Isolated on white background.California state law prohibits telephone recording unless both parties involved in the conversation consent to being recorded. The policy regarding telephone recording applies to both inbound and outbound calls. This may be conducted illegally by some companies.

This includes appliance giant Miele, which consumer advocates suspect may have been conducting illegal telephone recording during customer service calls or other conversations.

Miele was started over 100 years ago by the Miele and Zinkann families in 1899, starting from just a few tools and eventually expanded into an entire appliance company.

Miele produces and manufactures a number of home appliances including washing machines, dryers, and refrigerators. With the company’s history and widespread line of appliances, millions of Americans have either bought Miele appliances or will most likely purchase one at some point in their lives.

Like many other businesses, Miele often monitors its customer service quality by calling consumers or promptly responding to incoming customer service calls. Companies often analyze recorded telephone conversations between representatives and customers to better determine how to improve their customer relations.

However, Miele cannot legally do this without the consent of both the consumer and representative in the state of California.

Overview of Illegal Telephone Recording

Businesses often conduct customer service calls to customers for a variety of purposes while customers often contact businesses for different services such as billing or technological help.

During these calls, businesses typically disclose the fact that telephone recording may occur during the beginning of the call or a customer service agent will ask for permission.

While some states only require the consent of employees for call recording to occur, California state law requires all parties involved to consent in order for the call recording to be legal. In addition, implied consent occurs when either party remains on the line after receiving the notification.

California is one of the most progressive states for consumer protection laws, with the California Invasion of Privacy Act protecting consumers from illegal telephone recording. This act can also be applied to California’s wiretapping law, Cal. Penal Code 632, which is known as a “two party consent law.”

This essentially means that it is a crime in the state of California to record or eavesdrop on a phone call or any other confidential communications unless all parties involved give consent. Under state policy, there are few exceptions when non-consensual telephone recording is acceptable for either inbound or outbound calls.

This phone call law also applies to customers making calls to businesses. It is also illegal for them to call record without the business’ knowledge or consent. Businesses that violate this California privacy law may be subject to legal consequences with $5,000 per illegal telephone recording.

Consumers thinking of filing legal action should keep record of every communication with the company to help any potential litigation progress. California consumers who believe they have been the subject of illegal telephone recording should contact a lawyer to determine eligibility for a California call recording lawsuit.
