Jeep class action lawsuitThe Chrysler Group LLC, which is now known as FCA US LLC, was hit with an amended class action lawsuit in a New Jersey federal court, alleging that the 2014 Jeep Cherokees have defective transmissions that are wrought with problems.

Plaintiff Stacy Oquendo, who lives in New Jersey, says in her Jeep Cherokee class action lawsuit filed on Aug. 6 that she purchased her Jeep Cherokee in April 2014, which she has since had “repeated problems” with.

“The repair history reflects complaints of the transmission not shifting properly, and other transmission problems,” the class action lawsuit says.

Because of the transmission problems she claims her Jeep Cherokee has faced, Oquendo says that “she has lost the use of her vehicle for repair, the value of the vehicle is diminished because of its frequent and persistent problems, and the vehicle poses safety concerns to the driver and occupants.”

The New Jersey woman claims that her Jeep Cherokee has faced an “abnormal” amount of “transmission, problems, malfunction, and failure.”

And she claims that she’s not the only 2014 Jeep Cherokee owner that has had these types of problems. Oquendo cites various publications that have reported on the transmission problems occurring in other 2014 Jeep Cherokees as well.

The Jeep Cherokee class action lawsuit cited Car and Driver as one such publication that has cited similar transmission problems: “At least 12 out of 30 complaints submitted thus far to the National Highway Traffic Safety Administration cite poor shift quality, including transmissions that held gears for too long or suddenly shifted into neutral.”

The industry magazine says that “Chrysler delayed the Cherokee’s launch last fall by several weeks to make last-minute fixes to the new transmission and then released two technical service bulletins,” which included “an entire step-by-step process to recalibrate the adaptive software to better match the owner’s driving style.”

These fixes, Car and Driver explains, are “supposed to smooth out shifts from first to second and second to third.”

The publication added that in its “reviews of a four-cylinder and various V-6 Cherokees, we noticed erratic behavior from the nine-speed. It would deliver crisp, well-timed shifts on some occasions, yet on others would respond with slurred and delayed changes.”

Oquendo says that the problems described by Car and Driver are the problems that both she and other potential Class Members have experienced.

However, the Jeep Cherokee class action says that instead of acknowledging “the problem Chrysler has proceeded to deny and/or conceal the problem and directed its dealers to provide deceptive, false, or misleading explanations for the failure to provide warranty coverage and reimbursement.”

The New Jersey woman is charging Chrysler with breach of express warranty, breach of implied warranty of merchantability, fraud, violating the Consumer Fraud Act, and violating the Magnuson-Moss Act.

Oquendo is looking to represent a class of 2014 Jeep Cherokee owners who purchased their vehicles in New Jersey, New York, Delaware and Connecticut, have experienced transmission problems with their vehicles, have had to pay for rental vehicles during repairs, and have also been hurt because of the loss of use and diminished value of their vehicles.

The Jeep Cherokee class action lawsuit was first filed in in a New Jersey state court in May, but Chrysler had the Jeep Cherokee class action lawsuit transferred to the federal court because there were cross-state issues.

Oquendo is represented by Howard A. Gutman of the Law Office of Howard A. Gutman.

Chrysler is represented by Thomas R. Curtin of Graham Curtin PA.

The Jeep Cherokee Class Action Lawsuit is Oquendo v. Chrysler Group LLC, Case No. 3:15-cv-05056 in the U.S. District Court for the District of New Jersey.

    I have a 2014 jeep Cherokee lattitude and am having the same issues. It’s a real safety concern driving this vehicle with my son in it. We have almost had a few accidents already and I just purchased this vehicle in April 2017. I sent it back in the dealership within a week of purchasing it for transmission issues and it still hasn’t been fixed yet!! It is also burning an extreme amount of oil . A quart every 1000 miles. Have asked dealership for my money back but they won’t .. they said they told me to just keep sending it in for repairs and they will keep trying to fix it . I would like in on this lawsuit also. I’m in Rhode island

    I have the same issue mine is a 2016, when I mentioned this to Service I was told it was he design of the transmission! Is this lawsuit still open and is it just for 2014 models?

    I purchased a Jeep Grand Cherokee in June 2014. I have had similar issues with acceleration and shifting. From day one, recalls started and have continued since then. Please add me to the class action suit.

    I purchased my 2014 jeep Cherokee at the end of 2013 and have had problems from the start. I have repeatedly taken my car in for service and have been told there was no problem. Most recent is today 10\9\17 where I explained that on a trip from NYC to nj, I had to press harder on the gas to accelerate whi!e the engine was revving the entire time. The scariest part of my commute was coming home where the speedometer was reading 91mph when I was actually going 55 to 60 on a curvy stretch of the highway. After getting off the highway foot on the break slowing down to make a turn still got a reading of 45 mph when I was practically stopped. Fed up with all the recalls and the problems with this jeep and can’t get it signed for a lemon because the service center does not write the problem so that it shows the same issue 3 times. I want in on any class action suits being filed against Chrysler. Totally fed up.

      I also just had service 2 weeks ago on my transmission on our 2014 Jeep Cherokee. Adaptive software to relearn they said. It was good for 2 days and now back to the same rough shifts delayed responses from accelerator. I also want in on any class action lawsuit. Vehicle has been in several times since 3 months old and we have been extremely patient with it over the last 3 years.

    I have a 2014 Jeep Cherokee sport same issue car surges, car shuts off while driving, ignition issues, i have had a new transmission put in, cam shaft sensors x3, valve replacements, updates on everything and i picked up the car yesterday and it is going back in the shop today for same surges. I am so disturbed with this car, i am scared to drive my car.

    I owned a 2015 jeep cherokee sport limited and had issues from the “get go”. Chrysler replaced the transmission, drive shaft, steering rack column, battery, multiple software updates, issues with the bluetooth. The transmission issues were a constant nightmare with hesitation and surging upon acceleration from a stop and even while in motion. I had the vehicle from 6 miles on the odometer reading to 48,000 miles on the odometer reading. I had several “customer care files” through Chrysler and had the vehicle looked at and repaired at 3 different Jeep dealerships. The most I ever got out of Jeep was 2 years of free oil changes and tire rotations. I finally gave up the car in January of 2017, knowing that it wasn’t safe for me or my children to be in the vehicle. My Jeep spent more time at the dealerships service department than it did with me driving it. I asked several times for Chrysler to buy it back, and they refused, stating that the service department couldn’t find anything wrong with the vehicle and there were no recalls or issues with the transmission. I have a stack of papers from all the service department visits and complaints which measures about 3″ thick. I wish there was something that could be done before someone is in a massive/fatal accident due to Chrysler/Jeeps neglect. I am in Massachusetts.

    Same here I’m have the same issue with my 2015 Jeep it is so bad that I’ve almost been in two accidents and will not let my family members drive it. I’m from Minnesota and purchased it from a local dealer. I’ve had it in at least twice for this issue and now it’s out of warranty and the issue is still not resolved

    I am having the same issue with my 2015 Jeep Cherokee. In hesitates on take off or bucks when pressing on the accelerator. Yesterday, I couldn’t get it to shift out of park. This all started when I had a software upgrade when I took the care in for a heater and air conditioning problem (which still exist as well) Is there anything I can do? Calling the dealer tomorrow

    I failed to mention in my post that I am from South Carolina. I purchased my vehicle through a local dealership but the car was delivered to me from a dealership in Georgia. Per Mycarfax.com, the vehicle was made in Canada.
    I would like to join the class action suit.
