Zimmer Durom CupA Texas woman filed a metal hip replacement lawsuit against Zimmer Holdings Inc. and its affiliates alleging that she suffered extreme pain and complications from the company’s metal hip replacement system.

Plaintff Lynn Harris alleges that the Zimmer Metasul Hip replacement system implanted in both her left and right hips were defective, which caused them to fail and cause her extreme physical and emotional pain and injury. Additionally, Harris alleges that the Zimmer Metasul Hip “components were defective in design and/or manufacture. Said defects existed when the components left the hands of Defendants, making the components unreasonably dangerous beyond the contemplation of the ordinary user.”

According to her hip implant complications lawsuit, in 2007, Harris’ surgeon implanted her with the following Zimmer hip replacement products: the Zimmer Metasul Durom uncemented acetabular component, Zimmer Metasul LDH femoral head, and Zimmer Metasul LDH Head Adapter. All of these hip replacement components were designed, manufactured, distributed, and sold by Zimmer.

A month later, Harris underwent the same surgery, during which she was implanted with the same components on her right hip. Harris did not suffer any immediate complications from the Zimmer hip replacement surgery, according to her hip implant lawsuit.

However, according to Zimmer’s metal-on-metal hip replacement lawsuit, mechanical failure was discovered in both hips in late March of this year and surgery was required to remove and replace them.

Harris and her metal hip replacement lawyer allege that Zimmer is strictly liable under the manufacturer’s products liability doctrine, and have accused Zimmer and its affiliates and/or subsidiaries with breach of implied and express warranty, failure to warn, and personal injury.

Harris is seeking monetary compensation punitive damages, payment of medical expenses and procedures, and replacement of income lost due to the complications allegedly resulting from her hip replacement surgery.

The Zimmer Hip Replacement Lawsuit is Lynn Harris v. Zimmer Holdings Inc., et al., Case No. 2:14-cv-04509-SDW-MCA, in the U.S. District Court for the Northern District of Texas, Dallas Division.

In general, metal hip implant lawsuits are filed individually by each plaintiff and are not class actions.
