Jeep class action lawsuitThe Chrysler Group LLC, which is now known as FCA US LLC, was hit with an amended class action lawsuit in a New Jersey federal court, alleging that the 2014 Jeep Cherokees have defective transmissions that are wrought with problems.

Plaintiff Stacy Oquendo, who lives in New Jersey, says in her Jeep Cherokee class action lawsuit filed on Aug. 6 that she purchased her Jeep Cherokee in April 2014, which she has since had “repeated problems” with.

“The repair history reflects complaints of the transmission not shifting properly, and other transmission problems,” the class action lawsuit says.

Because of the transmission problems she claims her Jeep Cherokee has faced, Oquendo says that “she has lost the use of her vehicle for repair, the value of the vehicle is diminished because of its frequent and persistent problems, and the vehicle poses safety concerns to the driver and occupants.”

The New Jersey woman claims that her Jeep Cherokee has faced an “abnormal” amount of “transmission, problems, malfunction, and failure.”

And she claims that she’s not the only 2014 Jeep Cherokee owner that has had these types of problems. Oquendo cites various publications that have reported on the transmission problems occurring in other 2014 Jeep Cherokees as well.

The Jeep Cherokee class action lawsuit cited Car and Driver as one such publication that has cited similar transmission problems: “At least 12 out of 30 complaints submitted thus far to the National Highway Traffic Safety Administration cite poor shift quality, including transmissions that held gears for too long or suddenly shifted into neutral.”

The industry magazine says that “Chrysler delayed the Cherokee’s launch last fall by several weeks to make last-minute fixes to the new transmission and then released two technical service bulletins,” which included “an entire step-by-step process to recalibrate the adaptive software to better match the owner’s driving style.”

These fixes, Car and Driver explains, are “supposed to smooth out shifts from first to second and second to third.”

The publication added that in its “reviews of a four-cylinder and various V-6 Cherokees, we noticed erratic behavior from the nine-speed. It would deliver crisp, well-timed shifts on some occasions, yet on others would respond with slurred and delayed changes.”

Oquendo says that the problems described by Car and Driver are the problems that both she and other potential Class Members have experienced.

However, the Jeep Cherokee class action says that instead of acknowledging “the problem Chrysler has proceeded to deny and/or conceal the problem and directed its dealers to provide deceptive, false, or misleading explanations for the failure to provide warranty coverage and reimbursement.”

The New Jersey woman is charging Chrysler with breach of express warranty, breach of implied warranty of merchantability, fraud, violating the Consumer Fraud Act, and violating the Magnuson-Moss Act.

Oquendo is looking to represent a class of 2014 Jeep Cherokee owners who purchased their vehicles in New Jersey, New York, Delaware and Connecticut, have experienced transmission problems with their vehicles, have had to pay for rental vehicles during repairs, and have also been hurt because of the loss of use and diminished value of their vehicles.

The Jeep Cherokee class action lawsuit was first filed in in a New Jersey state court in May, but Chrysler had the Jeep Cherokee class action lawsuit transferred to the federal court because there were cross-state issues.

Oquendo is represented by Howard A. Gutman of the Law Office of Howard A. Gutman.

Chrysler is represented by Thomas R. Curtin of Graham Curtin PA.

The Jeep Cherokee Class Action Lawsuit is Oquendo v. Chrysler Group LLC, Case No. 3:15-cv-05056 in the U.S. District Court for the District of New Jersey.

    Have a 2014 lattitude and have had shifting and transmission issues since I first bought. Is there a class action suit going on for Connecticut and how do I get involved? Already had the transmission go once. Recently had 2nd computer upgrade on transmission and it drives even worse. This evening check engine light and 4×4 was disabled and won’t shift past 3rd gear.

    I have the same problemwith my 2014 Jeep Cherokee, but on my third transmission. I don’t feel safe driving my 2014 Jeep Cherokee Limited 4×4 anymore. Is a Class Action Lawsuitin New York State and who do I contact?

    I wish Pennsylvania was included in this suit.
    I have a 2014 trailhawk and my problem started at 90 miles on the vehicle.
    I have had the sun roof replaced, the drive train, the housing and differential twice and the entire fuel system.
    I had just got my car out of the dealer service department yesterday morning and 9 hours later my vehicle just stopped in the middle of the road and i had to be towed back to the dealer at my own expense.
    I think that i have hit my breaking point. Please keep me posted on how this case progresses.

      Oh forgot to add multiple updates and repairs on the transmission as well as multiple complaints and requested evaluation for improper gear shifting, revving at high rpm, jerking and throwing of the vehicle when shifts and shaking of the front end, weaving from side to side…. just too much to deal with…

    I have a 2014 Jeep Cherokee and have problems with the transmissions from the first. Purchased in April/May of 2014. The dealerships I have taken it to say that they update the software on the transmission and that it should fix it. They say it has to “learn” me all over each time they update or someone else drives the car. Well none of the updates have helped and after 2 almost 3 years it still stalls out when you hit the gas and then catches and goes. I’m very careful or I would have had an accident by now. It’s very dangerous. I also have had to have the front axle replaced on both sides and it is back in today to check it out again as it is making the same sounds as before. Who do I contact at Chrysler to get a buy back? I’m ready to try a safer vehicle.

    My 2014 Jeep Latitude is currently getting a new transmission. Only 32,000 miles. My problems started at 25,000 miles. They have had it for over a week because there are no transmissions available (bad sign). Also my gas mileage is no where near what the sticker said. I’m was only getting 16 mph, sticker showed 21-25 mpg. On top of all of that, I’ve have received about 5 recalls in 2 years. Not a reliable vehicle at all.

    I have a 2014 Jeep Cherokee Limited. It has had two replacement transmissions, and needs a third. The vehicle has shifted harshly from the beginning, lurching forward when on a slight incline usually around 8-10 miles per hour. Now after the second transmission not only does it lurch forward at 8-10 miles per hour but also around 30 miles per hour.

    The vehicles power also stops working while driving creating safety issues for me and my family. Numerous recalls with no repairs in sight because Chrysler does not know how to fix this product that they rushed out to the sales floor.
    Per Chrysler and The Attorney General, the vehicle has too many miles on it for it to be considered a lemon. Too many miles on it for Chrysler Cares to assist me in repurchasing my vehicle.

    HOWEVER, I have been told that multiple Jeep owners with the same transmission problems have received letters from Chrysler indicating that they are eligible for buybacks.

    So, what is one to do? It is my only vehicle. I pay a hefty car payment, 26 of them to be exact, and all on time. I cannot afford to 1) purchase another vehicle and let this one sit, 2) trade in because once they pull the VIN they will see all the maintenance. So my options are to either keep driving this POS, trade it in and take a huge loss or tell Chrysler Finance to come get it and take a hit to MY credit. This is an ETHICAL issue, and in my opinion, Chrysler needs to fix this problem.

    This vehicle is a lemon regardless of how many miles on it! Sounds like the lemon law should be updated to reflect when the problems first started occurring. Is it my fault that Chrysler still doesn’t have a fix for this transmission 20,000 miles later???

    I had my 2014 Jeep Cherokee for 2 years. It always shifted weird, but dealer always said it was that you had to get used to the 9 speed transmission. They did updates on it, which would be good for a week or so and then it would revert back to it’s old self.(popping into gear when accelerating from a stop or just shifting hard in general) The last straw was in August when I had to get the transmission replaced because it just stopped the car and it would not move. The dealership replaced it, and when I got it home same deal it was good for about a week, and then it started shifting hard again. Dealer told me that it was adjusting to my driving style, whatever that means?! I was getting nervous about the car, I had some long trips that we were to be taking with it and I didn’t trust it. So long story short I traded it in (lost $15,000 by doing so) and bought a 2015 Honda CRV, there is a million of them on the road, so I figured something is right with them. been happy so far, but I don’t know if I can get into a class action suit if I traded it, I sure lost a lot of money by doing it! Please contact me if I qualify..

    Having all these same issues and can’t even get out from under the car because of its worthless value. Who do we contact, Jeep can have the car I simply want to be.able to drive a vehicle that is safe for my family. Current dealership is supposedly putting in a new transmission but it doesn’t sound as if that’s going to help. Not fair to us hard working people to be forced to continue paying and putting families at risk

    I am also experiencing the same transmission issues in my 2014 Jeep Cherokee Latitude 4×4 9 speed. I’ve worked with Auto Nation Chrysler Jeep in Littleton CO where I am leasing from and the fix they have is for me to lease a 2016 at double the cost of my current car payment. Unacceptable! I contacted Chrysler directly and the lady that was assigned to my case said “The vehicle operates as it was designed.” “It’s a 9 speed and takes longer to get into gear.” I am beyond pissed! My lease is up in less than a year and they can have their defective vehicle back! I thought I would give US cars another shot, but after this experience, I am never buying American made cars again! Chrysler takes no accountability and I wish we would have let them fail instead of bailing them out!!!! I signed up for the Class Action Lawsuit, but have not heard back…
