Cuisine Solutions Oatmeal bitesA recent Cuisine Solutions class action lawsuit claims that the company’s oatmeal bites are being sold with inaccurate nutrition facts.

Plaintiff Ruth Smith claims she and other consumers were deceived by the false nutrition facts that promised lower carb levels than were accurate.

Cuisine Solutions specializes in the “sous-vide” cooking method – the practice of placing food in a vacuum sealed container and cooking it to a precise temperature in a water bath. A variety of foods are sold by Cuisine Solutions, including their Sous-Vide Oatmeal Bites.

Smith says she purchased the Cuisine Solutions Oatmeal Bites from her local Costco in February 2020. According to the Cuisine Solutions class action, Smith’s purchase was based on the product’s representations regarding nutrition content. However, these representations are reportedly false.

Specifically, the representations regarding carbohydrates are false and misleading, argues the plaintiff.

Each serving of the oatmeal bites reportedly contains 41 grams of carbohydrates. Although this number is accurate, Smith claims that Cuisine Solutions misrepresents this amount as only one percent of the daily reference value for carbohydrates.

Based on a standard daily caloric intake of 2000 calories, the daily reference value for carbohydrates is 275 grams for adults and children who are over the age of four. Based on this information, one percent of the daily reference value would be 2.75 grams.

Smith argues that Cuisine Solutions “inaccurately and deceptively represents” their products as containing only one percent of the daily reference value for carbohydrates. She further claims that the nutritional fact disclosure, which “understates the [daily reference value] in a serving by nearly 15 fold,” is deceptive.

The Cuisine Solutions class action claims that this alleged mislabeling may have convinced consumers to buy the products. Carbohydrate content is an important metric which many health-conscious consumers pay attention to. Smith claims that, had she and other consumers known the truth about the oatmeal bites’ nutritional information, they may not have purchased the products.

“Defendant’s overstatement of key nutritional information is so substantial and deviates well beyond the bounds of any margin of error, that had plaintiff and members of the Class known of the true nutritional value of defendant’s Sous-Vide Oatmeal Bites, they would not have purchased the product,” the Cuisine Solutions class action lawsuit claims.

Smith seeks to represent a Class of consumers who purchased Cuisine Solutions’ Sous-Vide Oatmeal Bites where the daily reference value for carbohydrates was misrepresented.

On behalf of herself and potential Class Members, Smith seeks monetary damages of between $500 and $1,000 for violations of Virginia consumer protection laws, along with other relief.
