The clothing brand Citizens of Humanity is facing a false advertising lawsuit from consumers who allege that the company’s jeans were not made in America contrary to the company’s “Made in USA” marketing claim.
Citizens of Humanity is one of America’s leading designers and manufacturers of denim jeans, distributing to more than 1,300 retailers around the world.
While the company claims its products are made in America, foreign components have been found in them including fabric, thread, buttons, rivets, and sub-components of the zipper assembly.
Some states, including California, restrict what can be advertised as “Made in USA” to only those products made entirely of American-made components. State laws allow consumers to file false advertising lawsuits in cases when companies allegedly misled them by making false claims about their products’ origins.
Overview of False Advertising Allegations
Plaintiff Louise C. purchased Boyfriend jeans, the defendant’s product, from a Macy’s on May 31, 2014. She alleges she was misled that the product was American-made when it actually had foreign components.
Louise claims that the jeans she bought were not worth the price she paid and is seeking reimbursement from the company. Louise accused Citizens of Humanity of false advertising.
Because Americans are willing to more money for American-made goods, companies are accused of making such allegedly false marketing claims to justify higher prices.
The Citizens of Humanity lawsuit is Case No. 3:14-cv-01404-JLS-WVG, in the U.S. District Court of Southern California.
