A new class action lawsuit alleges Momcozy advertises its KleanPal Pro Bottle Washer and Sterilizer as safe to use, when, in reality, it contains a defect that poses serious health and safety risks for babies.
Plaintiffs Megan Adinolfi and Danielle Toro claim Momcozy’s KleanPal Pro Bottle Washer and Sterilizer product contains a defect that causes its internal plastic components to degrade, crack and break off into small pieces during normal use.
Adinolfi and Toro argue the KleanPal Pro’s internal components are made of materials that are unable to withstand the high temperatures required for steam sterilization, leading to the degradation and breakage of the components.
“As a consequence of the defect and as reported by numerous consumers, the KleanPal Pro’s internal components degrade, crack and/or break off into small pieces during ordinary and foreseeable use,” the Momcozy class action lawsuit says.
Adinolfi and Toro want to represent a New York class and multi-state consumer protection class of consumers from California, Florida, Illinois, Massachusetts, Michigan, Minnesota, Missouri, New Jersey, New York and Washington who purchased a KleanPal Pro from Momcozy or an authorized retailer for personal use and not for resale
Momcozy has known about defect ‘for years,’ class action says
Adinolfi and Toro claim Momcozy has known about the alleged defect “for years,” as evidenced by the company receiving numerous complaints and warranty claims from consumers.
Despite this knowledge, Momcozy has continued to sell the KleanPal Pro at a premium price of $299.99 without disclosing the defect to consumers, the Momcozy class action lawsuit alleges.
Adinolfi and Toro further argue that Momcozy’s marketing campaign misleads consumers by representing the KleanPal Pro as safe and durable.
“To persuade reasonable consumers, including parents and caregivers, to purchase the KleanPal Pro for this premium price, Momcozy utilizes a deceptive safe baby product marketing campaign uniformly representing the KleanPal Pro as safe and suitable for its advertised functions,” the Momcozy class action lawsuit says.
Adinolfi and Toro claim Momcozy is guilty of unjust enrichment, negligent misrepresentation, common law fraud, breach of warranty and violations of New York and state consumer laws.
The plaintiffs demand a jury trial and request declaratory and injunctive relief and an award of actual and punitive damages for themselves and all class members.
In other recent news involving a baby product, a2 Milk Company recalled more than 60,000 units of a2 Platinum Premium Infant Formula in May due to the presence of cereulide toxin from Bacillus cereus.
