Jeep class action lawsuitThe Chrysler Group LLC, which is now known as FCA US LLC, was hit with an amended class action lawsuit in a New Jersey federal court, alleging that the 2014 Jeep Cherokees have defective transmissions that are wrought with problems.

Plaintiff Stacy Oquendo, who lives in New Jersey, says in her Jeep Cherokee class action lawsuit filed on Aug. 6 that she purchased her Jeep Cherokee in April 2014, which she has since had “repeated problems” with.

“The repair history reflects complaints of the transmission not shifting properly, and other transmission problems,” the class action lawsuit says.

Because of the transmission problems she claims her Jeep Cherokee has faced, Oquendo says that “she has lost the use of her vehicle for repair, the value of the vehicle is diminished because of its frequent and persistent problems, and the vehicle poses safety concerns to the driver and occupants.”

The New Jersey woman claims that her Jeep Cherokee has faced an “abnormal” amount of “transmission, problems, malfunction, and failure.”

And she claims that she’s not the only 2014 Jeep Cherokee owner that has had these types of problems. Oquendo cites various publications that have reported on the transmission problems occurring in other 2014 Jeep Cherokees as well.

The Jeep Cherokee class action lawsuit cited Car and Driver as one such publication that has cited similar transmission problems: “At least 12 out of 30 complaints submitted thus far to the National Highway Traffic Safety Administration cite poor shift quality, including transmissions that held gears for too long or suddenly shifted into neutral.”

The industry magazine says that “Chrysler delayed the Cherokee’s launch last fall by several weeks to make last-minute fixes to the new transmission and then released two technical service bulletins,” which included “an entire step-by-step process to recalibrate the adaptive software to better match the owner’s driving style.”

These fixes, Car and Driver explains, are “supposed to smooth out shifts from first to second and second to third.”

The publication added that in its “reviews of a four-cylinder and various V-6 Cherokees, we noticed erratic behavior from the nine-speed. It would deliver crisp, well-timed shifts on some occasions, yet on others would respond with slurred and delayed changes.”

Oquendo says that the problems described by Car and Driver are the problems that both she and other potential Class Members have experienced.

However, the Jeep Cherokee class action says that instead of acknowledging “the problem Chrysler has proceeded to deny and/or conceal the problem and directed its dealers to provide deceptive, false, or misleading explanations for the failure to provide warranty coverage and reimbursement.”

The New Jersey woman is charging Chrysler with breach of express warranty, breach of implied warranty of merchantability, fraud, violating the Consumer Fraud Act, and violating the Magnuson-Moss Act.

Oquendo is looking to represent a class of 2014 Jeep Cherokee owners who purchased their vehicles in New Jersey, New York, Delaware and Connecticut, have experienced transmission problems with their vehicles, have had to pay for rental vehicles during repairs, and have also been hurt because of the loss of use and diminished value of their vehicles.

The Jeep Cherokee class action lawsuit was first filed in in a New Jersey state court in May, but Chrysler had the Jeep Cherokee class action lawsuit transferred to the federal court because there were cross-state issues.

Oquendo is represented by Howard A. Gutman of the Law Office of Howard A. Gutman.

Chrysler is represented by Thomas R. Curtin of Graham Curtin PA.

The Jeep Cherokee Class Action Lawsuit is Oquendo v. Chrysler Group LLC, Case No. 3:15-cv-05056 in the U.S. District Court for the District of New Jersey.

    Having the same problem with my 2014 Jeep Cherokee Limited, including the car stalling while driving. Been to the dealership multiple times and have paid a lot of money to have the issue “fixed” when in reality it never fixed the stalling issue. Very Dangerous. Have also had the shifting problem the past 3 years with the vehicle.

      I purchased my 2014 Limited Jeep Cherokee in April of 2014 and have complained repeatedly over the past 3 years of the jeep sounding as it was a moped while being driven.I have multiple recalls and have always taken my jeep in to have the recalls addressed. It just so happens one of the recalls was on the TCM and PCM. Last week while driving 50mph a “service transmission” message began flashing and my car locked up. I couldnt use my breaks or put the jeep in park. That is a scary and VERY dangerous situation to have to experience! I called for a tow truck service and had my jeep towed into the dealership. Three days later I was contacted by the dealership and told they could not find any problems other than it needing to be updated.
      On the fourth day of having my Jeep back, the SAME thing happened AGAIN while driving down the road. The jeep was taken back to the dealership and I was informed today that I will need to pay $5,550 for a NEW TRANSMISSION!
      I am a Home Health Nurse and do alot of driving so there is 105,000 miles on my jeep and no warranty other than the engine extended warranty I pay extra for.
      I dont know what to do! I NEED a vehicle, but I dont feel I should be responsible for the cost of a new transmission.
      I have gone on mycarfax.com and printed all my visits to the dealership as well as proof that all the Jeep was taken to the dealership so the recalls could be addressed.
      Any suggestions?

    I’m in Pennsylvania and I am experiencing the same problems. I have had the recall some to my 2014 Cherokee, then they put in a new transmission, and since that I am still having problems. As a matter of fact, it’s at the dealership now. My jeep only has 28,000 miles on it. Something needs to be done. Chrysler/jeep does not care about its customers. They would much rather pay attorneys legal fees.

    I’m in Virginia with a 2014 Cherokee experiencing same problems. Although I bought my Jeep down here (and it originated in Jersey) this is a worldwide issue. It is SO unsafe, especially trying to fight to get in to the traffic in this area. Laura.trommer@gmail.com if anyone already has something going on this, I’d love to be involved.

    I had transmission service message on dash, trans stayed in 7th attempting to re-accelerate after slowdown on freeway. Dealer did trans control module software update. Same problem has not re-occurred but other failure to down shifts have occurred.

    Vehicle is 2015 Jeep Cherokee V6 Lattitude w/9 speed trans. 18,000 mi.

    Read some of the complaints in NHTSA website, servicing problems is not solving their problems. My dealer denied other owners are having similar problems.

    I would like to join any class action suit too, can someone help me?
    3 times in the shop for the same BS. First they claim it was battery, second claimed as sensor and now a sensor again :(

    I have a 2014 Jeep Cherokee limited. The car has been in the shop a many times with the same symptoms as those described in many of the other posters. I tried the Lemon Law in California and the attorney said I didn’t have enough of a case because the dealer’s written paperwork states that it is acting normally. I would like to join any class action suit.

      I bought a 2006 jeep with about 10k miles in it after about 3 weeks going down the road I let off the gas as I approached a red light when it geared down the rear end locked up when the light turned green I pressed the gas pedal and it acted like it was in neutralfor a second and the tool off
      I took it to the dealership on like a Monday picked it up Friday and was dropping it back off Monday I did this about 5 times tried to push the lemon law and got nothing I still have the jeep and the tranny has been nothing but problems. It goes in to neutral all the time.I usalky through it in neutral going dwon a highway then put it back in drive when it does it sometimes it will go back into gear sometimes I have to just pull over onhook the battery let it set about 5 minutes then it will drive again.
      I now absolutely hate jeepn

    It’s not just an issue with manual transmissions it’s with automatics as well. And the issue is nationwide. I live in San Diego and had my vehicle lock up while driving on the freeway at night. Took it in tp the dealership and they had to replace the entire transmission and everything. Thank goodness I still had coverage under Powertrain so I didn’t have to pay for it. But there was less than 65k miles on it. And my vehicle is acting funny again and this was in December.

      I’m in Canada and have a 2015 Cherokee Sport exhibiting similar transmission problems and in particular a sudden slowdown where the transmission service light comes on and it will go no faster than 20-25 km per hour and shut down. Very scary on freeways. Been in for servicing 4 times and only after the first I was told it was a software issue. Now I’m told that they can’t prove I have a faulty transmission because I left the car with them for 3 days and nothing happened. I’m 72 and expected to have a reliable vehicle at this stage of my life.

    is there anything in Canada? I have a 2014 Jeep Cherokee Sport with the 9 speed transmission and I have issues with it like hesitation,hard shifting and jerking when I step on the gas..

    I’m having the same problem here in Florida with my 2014 Latitude. I have been to the dealership numerous of times with my concerns and was told there was no problem. When my vehicle comes to a stop and than I try to go, it stalls and drag. Now today I receive a recall notice. Just a bandade on one of the numerous problems.
