Another Xarelto wrongful death lawsuit was filed against Bayer Healthcare and Janssen Pharmaceuticals by a surviving relative of a Xarelto consumer who allegedly died from uncontrollable internal bleeding.
Illinois resident Martha McMunn filed this Xarelto lawsuit on Sept. 26 on behalf of her husband Richard McMunn Jr. who died on Feb. 23, 2013, allegedly due to severe and painful Xarelto side effects.
According to the Xarelto lawsuit, Mr. McMunn was 82 years old when he was prescribed and first consumed Xarelto on Feb. 11, 2013, just about a week before his alleged Xarelto death. Mr. McMunn was prescribed Xarelto by his primary care physician after his total knee replacement surgery “to reduce the risk of stroke and systemic embolism in patients with non-valvular atrial fibrillation, to treat deep vein thrombosis (hereinafter referred to as ‘DVT’) and pulmonary embolism (hereinafter referred to as ‘PE’),” the Xarelot lawsuit says. Three days after his first dose of Xarelto, Mr. McMunn allegedly began to experience severe Xarelto complications.
On Feb. 14, Mr. McMunn was admitted to his local hospital for life-threatening bleeding, which allegedly developed from “an acute bilateral pulmonary embolism, and was caused to sustain severe and permanent personal injuries, pain, suffering, and emotional distress.” Due to the injuries Mr. McMunn allegedly suffered due to his Xarelto medication, he died a few days later.
Martha McMunn and her legal counsel sustain that the pulmonary embolism, uncontrollable bleeding, and any and all injuries sustained by Mr. McMunn that led to his eventual death could have been reasonably avoided had the drug manufacturers sufficiently warned him, other patients, and the medical community as a whole about the risks of taking Xarelto.
She has charged Xarelto’s manufacturers with several allegations, including negligence, strict products liability, breach of express and implied warranty, fraudulent misrepresentation, fraudulent concealment, negligent misrepresentation, fraud and deceit, and loss of consortium.
Martha McMunn is seeking relief from Janssen and Bayer in the form of compensatory damages, punitive damages, award of attorney’s fees, court costs, and other forms of compensation so deemed fit by the court.
This is only one of half a dozen Xarelto wrongful death and/or injury lawsuits filed during the month of September against Janssen and Bayer.
The Xarelto Wrongful Death Lawsuit is McMunn v. Janssen Research & Development LLC, et al., Case No. 3:14-cv-01042-DRH-PMF, in the U.S. District Court for the Southern District of Illinois.
