BlueGreen Vacations sales tacticsBlueGreen Vacations Unlimited Inc. has been hit with a class action lawsuit that accuses the timeshare company of using “hard sell” tactics and misinformation to convince consumers to enter into timeshare contracts.

Plaintiffs Kyle Miles and Jasmine Miles filed the deceptive sales tactics class action lawsuit against BlueGreen Vacations, claiming that the company engages in “the practice of making and advertising false promises and statements with regards to its timeshare contracts that it had no intention of honoring,” causing consumers to suffer damages.

According to the BlueGreen Vacations class action lawsuit, the plaintiffs attended a timeshare presentation for BlueGreen in Las Vegas, Nev., in December 2014.

“The presentation included other high intensity sales tactics to induce Plaintiffs to enter into a timeshare contract, including claiming the presentation would only last two hours when it in fact lasted over five hours in length,” the BlueGreen Vacations class action lawsuit alleges.

During the timeshare presentation, the plaintiffs were reportedly informed that, if they were not satisfied with the timeshare contracts BlueGreen was selling, BlueGreen would buy back the contracts.

The plaintiffs claim they were told by BlueGreen that the timeshare contract would cost only $15,000 over five years at 15.99% interest. However, BlueGreen’s timeshare contract was for $25,000 over 10 years, the timeshare sales pressure class action lawsuit alleges.

According to the timeshare class action lawsuit, BlueGreen also misled the presentation attendees by representing that the timeshare contract’s maintenance fees would not increase, when in reality, the maintenance fees increase on an annual basis.

After the timeshare presentation, the plaintiffs were reportedly taken into a separate room in which a BlueGreen Vacations agent read them the timeshare contract and had them respond, “I agree.” However, the plaintiffs allege that the terms that were actually contained in the timeshare contract are different than the terms promised during the timeshare presentation.

They also claim that they were pressured to open two BlueGreen credit cards and to put the entire $5,000 down payment on the cards.

The BlueGreen Vacations class action lawsuit alleges that BlueGreen’s “false advertising causes significant and continuing harm to consumers who are unable to sell back their timeshare contracts to BlueGreen despite Defendant’s representations.”

By filing the deceptive sales tactics class action lawsuit, the plaintiffs seek to represent a Class of individuals in the United States who entered into a timeshare contract with BlueGreen after BlueGreen made representations about the ability to sell the contract back to BlueGreen. They also seek to represent a California subclass.

The BlueGreen Vacations class action lawsuit asserts claims for violation of the Florida False Advertising Law, the Florida Deceptive and Unfair Trade Practices Act, the California False Advertising Act, the Consumers Legal Remedies Act, and California’s business and professions code.

    How do you get added to the lawsuit? I don’t want anything except out of my contract. Whatever I’ve paid into it they may keep…I just don’t want to to pay anymore.

      I’m in total agreement with you we have 3 1/2 years paid into that we will walk away from just to get out of it for good!

    My family and I also fell prey to Bluegreen. We were told they’d buy it back if we weren’t satisfied, there are never any availabilities. Just a huge scam.

    yes we would like to be added to the class action suit. we were not told that most of their properties require way more points any time of the year than we have. you have to book a year or more in advance to get it booked. i have been with them almost three years and have yet to be able to book a vacation i could afford with the points i have and now will loose what i have by 01/17. all lies

    I would like to be added as well, we went to a presentation in Tennessee, I spoke to a lady with Bluegreen just yesterday to try and sell back, and explained to her that the sales rep said there would be no problems, the lady I spoke with stated that the sales reps say whatever they need to to make a sale, and that I should have taken a tape recorder with me.

    My husband and I would like to be in the class action lawsuit. The sales people at Branson suckered me twice. They always claim more benefits are given than you receive. In 2006 soon after we were married we first went to their presentation. We were told points never expired so having points every other year and sAving them so we com go somewhere special since it’s hard to book where you want to go many times. That turned out to be untrue. Then we now bought more points so we get points every year because they said wouldn’t get the vacation club again since we didn’t renew that additional benefit. Now we don’t reverence that every year and we have to pay t o save points. They make it hard to use points you saved. For example for a weekend staying Chicago for a one room hotel for 7,000 points I had to wait until 11/5/2016. I have to decide soon again if I want to save points for another year or try to use them. It is annoying how y keep h can’t get people on the phone and things keep changing and maintenance fees keep increasing we could have eArned money off our maintenance fees when a set of my in-laws bought their time share from our referral,but didn’t g e t any credit because we didn’t list them in an additional website after giving then their names and addresses. We had credit cards with then and bar clays but the benefits they told us we would receive using their credit card wasn’t nearly as high as they pitched it. When we stopped using it they closed them because we didn’t use it enough. They never really let people meet one hour. You always get brow beaten 2 hours even when they claim its just a membership update to help you learn more about the benefits. It would be less annoyed if the maintenance fee didn’t keep increasing and pressured to buy more points. We are in the middle of iowa so no actual blue green properties are in my state even.

    My wife and I would like to join this class action lawsuit. We attended a presentation in Las Vegas as well and were made promises that are not true. My wife and I own another time share and we were told that we could trade one of those weeks and receive an additional 15,000 points to the 15,000 annual points we already receive. When we tried to do so to take the entire family (daughters, son-laws, and grandchildren) on a nice vacation, we were told that we could not do that. Also, when we tried to use points at one of Bluegreen’s affiliate hotels, the hotel would not accept the points. Basically, we were LIED to during the presentation, not only about all the benefits of being an owner, but the length of the presentation. The 2 hours turned into almost 6 hours. We were also pressured to apply for a Bluegreen credit card to put our down payment on. When we ashed about trying to sell back our timeshare, they advised us to sell it through their official partner, Pinnacle Vacations, Inc. Guess who owns Pinnacle? Bluegreen! This is a SCAM all the way around!!!!!!!

    We would also like to be added to this class action lawsuit. Blue Green is the worst decision we have ever made. They have in essence ruined out credit and subsequently our lives.

      We would like to be included in this class action lawsuit. Blue Green have lied and used forceful actions or tactics during there presentations. They have also tried to force us to attend a presentation during our check in at Myrtle Beach SC. We have a list of complaints. We our trying to sell but we can’t. We have they same issues as everybody, maybe more.

      Us too. I’d LOVE a class action suit against Westgate. We’ve been unsuccessfully fighting them for 4 years.
