Jeep class action lawsuitThe Chrysler Group LLC, which is now known as FCA US LLC, was hit with an amended class action lawsuit in a New Jersey federal court, alleging that the 2014 Jeep Cherokees have defective transmissions that are wrought with problems.

Plaintiff Stacy Oquendo, who lives in New Jersey, says in her Jeep Cherokee class action lawsuit filed on Aug. 6 that she purchased her Jeep Cherokee in April 2014, which she has since had “repeated problems” with.

“The repair history reflects complaints of the transmission not shifting properly, and other transmission problems,” the class action lawsuit says.

Because of the transmission problems she claims her Jeep Cherokee has faced, Oquendo says that “she has lost the use of her vehicle for repair, the value of the vehicle is diminished because of its frequent and persistent problems, and the vehicle poses safety concerns to the driver and occupants.”

The New Jersey woman claims that her Jeep Cherokee has faced an “abnormal” amount of “transmission, problems, malfunction, and failure.”

And she claims that she’s not the only 2014 Jeep Cherokee owner that has had these types of problems. Oquendo cites various publications that have reported on the transmission problems occurring in other 2014 Jeep Cherokees as well.

The Jeep Cherokee class action lawsuit cited Car and Driver as one such publication that has cited similar transmission problems: “At least 12 out of 30 complaints submitted thus far to the National Highway Traffic Safety Administration cite poor shift quality, including transmissions that held gears for too long or suddenly shifted into neutral.”

The industry magazine says that “Chrysler delayed the Cherokee’s launch last fall by several weeks to make last-minute fixes to the new transmission and then released two technical service bulletins,” which included “an entire step-by-step process to recalibrate the adaptive software to better match the owner’s driving style.”

These fixes, Car and Driver explains, are “supposed to smooth out shifts from first to second and second to third.”

The publication added that in its “reviews of a four-cylinder and various V-6 Cherokees, we noticed erratic behavior from the nine-speed. It would deliver crisp, well-timed shifts on some occasions, yet on others would respond with slurred and delayed changes.”

Oquendo says that the problems described by Car and Driver are the problems that both she and other potential Class Members have experienced.

However, the Jeep Cherokee class action says that instead of acknowledging “the problem Chrysler has proceeded to deny and/or conceal the problem and directed its dealers to provide deceptive, false, or misleading explanations for the failure to provide warranty coverage and reimbursement.”

The New Jersey woman is charging Chrysler with breach of express warranty, breach of implied warranty of merchantability, fraud, violating the Consumer Fraud Act, and violating the Magnuson-Moss Act.

Oquendo is looking to represent a class of 2014 Jeep Cherokee owners who purchased their vehicles in New Jersey, New York, Delaware and Connecticut, have experienced transmission problems with their vehicles, have had to pay for rental vehicles during repairs, and have also been hurt because of the loss of use and diminished value of their vehicles.

The Jeep Cherokee class action lawsuit was first filed in in a New Jersey state court in May, but Chrysler had the Jeep Cherokee class action lawsuit transferred to the federal court because there were cross-state issues.

Oquendo is represented by Howard A. Gutman of the Law Office of Howard A. Gutman.

Chrysler is represented by Thomas R. Curtin of Graham Curtin PA.

The Jeep Cherokee Class Action Lawsuit is Oquendo v. Chrysler Group LLC, Case No. 3:15-cv-05056 in the U.S. District Court for the District of New Jersey.

    I’m having all these same issues. Has anyone got a clue where I start? I’m about to be out of warranty and SCREWED! I’ve had the “software” update and now a re-manufactured transmission being put in.

    I have been having issues with 2014 Cherokee Trailhawk v6 nine speed transmission, on occasion refusing to downshift causing a dangerously poor acceleration event since day one. I have complained to dealer, FCA, complaints.com and more.
    FCA told me they found the vehicle to be working as intended and the transmission was working as programmed.
    I drove it and issue was not resolved/returned. Re-flashed again just like before. Worked for a couple months, issue returned. Vehicle out of warranty, FCA case closed.
    This is how I was treated.

    My 2014 Jeep Cherokee has had a problem with bucking and rough shifting since the day I bought it brand new. I brought it in and they did a software update which helped but did not fix the issue. It was bad again today to the point it would keep stalling then when I got it running again, it would barely move then take off like a race car. The drive button was blinking, saying shift into gear, even though it was. It says service transmission. The banging noise as I put it in gear or park was so loud and the entire car was jerking forward with it. I’m bringing it in again tomorrow but I am so not happy!!!

      My 2014 does the same, except mine will go to idle and shift to neutral while you driving. I the middle of the highway you have to turn it off, wait, then start up, it bangs into gear and the dash looks like a Christmas tree. After dropping it off today the service manager says your oil is a little low. I said your kidding right.

    I have a 2016 Jeep Renegade and it keeps cutting off on me while I am driving it and I am fearful that this could be the cause of me being in a major accident. Please advise. I think that my car has electrical issues. The first incident within the first year my radiator fan went out on me and it took the dealer like 2 months to fix my vehicle.

    Hello my name is larry i purchased a used 2014 jeep cherokee trailhawk at the time i got it the transmission had a hard shift to it in which it is automatic trans in it.i got the jeep from carmax in which they told me of the recall notice in which i took it over to the local jeep service dealership and they told me it needed a software update in which they did free of charge.but now it seems to be doing the same thing all over again it has about 52,350 miles on the vehcile what should i do any helpful hints will be appreciated thank you

    My 2014 loses power while on the highway. When I pull over and restart the car it is stuck in a low gear. I pull over again and reset the electro ice and it is fine for a day or two.

    I bought a 2016 jeep renegade sport brand new at 6000 miles my transmission started shifting rough and I hear a knocking noise when I coast and drop my speed down by 5 mph and re-gas it. I have had my car in the dealership repair shop for over 50 days collectively replace timing belt and tension pulley twice, but is still the same. They finally said it is a common characteristic of the vehicle when they couldn’t fix it.
    I have escalated it to the factory. A few months latter finally a technician from Chrysler factory came out and said the noise is coming from the vacuum pump and tensioner and is claiming it is a normal situation and functioning properly. The technician tried to say it’s the way I’m driving the vehicle. He said he would ask Chrysler to change the vacuum pump for me but couldn’t guarantee the noise would go away. Funny enough Chrysler called me back to follow up and knows nothing about replacing the part and My case manager at Chrysler is now offering me $1000 to settle with the noise. If I were to sign some paperwork. I said I don’t want money I just want my car fixed. I asked for the part to be replaced. Then they said they would put the part in if I signed the paperwork. I said no because the part is under warranty
    I am ready to file a lemon law on this. Super criminal the way they’ve run me around for months with no repair.
    I want to be a part of the class act.
    Who do I contact and how do I sign up?
    I need help with this crazy game they are playing

      I’m getting the same issues. They first told me it was software now I’m getting a whole transmission. I’m running out of warranty in 10k miles and the dealership won’t budge.

    I have the same issues with my 2014 Jeep Cherokee Limited. Lots of constant jerky starts & stalls. The worst and most dangerous part is when the vehicle actually will stall when taking off from a dead start and then it stalls for a second or two nearly causing a collision with oncoming traffic. So scary that my wife will not drive my car now, only hers. Read CR review of this transmission problem but they stated that likely it could be fixed with a software update. Now it looks like that is not the case. What can I do about this? Who do I tell that can help me?

    I have a 2015 Jeep Cherokee Latitude 4×4 with a V6 engine and Active Drive II. Transmission issue started before 5,000 miles were on the car. Every time I took it back to the dealership I was told “it’s a known issue and it’s not pulling any codes”. The car cuts off every time you use the brake, transmission shifts hard in low gear especially in traffic with a lot of stopping and starting, and will jerk the whole car, car jerks when transmission is shifting gears either slowing down or up and even hesitates in shifting gears. Turned car in as lemon and did not hear from Chrysler/Jeep and I know they received it because their customer service told me they did and dealership has not contacted me. Now when I take it to the dealership it comes back with programming missing. The dealership service department was pushing an extended warranty very hard and that would cost $5,000 plus and you still have to pay a $85.00 fee to have the diagnostics done on the car. The car cutting off issue they want $105.00 diagnostics fee and because the car is over 36,000 miles any repairs are not covered under warranty.

    I had my brand new 2015 latitude need a new transmission when it was’t even a month old and I hadn’t even made the first payment. When I called to bring it in, the dealership asked me if the mat was getting stuck under the gas pedal. Um no! It’s been through all the recalls and still drives like crap. My just learning to drive daughter hates it. Can’t wait for this to go through the courts.

      I bought a 2014 and I’ve only had it for 2 months and I’m having the same issues. I’m located in Chicago IL. I am so upset. I understand your frustration. I’m not sure what to do.

        I’ve had my 14 since October and the car keeps shutting off on me. Trans slips just doesn’t run right and they won’t repair saying it’s not pulling codes and it might be because you’re going pass second click when getting gas. Um no that trans is shot.
