BlueGreen Vacations sales tacticsBlueGreen Vacations Unlimited Inc. has been hit with a class action lawsuit that accuses the timeshare company of using “hard sell” tactics and misinformation to convince consumers to enter into timeshare contracts.

Plaintiffs Kyle Miles and Jasmine Miles filed the deceptive sales tactics class action lawsuit against BlueGreen Vacations, claiming that the company engages in “the practice of making and advertising false promises and statements with regards to its timeshare contracts that it had no intention of honoring,” causing consumers to suffer damages.

According to the BlueGreen Vacations class action lawsuit, the plaintiffs attended a timeshare presentation for BlueGreen in Las Vegas, Nev., in December 2014.

“The presentation included other high intensity sales tactics to induce Plaintiffs to enter into a timeshare contract, including claiming the presentation would only last two hours when it in fact lasted over five hours in length,” the BlueGreen Vacations class action lawsuit alleges.

During the timeshare presentation, the plaintiffs were reportedly informed that, if they were not satisfied with the timeshare contracts BlueGreen was selling, BlueGreen would buy back the contracts.

The plaintiffs claim they were told by BlueGreen that the timeshare contract would cost only $15,000 over five years at 15.99% interest. However, BlueGreen’s timeshare contract was for $25,000 over 10 years, the timeshare sales pressure class action lawsuit alleges.

According to the timeshare class action lawsuit, BlueGreen also misled the presentation attendees by representing that the timeshare contract’s maintenance fees would not increase, when in reality, the maintenance fees increase on an annual basis.

After the timeshare presentation, the plaintiffs were reportedly taken into a separate room in which a BlueGreen Vacations agent read them the timeshare contract and had them respond, “I agree.” However, the plaintiffs allege that the terms that were actually contained in the timeshare contract are different than the terms promised during the timeshare presentation.

They also claim that they were pressured to open two BlueGreen credit cards and to put the entire $5,000 down payment on the cards.

The BlueGreen Vacations class action lawsuit alleges that BlueGreen’s “false advertising causes significant and continuing harm to consumers who are unable to sell back their timeshare contracts to BlueGreen despite Defendant’s representations.”

By filing the deceptive sales tactics class action lawsuit, the plaintiffs seek to represent a Class of individuals in the United States who entered into a timeshare contract with BlueGreen after BlueGreen made representations about the ability to sell the contract back to BlueGreen. They also seek to represent a California subclass.

The BlueGreen Vacations class action lawsuit asserts claims for violation of the Florida False Advertising Law, the Florida Deceptive and Unfair Trade Practices Act, the California False Advertising Act, the Consumers Legal Remedies Act, and California’s business and professions code.

    I purchased many years ago and use it not to lose what i pay in maintenance fees. What I noticed is the original purchase site no longer appears on my 1099. Another site is now listed and one I have never been to. I was not asked if I wanted to move my timeshare to another location. I assume this was done to open more “sell” at the more popular places. Can they do this without my consent? Seems like it should not be legal to do this as I hold contracts on the other location.

    I am in the same boat. I was lied to about being able to sell it back if we wanted to. Can’t get anyone to discuss it with me. They just try to sell me more. Is this still open???

    We had a BlueGreen vacation club. We paid off the entire contract and as soon as we finished paying it off. We were canceled. We count not keep up with the maintenance fees. And we never ever used our time share. Everything was miss leading. I feel we should get our money back. We paid 12 years worth of payments.

    I bought a blugreen vacation last August 2017. I have paid maintenance fees twice and I have never used any of my points. Is this lawsuit still active?

    Mari, I totally undershoot your frustration. My husband and I hate paying the maintenance fees, and taxes each year. We also feel like we pay for more than our one unit that we get to use one time a year. We would love to sell but BG won’t buy it for what it’s worth.. getting to take vacation when and where we want is almost impossible. Wish there was something we could do to get out of this and get some of our money back. Good luck to you!

    Obviously we are only one of many who were lied to. Pinnacle Vacation is their seller, say our $20,000 investment is only worth $2,000 to sell. Who can I contact to sue this company? A specialist in this field?

      I am currently dealing with having to pay for Maintenance fees (1017.00 this year). When they sold it to me i didn’t know about this fee and when I was hit with it the following year, I was told that it would not increase, yet each year it has since i purchased it. I am finally done paying it off (which felt like a Mortgage for a house). However, every year I am stuck paying for maintenance fees which keeps increasing. I was told this increase was decided by the association but there isn’t a break down for any of the expenses. I only own one unit but i feel like I’m paying for all of them. I was also told this increase is due to the cost of living. So am I just paying for the area that I own or is it for all the properties? Not to mention, I can’t use them when i want to as I was told I could so it doesn’t make since ultimately when the $1000 could actually be used for a vacation instead of paying it in a year I haven’t used it. They lie about how you can use them and every year it gets more expensive. I have given this to be used by others because i can’t use it on the days I want and the points are mostly used in one visit. I am hoping something can be done about this. Even if it is selling it back to BG, which i was also told I could do but that was a lie too.
