Dell Service Contract Class Action Settlement

DellA settlement has been reached in a class action lawsuit about Dell desktop and notebook computers with at-home service contracts sold in California and Arizona. You may be entitled to receive a payment of up to $10 if you meet the requirements of the Dell settlement class.

 

The Dell class action lawsuit, entitled Fiori et al. v. Dell Inc. et al., alleges Dell and the other defendants engaged in wrongful conduct by failing to disclose that there was a cost for the first-year at-home service contract and by representing that at-home service would occur on the next business day after a customer initially requested service from Dell. Dell denies any wrongdoing, but has agreed to establish a $30 million settlement fund to pay out eligible class members.

 

To be considered a class member of the Fiori v. Dell class action lawsuit settlement, you must be a consumer in California or Arizona who purchased a Dell notebook or desktop computer with an at-home service contract directly from Dell between January 1, 2000 and July 31, 2010. Class members who submit valid claims postmarked by the deadline of May 20, 2011 will receive either a $10, $8 or $4 cash benefit from the Dell service contract class action settlement. Those who wish to exclude themselves from the class action settlement must submit their request by February 22, 2011.

 

In addition to cash payments, the Dell service contract settlement will require Dell to implement the following changes to their sales practices for at least two years:

 

(I) Invoices and acknowledgements sent to consumers will not list $0 next to Service Contracts that are sold with the computer system;

(II) The price of a Service Contract sold with a computer shall be disclosed to consumers in the invoice, acknowledgement, Service Contract, or accompanying documentation; and

(III) Dell will disclose pricing information for Service Contracts for its computers on its website and by telephone.

    I bought a Dell computer for my wife in December 2022 and was somehow signed up for a year of Mcafee Virus protection. Over the years this has turned into an auto renewal that is being charged to my credit card, at a higher rate than what Mcafee independantly charges. And if not noticed, has been renewing at about $127.33 annually. In Novemeber 2025, I received an email from Dell stating that the Dell-Mcafee fee was going to be charged in mid December. I responded that I wanted to know what the charged was for and received no answer. A week later, I got the same email from Dell and this time, I responded that I did no want whatever this product was and once again, did not get an answer. In January 2026, my credit card was charged $127.33 from Dell. I tried to contact Dell, but there appears to be no way to contact a human and was only able to Chat with bots that cannot help. I asked the bot to speak to a human and the bot chat placed me in a waitng cue. At the end of the wait, I ended up chatting with another Chat Bot that directed me to “Dell Digital Locker”. At the Dell Digital Locker, there is a message stating that Dell Digital Locker has moved, to another address. This became an endless loop of going from point to point. Whenever you get to the area where you believe you can cancel any auto renewal, it shows that I do not have an account, nor any credit card on file, but somehow, Dell is charging my credit card, year after year. I contacted Citi Bank and placed this charge in dispute in the first few days of January. After a month, they advised that they contacted Dell and Dell advised that it was a valid charged because the customer did not cancel the auto renewal in the time limit required and they printed instructions on how to cancel it. Citi Band Visa advised me that they were going to charge my account in the next two billing cycles. I called Citi Bank and this time tey said that they were going to make the Dell charge perminate in dispute. Realizing that coming Nov-Dec 2026 that would have to got through this all again, I once again tried to log into Dell online and carefully try to follow their instructions. But the same issues were found that the Dell Digital Locker as moved and the areas that they said that I had to visit had the menu changed, or that I did not have an account, a credit card on file and that I didn’t even have a subscription.

    Recently, I read somewhere that a large company was sued in a Class Action as they also made it difficult or impossible to try and cancel customer’s subscriptions and it appears that Dell is doing the same.

    I purchased a Dell laptop XPS 1530 in 2008. Upon needing repair of my newly purchased laptop I found the so called techs. Dell sent out to do the repairs were completely incompetent. But even more frustrating was trying to comunicate with the middle easterners that you get when you call for assistance on the phone. First of all you simply cannot understand them with the accent they have. Second when asking to speak to a English speaking representative i could understand they just beat around the bush never granting my request. Last but not least Dell and their middle eastern crew made multiple promises to make things right but failed to ever come through with any of the promises they made leaving me with a computer that did not work or perform even the most basic tasks . I eventully threw the computer in the trash having no use for the malfunctioning device. Thanks Dell for a $1,700 piece of garbage.
