Jeep class action lawsuitThe Chrysler Group LLC, which is now known as FCA US LLC, was hit with an amended class action lawsuit in a New Jersey federal court, alleging that the 2014 Jeep Cherokees have defective transmissions that are wrought with problems.

Plaintiff Stacy Oquendo, who lives in New Jersey, says in her Jeep Cherokee class action lawsuit filed on Aug. 6 that she purchased her Jeep Cherokee in April 2014, which she has since had “repeated problems” with.

“The repair history reflects complaints of the transmission not shifting properly, and other transmission problems,” the class action lawsuit says.

Because of the transmission problems she claims her Jeep Cherokee has faced, Oquendo says that “she has lost the use of her vehicle for repair, the value of the vehicle is diminished because of its frequent and persistent problems, and the vehicle poses safety concerns to the driver and occupants.”

The New Jersey woman claims that her Jeep Cherokee has faced an “abnormal” amount of “transmission, problems, malfunction, and failure.”

And she claims that she’s not the only 2014 Jeep Cherokee owner that has had these types of problems. Oquendo cites various publications that have reported on the transmission problems occurring in other 2014 Jeep Cherokees as well.

The Jeep Cherokee class action lawsuit cited Car and Driver as one such publication that has cited similar transmission problems: “At least 12 out of 30 complaints submitted thus far to the National Highway Traffic Safety Administration cite poor shift quality, including transmissions that held gears for too long or suddenly shifted into neutral.”

The industry magazine says that “Chrysler delayed the Cherokee’s launch last fall by several weeks to make last-minute fixes to the new transmission and then released two technical service bulletins,” which included “an entire step-by-step process to recalibrate the adaptive software to better match the owner’s driving style.”

These fixes, Car and Driver explains, are “supposed to smooth out shifts from first to second and second to third.”

The publication added that in its “reviews of a four-cylinder and various V-6 Cherokees, we noticed erratic behavior from the nine-speed. It would deliver crisp, well-timed shifts on some occasions, yet on others would respond with slurred and delayed changes.”

Oquendo says that the problems described by Car and Driver are the problems that both she and other potential Class Members have experienced.

However, the Jeep Cherokee class action says that instead of acknowledging “the problem Chrysler has proceeded to deny and/or conceal the problem and directed its dealers to provide deceptive, false, or misleading explanations for the failure to provide warranty coverage and reimbursement.”

The New Jersey woman is charging Chrysler with breach of express warranty, breach of implied warranty of merchantability, fraud, violating the Consumer Fraud Act, and violating the Magnuson-Moss Act.

Oquendo is looking to represent a class of 2014 Jeep Cherokee owners who purchased their vehicles in New Jersey, New York, Delaware and Connecticut, have experienced transmission problems with their vehicles, have had to pay for rental vehicles during repairs, and have also been hurt because of the loss of use and diminished value of their vehicles.

The Jeep Cherokee class action lawsuit was first filed in in a New Jersey state court in May, but Chrysler had the Jeep Cherokee class action lawsuit transferred to the federal court because there were cross-state issues.

Oquendo is represented by Howard A. Gutman of the Law Office of Howard A. Gutman.

Chrysler is represented by Thomas R. Curtin of Graham Curtin PA.

The Jeep Cherokee Class Action Lawsuit is Oquendo v. Chrysler Group LLC, Case No. 3:15-cv-05056 in the U.S. District Court for the District of New Jersey.

    I have a 2015 jeep I bought in May and mine is doing all the above and recalls after recalls and transmission shifting to neutral and then have no power have to pull over 8 times a day cuz of this and have almost been in 3 accidents because I lose speed. I’m in new Braunfels tx and jeep dealers have 2 1/2 months before they can see my car because it’s a transmission related problem. That’s just to diagnose the car. Then have to replace transmission we are looking at another 2 months. So I’m taking a chance with myself and kids driving this jeep and killing us. I now decided I’m gonna let the car go on a repo. I’ve owned 8 new cars and have never had a issue with finance they always got paid off. But I can’t afford to be paying on a vehicle that’s been sitting for 3 months I’ve been using my husbands truck with no A/c no radio cuz of these issues I don’t know what else to do! This is my last and final resort! I hate it that it will hurt my credit but I just can’t

    Very similar issues with my 2014 Jeep Cherokee Limited. Build date 11/2013. Poor shifting, poor performance, Chrysler so-called fixes make the issues worse. Whats a mother to do?

    My 2014 with less than 8000 miles in 18 months of ownership has had TWO transmissions replaced. First failure was after 6 months and only 2200 miles. Second time complete failure was at just under 7900 miles and almost exactly one year after the first replacement. Second one took over 5 weeks to get and install. Am perusing Maryland Lemon Law and am trying to get full cost replacement. The newest transmission only has a few hundred miles on it and we are having lag and surge issues now.

    I’m having transmission problems with my 2015 jeep Cherokee trail hawk bought in April of 2015 it is October 2015 been to dealership twice to try to fix problems brand new car paid off and it’s at the shop right now very disappointed don’t know what to do since I’ve already bought the darn thing

    Our 2014 Jeep Cherokee transmission has been a frustrating and dangerous problem from day one. Software updates and a complete transmission replacement have not solved the problem. We have no confidence that the faulty transmission will allow us to drive the vehicle safely. Unfortunately it will probably take a tragic accident to make the company respond appropriately to this defective product.

    I just dumped one of these Lemons, a 2015 Cherokee Trailhawk. The car was fine when i purchased it and then on the first trip to the dealer, they disabled 2nd gear! The car never ran right again in spite of 9 more service appointments. The transmission overheated every time i took it to the beach and a FCA rep finally admitted to me 4 months later that all of their transmissions would overheat on the beach. The car almost got me killed in the mountains so I traded it. FCA never would honor even the basic warranty.

    My 2014 Jerp Cherokee is also doing the same thing. It’s to the point of being unsafe. I’m unable to trade it because of the value depreciating so quickly causing a lot more negative equity than was anticipated. I’m scheduled to go to a different dealership than where I purchased it to try and get another opinion. I’m scared for myself and my family when I’m driving it. Please let me know what I need to do to be a part of this suit. Thanks!

    My 2014 Cherokee POS is scheduled to go back to the dealer next for the 4th time. The shifting issues make the vehicle dangerous since you never know if it will shift and accelerate or not – then there is downshifting. Please contact me to join the action.

      How do I join? I have 2015 trail hawk only 6 months old and I’ve been to dealership twice for transmission first time they gave me some bull story about it being low in some ice fluid he said he didn’t even know what it was called (salesman that sold it to me) got it back seemed to work fine for a couple of months and now it’s at the dealership right now down shifting while driving lagging in acceleration different service lights popping up saying transmission too; hot stop/start engine unavailable; service transmission; 4x4unavailable; parking brake needs service it’s just astounding how many problems the lights are saying need to be fixed I already payed it off I was saving up for no payments now I don’t even have a car to drive because I have to wait for diagnoses before they give me a loaner and the dealership is backed up

        How does one join this? Our 2014 Jeep Grand Cherokee slipped from park to reverse while loading a jet ski on a boat ramp. It went into the lake and was totaled.

      I just had my transmission replaced at 15000 miles, 4 th time in due to transmission. Mine is a 14 Cherokee limited. Resolutions will not call me bck or even answer dealer advisor. What r they doing for you?

        My 2015 Trailhawk had a new tranny installed in undr 3000 miles. Ive been back 5 times so far and going a 6th this week. Crysler Corporate says that my bid to have the car bought back or replaced was revoked…Now I get to go to arbitration or take the course of lemon law. Yippie. Thats the last time I buy Jeep.

      I recently lost a Lemon Law case in New York against Chrysler for the same transmission problems in my 2014 Jeep Cherokee. It accelerates at it own will. according to Chryslers remarks at my hearing, the transmission is doing what it was designed to do, but in reality It anticipates what the drivers next move would be.

        i have had the same issue and Jeep has updated the software 4 times. At first they were going to approve it for Lemon law and 3 months of delay they rejected it.

        This car is not safe and in the winter the jeep drives even worse.

        Sounds like the same thing they told me. Makes no sense. I don’t need a car to anticipate my next moves as a driver. I need a car that drives smoothly with mout jerks, sputters and pulling.
