Aspen Dental Class Action Lawsuit

Aspen Dental

UPDATE:

The Aspen Dental class action lawsuit was dismissed on March 27, 2015.

Aspen Dental, one of the nation’s largest corporate-dental chains, has been hit with a class action lawsuit accusing it of illegally owning and operating dental practices and of deceiving patients with aggressive sales pitches for expensive treatments after they’ve been lured in with promises of free exams and X-rays. Aspen Dental owns and controls 358 clinics across the country and markets to low-income patients that can’t afford dental care.

The Aspen Dental class action lawsuit was filed following a June 2012 report by PBS FRONTLINE and the Center for Public Integrity titled “Dollars and Dentists” that uncovered Aspen Dental’s practice of servicing patients who can’t afford a dentist and then allegedly locking them into debt. Some patients in the report also alleged they were overcharged and given unnecessary treatments.

The Aspen Dental class action lawsuit was filed October 18, 2012 by 11 patients across the country who accuse the company of violating laws in 22 states that require clinics to be owned by dentists actively performing procedures onsite. The laws are designed to prevent business interests from overshadowing those of patients.

Aspen Dental said Friday that the accusations in the class action lawsuit “are entirely without merit,” and that it provides support services to dental offices owned by local dentists.

“The dentists and staff at Aspen Dental offices around the U.S. provide access to high quality, affordable dental care for millions of patients,” the Syracuse-based company said. “Their singular commitment is to do what’s right for their patients.”

However, attorneys for the Plaintiffs say in the class action lawsuit that Aspen Dental trains the dentists and sets production goals for them, and accuse the company of illegally practicing medicine. They are seeking class-action status to cover potentially tens of thousands of current and former patients.

In 2010, Aspen Dental reached a $175,000 settlement with the Pennsylvania Attorney General’s Office over misleading information about discounts, consultations, financing and other promotions.

Plaintiffs in the Aspen Dental Class Action Lawsuit are represented by attorneys Brian Cohen and Jeffrey Norton.

After $16,000. My teeth look terrible they don’t fit every time you try to get an appointment you have to wait weeks and then they want more money. And if you file for the moneyback guarantee all you get back is the price of the actual physical denture which is about $2000. This is fraud I have been injured I am emotionally Roth with dealing with these people. If there’s a class action suit against them I want to be involved so please keep me informed. As I have to return to them today because last night one of my implants popped out of my jaw

Aspen dental has been one of the worst experience of my life. I was already a patient with aspen dental back in 2015 and had a tooth removed for 1300.00 I thought this was already way to expensive. After the dentist removed the tooth he cut the gum on the tooth in front of the one I just had pulled, and it was literally dangling out of the tooth. I could see in-between my tooth down to the bone almost. I thought this was not right but went along with what the dentist was saying. Fast-forward to 2020 and now the same tooth cracked where he made the cut below the gum. I went back to aspen dental “big mistake.” So now they did an extra and exam and then they made it very vague what they were going to do. I wanted it pulled, filled, or crowned. They added more work than I wanted or needed. So the financial lady that worked for them sat me down and gave me a number of over 4000.00 but said I can get a discount if I signed up for their credit service. After I signed up just to see what the discount was it was still over 3000.00. I wanted to get a second opinion before I had any work done. So when I went back for what I thought was going to be addressing the cracked tooth that is now starting to hurt. They wanted to do a cleaning and when I asked them if the amount that I was paying would include a crown or implant they said it did not cover that. So I got up and went to leave. They did everything they could to get me to sit back in that chair but I knew they were trying to take me for a ride. I went to leave and told the manager woman that I don’t want their services anymore. But they had already charged the credit line they set me up with the full 3000.00. The paid themselves before they did the work. Now I have a credit card company that I didn’t want sending me late fees and saying I owe them for a service I never received. I was also charged 40.00 for a member fee even though I was already a patient with their office. The whole experience has been a nightmare and my tooth still hasn’t been fixed and I’m In pain. I have found a new dentist and they are going to do the work for 1200.00 and it includes 2 cleanings and the filling or crown I need. I wish I could get help from someone about my situation. Even when I call to deal with the situation they put me on hold and don’t deal with the issue. Help me.

  8. Patrick Sansonetti says:

I was taken for $3800, never received my permanent dentures, and it took 3 attempts at making my dentures, and they were still painful, unaligned, and looked bad. I finally took a dremal tool and ground on them enough to wear, but still hurt and I rarely ware the bottoms because they hurt my gums. Ripped me off they did, and now will not return my calls or turn over my records of what they did.

  9. Jan Meckley says:

ASPEN DENTAL ARE STILL PRACTICING ILLEGALLY. I went in to just get a broken bridge pulled out. Aspen Dental did not put the bridge in. But I was lured there by low prices for uninsured people. They pulled the bridge out. I suffer from an autoimmune disease called “Show-grens” stemmed from Lupus. So, my teeth were falling out. After pulling the bridge, the very next minute, Dr. Jeffries came in and started trying to tell me everything that I needed to get done, to the tune of $23,000.00! I told her absolutely not! Then, she told me that I at leadt needed ALL my bottom teeth puleed out. The front bottom of my teeth, 8 teeth in all, were not affected. My back molars were, only. I told them I’m a retired, 67 year old and on a fixed income, and haven’t been able to afford to get dentures and partials, or I would have done it a long time ago. Here comes the finance lady. Now, after they got me approved for a loan, they made it quite affordable. So I was so happy!
The very next week, the work started! I had new full dentures on top, partials on the bottom.
They hurt me a lot. But was told that was normal. Went in for countless adjustments. I have a couple friends who have dentures and they assured me it was normal. I’m now almost 6 months in, and since I couldn’t afford top of the line, they told me the “basic” denture plan was great. That’s what I got. Two weeks ago, I told them I was looking forward to my final Dentutes and partials. I was told then that since I DID NOT GET THOSE FRONT BOTTOM TEETH PULLED, there was NO SENSE IN THEM PUTTING IN PERMANENT DENTURES OR PARTIALS! NOTHING WAS CONTINGENT ON THAT!!
The top dentures have torn pieces in the back. TORN! My partials which were to have a metal bar between to hold them in place is plastic and broke in half. Which THEY ARE CHARGING ME FOR! This is a NIGHTMARE! I do not have the money to fix what they LIED AND MISLED ME TO BELIEVE! I have NOTHING NOW! NO TEETH AT ALL! I’ve spent countless nightss just crying and beside myself! My kids cannot believe this. They have gone in to talk to them to no avail!
AND I now have learned they FINANCED THIS WITH AMERICAN FIRST FINANCE who are being sued and CANNOT LEGALLY GIVE LOANS IN CALIFORNIA! What is wrong with this company?? Something horrible is happening here.
This office is on Greenback Lane in Citrus Heights, CA. 95610
PLEASE PLEASE CAN SOMEONE HELP ME?
They have been sued before and I completely and I understand why!

    1. Autumn Kunsman says:

Omg, I’m so sorry this happened to you. Similar experience I had here in Pennsylvania on the 14th of June this year. Gaping hole in my mouth from two extractions. Only needed one but they insisted and flat out refused to take out the painful one unless he takes both. Lied and said my insurance didn’t cover extractions but they did. Got me all upset about not being able ti afford to get my tooth pulled. Charges me $334 per tooth but somehow offers and gets me credit to cover the cost. I just wanted to be out of the pain. The actual procedure he performed was $150, which my insurance covers 50% of that. He lied then upcoded the claim stating he performed a much more complicated procedure than an extraction. So I’m in debt for $700, huge hole in my mouth unable to eat on one side of my mouth, teeth beginning to shift after 6 years of braces, and all the complaints I have made have gone completely unanswered or even acknowledged. No one cares it’s not their money, life, beauty or smile. I’m devastated and defeated. You can’t even trust Doctors who take an oath. It’s a sad world we live in today. Good luck to you. I am not paying a dime to AFF.
