, and I am sure there are more people in my situation. They should not be allowed to get away with this type of business.

    My tolls were $8. My EZpass didn’t read. Now they’re expecting me to pay $183.00 !!!!! Yes you read that correctly. More than TWENTY TIMES what the actual toll was. PLEASE someone point me in the direction of how to join this class action lawsuit.
