BlueGreen Vacations sales tacticsBlueGreen Vacations Unlimited Inc. has been hit with a class action lawsuit that accuses the timeshare company of using “hard sell” tactics and misinformation to convince consumers to enter into timeshare contracts.

Plaintiffs Kyle Miles and Jasmine Miles filed the deceptive sales tactics class action lawsuit against BlueGreen Vacations, claiming that the company engages in “the practice of making and advertising false promises and statements with regards to its timeshare contracts that it had no intention of honoring,” causing consumers to suffer damages.

According to the BlueGreen Vacations class action lawsuit, the plaintiffs attended a timeshare presentation for BlueGreen in Las Vegas, Nev., in December 2014.

“The presentation included other high intensity sales tactics to induce Plaintiffs to enter into a timeshare contract, including claiming the presentation would only last two hours when it in fact lasted over five hours in length,” the BlueGreen Vacations class action lawsuit alleges.

During the timeshare presentation, the plaintiffs were reportedly informed that, if they were not satisfied with the timeshare contracts BlueGreen was selling, BlueGreen would buy back the contracts.

The plaintiffs claim they were told by BlueGreen that the timeshare contract would cost only $15,000 over five years at 15.99% interest. However, BlueGreen’s timeshare contract was for $25,000 over 10 years, the timeshare sales pressure class action lawsuit alleges.

According to the timeshare class action lawsuit, BlueGreen also misled the presentation attendees by representing that the timeshare contract’s maintenance fees would not increase, when in reality, the maintenance fees increase on an annual basis.

After the timeshare presentation, the plaintiffs were reportedly taken into a separate room in which a BlueGreen Vacations agent read them the timeshare contract and had them respond, “I agree.” However, the plaintiffs allege that the terms that were actually contained in the timeshare contract are different than the terms promised during the timeshare presentation.

They also claim that they were pressured to open two BlueGreen credit cards and to put the entire $5,000 down payment on the cards.

The BlueGreen Vacations class action lawsuit alleges that BlueGreen’s “false advertising causes significant and continuing harm to consumers who are unable to sell back their timeshare contracts to BlueGreen despite Defendant’s representations.”

By filing the deceptive sales tactics class action lawsuit, the plaintiffs seek to represent a Class of individuals in the United States who entered into a timeshare contract with BlueGreen after BlueGreen made representations about the ability to sell the contract back to BlueGreen. They also seek to represent a California subclass.

The BlueGreen Vacations class action lawsuit asserts claims for violation of the Florida False Advertising Law, the Florida Deceptive and Unfair Trade Practices Act, the California False Advertising Act, the Consumers Legal Remedies Act, and California’s business and professions code.

The plaintiffs are represented by Todd M. Friedman and Adrian R. Bacon of Law Offices of Todd M. Friedman PC.

The BlueGreen Vacations Timeshare Sales Tactics Class Action Lawsuit is Kyle Miles, et al. v. BlueGreen Vacations Unlimited Inc., Case No. 1:16-cv-00937, in the U.S. District Court for the Eastern District of California.

I’ve been an timeshare owner with BG for over 10 years. I’m retired on a fixed income and with the skyrocketing maintenance fees I cannot afford it anymore. Can’t understand why one maintenance fees increased during the pandemic when everything was shut down. Some of the promises have not come to pass.

  3. URSULA SWIFT says:

My husband and I have been owner for over 15yrs. As tge years have past, the maintenance fees have greatly increased. We use to enjoy traveling, but the cost kf fees is too much. I don’t see where maintenance fees are being utilized because every resort we’ve visited in the paat 5+ years have been dated and appliances failing. BG claims that owners can book the newly remodeled unit, but that information is not identified on the site.
I noticed that the organization is entertaining non-ownwers to the extravagant rooms, to entice a sale; this was observed in Las Vegas. I was furious 😠
Fees are becoming astronomical and availability is limited, bo matter what level a member is at.

I’m in the same boat . Predatory lending.

Same issue! 6 hours in the meeting felt pressured to say yes. Lost income weeks later because I got Covid on that trip. Less than 30 days wanted out. They told me mail back contract and could file for hardship. Then tell me they were wrong. Months later lost my job. Fees def went up after told they wouldn’t.

My husband and I were sold a $80 3 night stay no commitment with a $50 gift card handed to us when we gave our info at a Cabelas in NYS, they said we have a year to use the stay it’s all just for $80, and all we have todo is attend the 90 min seminar for BGV, well we finally “booked” to go to GA and I finally have the time to check all the information on our stay, we are noticing a ton of extra charges that we have to pay upon arrival, plus the seminar. After reading all this we have decided to cancel and not go, but we definitely fell for the company I knew it was to good to be true and I was starting to get nervous I’m just glad we didn’t actually buy into the time shares! I feel so bad for all of you guys! I hope it all works out for you!!

  6. James and Kay Darlene McGee-Cordova says:

We are Platinum members and we are not happy with our purchase. We were told one thing at the meetings and another when we tried to receive the offers that were given to us. We can’t book a stay because they are so interested in booking free trips to entise people to buy that the selection just isn’t there. I could go on for hours.

    1. Barbara says:

I’ve heard or read that anyone, don’t have to be a member to do it, can book one of their places for a stay. It is a common complaint to be at their mercy as to where and when.
When we went for the presentation, not placed in one of the nice luxury places but in hotels which did not meet my needs.

  7. Bryan says:

For over 7 hours with 2 and sometimes 3 sales reps on us, we were promised so much and lead to believe they were even building a massive water park in the lot just west of resort. Afterwards we felt beat up, traumatized the onslaught started at nine am and went on till 5 pm..
With only water and a few cookies all day they pretty much took our will to do anything but sign.
I made the mistake and paid it off. We were told Maintenance fee would be around 5 or 6 hundred first one was 600 the second was over 1600.. I walked after that.

    1. Cynthia Parks says:

I was told maintenance fees would stay the same because I already purchased a biannual share that the yearly fees was already covered getting more points. I was charged a separate fee for each one and the price is way up for when I originally bought

    2. Barb says:

Yes, same here. And very cold , freezing air conditioning , I was already stressed from the drive and finding the hotel and conference center, I was exhausted and hurting from my fibromyalgia.

  8. Patricia Laskowski says:

My maintenance charges have increased during the Covid. I’m now on fixed income I can’t afford these fees. I’ve been contacted by lawyers that do this but fees are $7,000-$10,000.

  9. Concepcion Gonzalez says:

    Gracias
    Concepcion y Jorge
