BlueGreen Vacations sales tacticsBlueGreen Vacations Unlimited Inc. has been hit with a class action lawsuit that accuses the timeshare company of using “hard sell” tactics and misinformation to convince consumers to enter into timeshare contracts.

Plaintiffs Kyle Miles and Jasmine Miles filed the deceptive sales tactics class action lawsuit against BlueGreen Vacations, claiming that the company engages in “the practice of making and advertising false promises and statements with regards to its timeshare contracts that it had no intention of honoring,” causing consumers to suffer damages.

According to the BlueGreen Vacations class action lawsuit, the plaintiffs attended a timeshare presentation for BlueGreen in Las Vegas, Nev., in December 2014.

“The presentation included other high intensity sales tactics to induce Plaintiffs to enter into a timeshare contract, including claiming the presentation would only last two hours when it in fact lasted over five hours in length,” the BlueGreen Vacations class action lawsuit alleges.

During the timeshare presentation, the plaintiffs were reportedly informed that, if they were not satisfied with the timeshare contracts BlueGreen was selling, BlueGreen would buy back the contracts.

The plaintiffs claim they were told by BlueGreen that the timeshare contract would cost only $15,000 over five years at 15.99% interest. However, BlueGreen’s timeshare contract was for $25,000 over 10 years, the timeshare sales pressure class action lawsuit alleges.

According to the timeshare class action lawsuit, BlueGreen also misled the presentation attendees by representing that the timeshare contract’s maintenance fees would not increase, when in reality, the maintenance fees increase on an annual basis.

After the timeshare presentation, the plaintiffs were reportedly taken into a separate room in which a BlueGreen Vacations agent read them the timeshare contract and had them respond, “I agree.” However, the plaintiffs allege that the terms that were actually contained in the timeshare contract are different than the terms promised during the timeshare presentation.

They also claim that they were pressured to open two BlueGreen credit cards and to put the entire $5,000 down payment on the cards.

The BlueGreen Vacations class action lawsuit alleges that BlueGreen’s “false advertising causes significant and continuing harm to consumers who are unable to sell back their timeshare contracts to BlueGreen despite Defendant’s representations.”

By filing the deceptive sales tactics class action lawsuit, the plaintiffs seek to represent a Class of individuals in the United States who entered into a timeshare contract with BlueGreen after BlueGreen made representations about the ability to sell the contract back to BlueGreen. They also seek to represent a California subclass.

The BlueGreen Vacations class action lawsuit asserts claims for violation of the Florida False Advertising Law, the Florida Deceptive and Unfair Trade Practices Act, the California False Advertising Act, the Consumers Legal Remedies Act, and California’s business and professions code.

    That is exactly what they did to us and we are now stuck with something that we haven’t been able to use. We tried all summer to plan a vacation and there was never any availability

        I’m in on a class action suit. I have been an owner for a number of years now. I have had to keep buying points to actually use. Every year or two they restructure so it keeps you always needing more and maintenance dues are so high. One reason we purchased was because they had retirement communities. Maybe a 6months to a year after purchasing that did away with those. We have been told you can rent points or even sell the timeshare. It’s worthless. We were told we could refinance the “mortgage”. You can’t. Very deceptive, they will do anything to get their hooks in and not let go.

    Bad product, haven’t ever used it and want out. The high pressure sales tactics are deceptive, they lied ? to us from the start.

    My parents were misinformed as well. With one of my parents deceased and my father aging we were told the agreement was a lifetime commitment and if we chose not to pay the maintenance fees it could go against our credit. The commitment to buy back the contract is not an option Blue Green will discuss. They sent us to a real estate group who charges large fees to assist. No one would have bought into this scam if they knew it was even past, until death do you part.

    any one a senior citizen who bought. my wife and I did after 3 to 4 hrs of constantly being shown vac packages. they just would not take no for an answer. kept telling us how great it was. we were mentally and emotionally worn down. would not let us leave just to get lunch and talk, went to bathrooms and staff stayed outside as I believe it was a tactic to prevent us from leaving. we were pressured and signed under duress. to this day it was a blur and most of we feel violated. things that to my knowledge were never explained as we were rushed through without being able to stop and read contract and ask questions. to this day I do not remember hearing anything about cancelling period and maint fees were never discussed. we were taken advantage of and were easy targets. abusive is an understatement

    I have been lied to and paid thousands of dollars and not been able to go on one single trip, we have been owners for a year. I am contemplating stopping bank drafts and maintenance fees. Has anyone else done this ?

    I just went to a Blue Greens owner update, informing me that the point shares price is going up from $2.50 to $3.75. They wanted me to sign another contract to “lock in the old price”. They would give us 6000 more points for $104.99 a month, and I asked if it would be totaled to that or added, it would be added. My vacations partner wasn’t able to be there, so they said it wasn’t right for me to speak on his behalf. They said that the credit score would have to be 600 or better, so they ran my credit, it was less than 600 and the lady said that I could still buy at less than 600. I told them that they lied, and off course I would have to put 20% down, I declined on their offer. They had me sign this “hold the old price” type of deal “not affecting your current or obligating” me to purchase and I would get a copy. He quickly took us to the check out and after we left remembered he didn’t give me a copy. So I called and told them to email it to me. Still waiting. They are crooks. We need to join the class action as well. If you buy they are a ok with you but if you decline, they escort you out like a hot potato! We all need justice!!!!

        Exact same story . So many lies has no value, put money down. Maintenance fees have increased so much , can’t even go when we want to go . Paying over 6000a year
