Hernia Mesh InfectionA hernia surgery patient alleges the Bard Ventralex hernia patch used to repair her hernia is a defective product.

Plaintiff Corine B. is a citizen and resident of the State of New York, living in Brooklyn. The defendant in this complaint is C.R. Bard, the developer, manufacturer, and promoter of the Bard Ventralex hernia patch.

In this new lawsuit, Corine describes the Bard Ventralex hernia patch as being made of materials that are biologically incompatible with human tissue. Because of these materials, she claims, the patch can react with tissue and cause serious problems for a certain percentage of people in whom it is implanted.

Corine says she was diagnosed with an incarcerated ventral hernia and was implanted with the Bard Ventralex hernia patch to treat this condition on Oct. 2, 2014.

According to the narrative of the complaint, the plaintiff suffered greatly as a result of this treatment choice. She alleges she has suffered considerable physical pain and mental anguish and experienced permanent injury which has required further medical intervention and will need additional care in the future. She has also lost income as a result of the need to care for her condition and pursue help.

Corine says that the Bard Ventralex hernia patch has incurred complications in numerous people other than herself. These complications include the patch eroding into parts of the bowel, requiring removal of the device and sometimes part of the affected intestines.

Treatment for the complications has been known to require several inpatient stays. The hospitalizations were needed to get colostomies, help with bodily-wide infections and other dangerous situations.

This is not the first lawsuit filed concerning the Bard Ventralex hernia patch. In November 2016, plaintiff Thomas F. claimed he suffered a negative immune response after implantation with the product.

Corine B. is bringing the following counts against C.R. Bard in this Bard Ventralex hernia patch lawsuit: Count One—Negligence; Count Two—Strict Liability, Design Defect; Count Three—Strict Liability, Manufacturing Defect; Count Four—Strict Liability, Failure to Warn; Count Five—Breach of Express Warranty; and Count Six—Breach of Implied Warranty.

Through the counsel of her attorney, the plaintiff is seeking judgment and damages against C.R. Bard, developer, manufacturer, and promoter of the Bard Ventralex hernia patch.

She hopes for an award which takes into consideration her pain and suffering both physical and mental, her lost income, continued need for medical treatment, and all costs associated with litigation.

The Bard Ventralex Hernia Patch Lawsuit is Case No. 1:17-cv-06410-CBA-VMS in the U.S. District Court for the Eastern District of New York.
