FCA Faulty Valve Train Systems Class Action Lawsuit Overview: 

  • Who: Shawn Petro, Mike Fairchild and David Kinchen filed a class action lawsuit against FCA US LLC. 
  • Why: Petro, Fairchild and Kinchen claim FCA fails to disclose that it manufactures, distributes and sells certain vehicles built with defective engine valve train systems.
  • Where: The class action lawsuit was filed in Delaware federal court. 

FCA US LLC manufactured, distributed and sold vehicles containing defective engine valve train systems, a fact it failed to disclose to consumers, a new class action lawsuit alleges. 

Plaintiffs Shawn Petro, Mike Fairchild and David Kinchen claim the FCA-manufactured engine valve train systems in question were defective in “design, workmanship and/or materials.” 

“This is a consumer class action concerning a failure to disclose—or omission of— material facts and a safety concern to consumers,” the FCA class action states.

The class vehicles include all model year 2014 to present Dodge, RAM, Jeep and Chrysler vehicles containing a Gen III 5.7-liter HEMI or 6.4-liter HEMI 392 engine, according to the FCA class action. 

Petro, Fairchild and Kinchen claim valve train components in the engine valve train systems prematurely fail due to defects in design, material and workmanship, among other things. 

“The Defect ultimately causes premature internal wear to the engine and requires premature replacement of valve train components, including the camshafts,” the FCA class action states. 

Alleged Defect In FCA Vehicles ‘Substantially Decreases’ Value, According to Class Action

Petro, Fairchild and Kinchen argue the alleged defect “substantially decreases” the value of the class vehicles and forces owners and lessees to either spend “significant money” for repairs or simply “hope FCA will cover the cost.” 

Further, the plaintiffs argue repairing the vehicle doesn’t ultimately solve the issue since “the customer would simply be given another defective part or engine in its place.”

“As a result, the Valve Train Defect will manifest again, often outside the warranty period, and Class Members must then personally bear the cost of replacing lifters, rocker arms, valve springs and other damaged components,” the FCA class action states.

Petro, Fairchild and Kinchen claim FCA has not only been unable to remedy the defect, but that it has been both aware of and concealing it since as far back as 2013. 

“Despite access to aggregate internal data, FCA has actively concealed the existence of the Valve Train Defect by claiming that consumers are responsible for the failures, even when consumers follow FCA’s published maintenance schedules,” the FCA class action states.

Petro, Fairchild and Kinchen claim FCA is guilty of fraudulent concealment, unjust enrichment and breach of express warranty and in violation of the Magnuson-Moss Warranty Act and several state consumer protection acts.

They want to represent a nationwide class and Illinois, Oklahoma and Louisiana subclasses of all persons or entities who purchased a vehicle containing a defective engine valve train system.

Plaintiffs are demanding a jury trial and requesting declaratory relief along with punitive, exemplary and compensatory damages for themselves and all class members.

Consumers filed a similar class action lawsuit against FCA earlier this year claiming the company sold certain vehicles built with defective 3.6L Pentastar V6 Engines

    Is this still being pursued? My case is a perfect illustration of the issue. I asked Dodge to reimburse me for at least half of the repair based on Warranty Bulletin D-14-12, but Dodge is refusing to honor that.

    2015 Charger with the 6.4 392 HEMI here.. MDS lifter failure at 66k miles outside of warranty. 4800.00 later, a new cam, new lifters, etc. I wonder how long until these fail again.

    I suffered the same problem on a 13 Ram 1500 sport with the 5.7L. I live in Canada and was advised that canadian trucks didn’t have the same issues as the American trucks. I ended up doing a motor swap, cam shaft was destroyed, I lifter completely seized with others showing signs of wear. I wish we could get a lawsuit going in Canada. I am currently having suspension issues on a 2022 Grand Wagoneer. It was discovered that multiple components such as hub nuts and sway bar links were not torqued. FCA should be held accountable for this nonsense. The big corporation tries to bully the consumers and I guarantee they win 99% of the time. It’s criminal.

    2015 Jeep Grand Cherokee with 115,000 miles. Started hearing a ticking noise from the right side of the engine. I took it to a local car shop and they diagnosed it as a bad rocker arm. The rocker had dug about a half mm groove into the cam lobe. So all 4 camshafts and all rockers have to be replaced. It was quoted as approx $4,000 to be fixed. Car is in the shop right now. Waiting on the the price for the final bill.

    2011 Grand Jeep Cherokee Limited 4×4 with a HEMI V8 5.7 L engine purchased in December 2021 with less than 99k miles, yet taken to the CDJR service for recall repairs three times. By the third time the CDJR dealership kept my Jeep for almost a month, leaving me without transportation. They offered no loaner vehicle, stated the Jeep was not safe to drive and doing so could cause further engine damage. Only for them to tell me a month later the Jeep is drivable after I refuse to agree to $450 “tear down cost” for further diagnostics the service center asserted the extended warranty provider demanded before they would even consider the engine repairs CDJR insisted were needed. CDJR stated the engine misfire codes, bogging down, ticking, and gas fumes coming through the cabin were caused by worn cams, pistons, and needed lifter replacement, totalling a cost over $6500. They ultimately refuse to fix it. I had to pay $150 to tow my Jeep from their repair center back to my house! I have contacted Jeep, to no avail. Likewise with Chrysler. Livid does not begin to describe $15G for a pile of metal, $6500 in needed repairs or come close to defining the value of priceless time lost during a month without a vehicle while living in rural Georgia! (FYI CHRYSLER/DODGE/JEEP/RAM: One thing about the rural south… word gets around faster than a little blue birdy can utter a tweet. Tweet. Tweet )

    I have a 2021 Dodge Durango R/T with the 5.7 Hemi. I had it at the dealer two and a half weeks ago because I thought the engine sounded more noisy and it was idiling rough. Fast forward to 10/11/2022. I got gas. And restarted my Durango and it was excessively knocking. I had to have it towed to a dealership. I have a video for proof. I have been trying to get ahold of my dodge case manager since 10/5/2022 does to the loud engine noises. And even after having to have it towed I have not received a call from my case manager as promised. My car is sitting at the dealership where they “can’t get it to make the noise”.

      2014 jeep grand cherokee srt engine failed at 65k miles in July 2020. Lifter failed and wore camshaft down to nothing. Dealer tried to repair engine but it didn’t last 19 miles. Had to buy a mopar 6.4 long block with 60k warranty plus labor. 6 weeks to fix and many thousands out of pocket. Jeep..Just empty every pocket..

    2014 ram 1500 $5500 lifter repair and camshaft. Homie had the same problem in his 300 Chrysler. $5700. Someone needs to represent and be the voice. No attorney I have spoke to wants to take this case due to non bodily injury. 512.745.5174 someone call me when they figure something out so I can voice my concern. I’ll be posting to other sites and forums looking for a solution for all. God bless

      My 2014 RAM 1500 limited edition cams lifters failed. 3 dealerships in Houston said “that’s how these engines sound.” Starting at 18,243 when cams/lifters code 1st popped up. 73,616 ticking was constant. Moved to AL, they drove it around the block & said ticking says cams/lifters failure & wants $5k to replace with same faulty part & refuses to acknowledge my engine is shot (knocking & no power). FCA won’t speak with me after I provided evidence. Told me I have to get an attorney to contact them… I’m a pissed broke single mom with no working vehicle & can’t even sell the dang thing & gonna lose my job not having a ride. I suggest we all flood the media, social media, attorney generals, attorneys on the class action (their names are listed on filing) etc. I didn’t know about all this till AL RAM didn’t match the cover-up & I started digging. I want everyone to know! Equivalent Ford f-150 with way more miles is worth double our rams. Same with Toyota Tundra. Disturbing there is no justice for consumers. I’ve been combing through attorneys Let’s stop buying their literal shit, that’s a start!

    2015 dodge challenger 5.7 rt plus; Failed lifters and the camshaft is flattening itself, only 130k miles.
    Out of warranty and don’t want to spend thousands to replace with faulty OEM parts.
