BlueGreen Vacations Unlimited Inc. has been hit with a class action lawsuit that accuses the timeshare company of using “hard sell” tactics and misinformation to convince consumers to enter into timeshare contracts.
Plaintiffs Kyle Miles and Jasmine Miles filed the deceptive sales tactics class action lawsuit against BlueGreen Vacations, claiming that the company engages in “the practice of making and advertising false promises and statements with regards to its timeshare contracts that it had no intention of honoring,” causing consumers to suffer damages.
According to the BlueGreen Vacations class action lawsuit, the plaintiffs attended a timeshare presentation for BlueGreen in Las Vegas, Nev., in December 2014.
“The presentation included other high intensity sales tactics to induce Plaintiffs to enter into a timeshare contract, including claiming the presentation would only last two hours when it in fact lasted over five hours in length,” the BlueGreen Vacations class action lawsuit alleges.
During the timeshare presentation, the plaintiffs were reportedly informed that, if they were not satisfied with the timeshare contracts BlueGreen was selling, BlueGreen would buy back the contracts.
The plaintiffs claim they were told by BlueGreen that the timeshare contract would cost only $15,000 over five years at 15.99% interest. However, BlueGreen’s timeshare contract was for $25,000 over 10 years, the timeshare sales pressure class action lawsuit alleges.
According to the timeshare class action lawsuit, BlueGreen also misled the presentation attendees by representing that the timeshare contract’s maintenance fees would not increase, when in reality, the maintenance fees increase on an annual basis.
After the timeshare presentation, the plaintiffs were reportedly taken into a separate room in which a BlueGreen Vacations agent read them the timeshare contract and had them respond, “I agree.” However, the plaintiffs allege that the terms that were actually contained in the timeshare contract are different than the terms promised during the timeshare presentation.
They also claim that they were pressured to open two BlueGreen credit cards and to put the entire $5,000 down payment on the cards.
The BlueGreen Vacations class action lawsuit alleges that BlueGreen’s “false advertising causes significant and continuing harm to consumers who are unable to sell back their timeshare contracts to BlueGreen despite Defendant’s representations.”
By filing the deceptive sales tactics class action lawsuit, the plaintiffs seek to represent a Class of individuals in the United States who entered into a timeshare contract with BlueGreen after BlueGreen made representations about the ability to sell the contract back to BlueGreen. They also seek to represent a California subclass.
The BlueGreen Vacations class action lawsuit asserts claims for violation of the Florida False Advertising Law, the Florida Deceptive and Unfair Trade Practices Act, the California False Advertising Act, the Consumers Legal Remedies Act, and California’s business and professions code.
The plaintiffs are represented by Todd M. Friedman and Adrian R. Bacon of Law Offices of Todd M. Friedman PC.
The BlueGreen Vacations Timeshare Sales Tactics Class Action Lawsuit is Kyle Miles, et al. v. BlueGreen Vacations Unlimited Inc., Case No. 1:16-cv-00937, in the U.S. District Court for the Eastern District of California.
UPDATE: The BlueGreen sales tactics class action lawsuit was dismissed on October 21, 2016. Please keep checking Top Class Actions for updates. We will let our viewers know if any new class action cases are filed!

Hola, Mi nombre es Sandra y a mi esposo y a mi, nos vendieron las mismas cosas las cuales nunca hemos

I need help too same big problem
I also need help. We were promised so much more, 2 paid weeks at on of the resorts of our choice. We were sold on the idea that this wasn’t a timeshare but an investment in property that we held the deed to. Too many fees for something we didn’t have a chance to use and it’s a fee to use the points which were not aware of.
Bluegreen Orlando Florida lies on timeshare contract totally different information from what we were told we haven’t made our first payment yet and the field specialist will not return our calls or emails.
I had same in Orlando fl….they kept us till the end…and when I tried to get out they held my wife hostage…until I came back with the money…we missed our whole day. No vacation no food ..nothing but go back to sleep….I need a lawyer
We were in Orlando too, and we stayed way over the hour. We were there for 6 hours with our children waiting.
There would like to join you for a law suite. I’m an owner in Bluegreen and had the same difficulty to book.
Hello fellow Bluegreen partners !
I’m pretty much on the same boat here as everyone else. Just one exclusion though, I’ve tried to sell it our before but due to very low to nothing payback I’ve decided to keep it, and maybe rent it out in the future when things calm down a bit. Nevertheless, I’m very unhappy with Bluegreen and how they handle business. My biggest complaint currently is “the no monthly billing statement”. I’ve called and asked several times for my monthly billing statement and they bluntly said statement is not available on line neither is in paper form. I know for sure I’m entitled for a monthly billing statement per consumer law, stating interest charges, and how much of my payment is going to the principal. Thus, it is my hope that we can tackle Bluegreen with this issue.
Has anyone experience the same billing issue – no billing statement available?
I have been considering to do a balance transfer and pay them off completely, so I can save thousands of dollars from their high interest rate. However, I’m hesitating until I speak to an attorney and see where I stand and what can be done. Will keep you updated.
All the best to us
Wife and I are in exactly same boat, I decided to pay that mortgage off completely to keep them from getting more money from me. But of course have those maintenance fees for something we can’t even use…
We enjoyed our blue green resort but now we are in our 70s and we can’t even afford the taxes every year went from 700 dollars when we bought it now we’re paying up to 1400 a year don’t even use it because we can’t afford to I have tried selling it cost money to do that no responses tried selling it through blue green no responses you can’t even give it back won’t take it back
We are in the same situation as everyone else. We would also like to be include in any action that can be taken against them.
We just got back from a presentation and it’s be coming clear there are a lot of unknowns. If anyone CURRENT BG owner would email me on pros/cons that would be appreciated.
JoAnn, we bought a BG timeshare years ago and have regretted it ever since. The maintenance fees, membership dues, and travelers plus increase every few years. We have also been invited to timeshare owner updates where pressure is, once again, applied and have been told many times that we are not enjoying our timeshare because we need to purchase more points in order to fully benefit from our ownership. It’s all a lie. Every time we have sit in one of these “update” we have been told we can put our points out to rent to pay or at least offset the maintenance fees. Yet, when we have called to rent them, we are told we don’t have enough points to rent and will need to purchase more points to qualify for their rental program. I’ve contacted them to buy back or just take back the timeshare since it has been paid off for some time. And finally, since this is a deeded property your heirs inherit the property and the maintenance fees whether they want them or not. And it isn’t divided equally between your heirs, the eldest get the privilege of paying all of the fees and if they do not, BG can pursue them, turn them into a collection agency, and ruin their credit rating.
I’ve been a member for maybe 5 years and haven’t been able to get in a place yet. Even after trying 11 months ahead of the date requested. Can’t build up points unless you pay additional fees. After not paying maintenance fees BG has turned me into credit
This is the same story with me more maintenance fees but never can get a reservation when I can go! How can I get out of this? Can I ever get any of my money back?
