BMW, Porsche telematic features class action lawsuits overview: 

  • Who: Peter Grayson filed separate class action lawsuits against BMW of North America and Porsche Cars North America. 
  • Why: Grayson separately claims BMW and Porsche misrepresented the telematic systems in certain of its vehicles since they allegedly are only compatible with 3G technology and have been rendered inoperable with wireless carriers dropping it. 
  • Where: The class action lawsuits were filed in New Jersey federal court. 

Certain older Porsche and BMW vehicles will no longer be able to perform telematic features due to wireless carriers dropping 3G technology, a pair of new class action lawsuits separately allege. 

Plaintiff Peter Grayson separately claims Porsche and BMW misrepresented the vehicles telematic systems by not informing consumers they would be rendered inoperable in the event wireless carriers dropped 3G technology. 

Grayson argues the telematic systems manufactured into the affected Porsche and BMW vehicles were only temporary on account of them allegedly only being compatible with 3G technology. 

“The Class Vehicles’ internet enabled telematic features such as roadside emergency safety features were rendered inoperable after the 3G phase out in 2022 due to defendants’ use of obsolete telematics equipment they installed in the Class Vehicles,” states the BMW class action and Porsche class action. 

Porsche and BMW being asked to provide compensation for telematic systems allegedly ‘rendered inoperable’

Grayson wants to represent nationwide classes of consumers who have purchased either a BMW or Porsche vehicle containing telematics systems that are only compatible with 3G technology. 

“This action was commenced to obtain recompense for Class Vehicles whose telematics were rendered inoperable when 3G was phased out, or repair, retrofit or replacement of 3G telematics,” states the BMW class action and Porsche class action. 

Porsche drivers will no longer be able to access their vehicles’ “Porsche Connect” features due to the phase out of 3G, while BMW owners will be unable to use their “Connected/Drive BMW Assist” systems, according to the BMW class action and Porsche class action. 

Grayson separately claims Porsche and BMW are guilty of unjust enrichment and in violation of New Jersey’s Consumer Fraud Act, breach of express warranty in violation of a New Jersey statute, and the Magnuson-Moss Warranty Act

Plaintiff is demanding a jury trial in both complaints and is requesting an award of actual damages for himself and all class members. 

A separate class action lawsuit was filed against BMW in June over claims the company exaggerates the driving range for some of its i3 passenger vehicles when they are being driver in cold weather.

    Florida resident. 2015 740 li. Same, lost all connectivity and no solution offered by BMW.

    Have 2016 BMW x3, telematics no longer work, SOS safety call in case of accident no longer functional. Bmw advised me car did not meet retrofit requirements. Did some research and all parts in my car (since i have the technology package) should be retrofitted. I provided documentation to BMW service, they still will not correct.

    Add me. I have a BMW 2015 428i XDrive and I cannot make calls my camera while reversing won’t turn on.

    Two vehicles which have been disabled 2013 x5 and 2015 i3. Lack of safety SOS, and i3 energy management. Why the telematic module can’t be treated as any “modem” and easily upgraded. Add me.

    I purchased a used 2018 BMW x5 and renewed my connectdrive services/BMW app on 3/6/22. But all of a sudden without any notification the services were stopped and I don’t have a option to renew or purchase the subscription. After doing some research came to know that shutdown of 3G is causing the issue. This is clearly cheating. BMW should have notified this is going to happen. I would have chosen a newer model. BMW is not a start up company that does not know how to fix the issue. They should atleast provide a solution. It is up to the user if he wants to buy it or not. But not giving any choices is cheating. Please add me the case action suit. Companies like this think they can do what ever they want & cheat consumers.

    I have always considered myself to be a BMW faithful…. but…. i purchased my 2015 in 2018 and lost all of the features that connecteddrive offered. I even purchased upgrades based on the information I was given at the time of purchase…. all have been lost.
    I most certainly want to be included in this…. since this is the worst thing BMW could have done to their consumers.

    My 2019 430i gran coupe also lost Connected Drive features at the time of the 3G phase out. The dealer said it’s not included but were not able to fix it on multiple attempts. I wrote to BMW USA a month ago but still no response. I test drove a new 2021 330i on the same day. If I was informed that Connected Drive would be disabled due to 3G phase out, I would have bought the new model. Please add me to the lawsuit.

    Purchased a 2016 X6 35i Msport, was excited about the features ” I thought I was going to get” but now I have nothing. If I would of known I would have purchased a 2018-19 X6 instead. Add me to this lawsuit. They need to correct this somehow.
