Aspen Dental Class Action Lawsuit

The Aspen Dental class action lawsuit was dismissed on March 27, 2015.

Aspen Dental, one of the nation’s largest corporate-dental chains, has been hit with a class action lawsuit accusing it of illegally owning and operating dental practices and of deceiving patients with aggressive sales pitches for expensive treatments after they’ve been lured in with promises of free exams and X-rays. Aspen Dental owns and controls 358 clinics across the country and markets to low-income patients that can’t afford dental care.

The Aspen Dental class action lawsuit was filed following a June 2012 report by PBS FRONTLINE and the Center for Public Integrity titled “Dollars and Dentists” that uncovered Aspen Dental’s practice of servicing patients who can’t afford a dentist and then allegedly locking them into debt. Some patients in the report also alleged they were overcharged and given unnecessary treatments.

The Aspen Dental class action lawsuit was filed October 18, 2012 by 11 patients across the country who accuse the company of violating laws in 22 states that require clinics to be owned by dentists actively performing procedures onsite. The laws are designed to prevent business interests from overshadowing those of patients.

Aspen Dental said Friday that the accusations in the class action lawsuit “are entirely without merit,” and that it provides support services to dental offices owned by local dentists.

“The dentists and staff at Aspen Dental offices around the U.S. provide access to high quality, affordable dental care for millions of patients,” the Syracuse-based company said. “Their singular commitment is to do what’s right for their patients.”

However, attorneys for the Plaintiffs say in the class action lawsuit that Aspen Dental trains the dentists and sets production goals for them, and accuse the company of illegally practicing medicine. They are seeking class-action status to cover potentially tens of thousands of current and former patients.

In 2010, Aspen Dental reached a $175,000 settlement with the Pennsylvania Attorney General’s Office over misleading information about discounts, consultations, financing and other promotions.

Plaintiffs in the Aspen Dental Class Action Lawsuit are represented by attorneys Brian Cohen and Jeffrey Norton.

    I also got screwed by Aspen dental they made 3 sets of dentures that I can’t use they are garbage the first set a 4 yr old could’ve done a better job they talked to me about having all my teeth pulled out. I had went there because I had a really painful tooth ache and they wouldn’t do anything to help me until they got the money up front they charged me over 8000 dollars that had taken about two weeks to get approved to take out of my retirement fund and I had been left in agony during that time , they didn’t care about me as a patient at all they just were concerned about the money .the manager of the place was downright nasty to me I got to the point that he upset me so bad I wanted to pummel him to the ground and the dentist that did the procedure had the audacity to tell me that the dentures were fine and when I told him they weren’t he condescendingly said to me he knew better and he had been doing it for 30 years and they are fine I finally just told them to basically screw themselves and refund me the last 300$ of my money because the said they weren’t going to make the dentures again and I was basically stuck with the garbage that the dentist said were fine I still have no teeth after 10 yrs because I can’t afford paying for another dentist to make me a set that actually works …..Aspen dental is a slaughter house and they definitely are all about the money ….you can’t imagine how bad I wanted to rip that office managers head off ….my wife was there to witness almost all of it they are scum…. So yeah I want to join this lawsuit also. That was the absolute worse experience of my life ….I’ve been through 2 pretty bad car crashes also have had a finger ripped off in a sprocket and gear in a farm machinery accident ,I would of rather been put through all that again than ever having to go through what I had experienced at that butcher shop called Aspen dental….I still have all three sets of dentures that are trash …they definitely don’t have any compassion for their patients…they are pure evil in all the sense of the word …..I felt as though I was put through Hell so they could profit ….

      OMG where do I start with this comment….not sure I can even get through all of what I want to say about the Aspen Dental that I started going to at the middle or towards the end of last year..but here goies sum….I first off will say that the dentist that did my extraction and then the come back appointment to get a piece of fragment out of my upper right side…
      That they said I was pretty much lying about but it could because they couldn’t see it on x-ray in the meantime b4 that when he was pulling my teeth he got to one that was being moody and it hurt super super bad and I would tell him to stop that it hurt and he said no it doesn’t and continued trying to pull throwing me into a anxiety attack….man I can keep going but it makes me really upset. So let me just tell all the things in one sentence….I was brushed up on and he me his teddy that made me feel very uncomfortable to the point that I quit going ….b4 that to get the the fragments that is sticking out and instead of jus pulling the piece he cut my gum and then proceeded to scrap my gum at least 10 minuted with all of his force, then put stitches in well not even a minute of him walking out of my room the 1st stich falls out and he puts it back in but by the time I got home every single stich was out of my mouth called them they said they were closing that I would need to wait till Monday…..but so there is sooooooul long long story short I guess…. I’m very scared and anxious about going back ….I’m sorry for writing so much but this isn’t even a good start on what has happened to me there at Aspen Dental. I just need help because these people can’t keep doing this to people it’s simply is fair or right of them. Please I need help or something Thank you

    Aspen Dental has deceptive advertising and our fraudulent. I got dentures had insurance got pre estimate before having work done. Then I go in to get permanent denture they tell me I more money. Insurance didn’t pay for aveoloplasty. I had no clue what that was . I never had that done to my knowledge. I would think that a professional would explain why and what they were doing before doing procedure on patient. I was unaware of this procedure. If it is done to make dentures fit it didn’t work because my gums ate torn up. I’m in pain most of the time. I called corporate office they said I owe 600.00 dollars went to office they said I owe 400.00
    I already paid 200p and insurance pd. 2000. This company is ruthless
    They should be ashamed of themselves. Don’t step foot in this company because everything that comes out of their mouths is a life
    You can’t trust them. The district attorney and the Denist Boatd should stop them from their deceptive practices but they do not. It’s really sad.

    I went to my first visit to have a tooth pulled that’s been hurting..instead they did x-rays and said I needed a deep root cleaning…I said I needed that tooth out..they said cleaning had to be done first…
    Well to begin with..a very rude lady said I needed to pay up front…I have a very good insurance…they pay for everything…they said they had to pay up front first…on Jan I paid 139.00 just to get my tooth pulled…
    Then a few days later they said I needed to pay 40.00…i did to get tooth pulled again…
    This is 3 months later I still have my sore tooth..I changed dentist …
    Still never got my money back…oh I got a refund check back..for 11.00 dollars..since I never went back..
    My insurance has since paid them and still no money back…
    Been over 3 months but they are sure to get their money up front!

    I went to aspen two years ago for dentures. Paid the top price. They pulled good teeth because they said it would be easier to get a full set than a partial. Ok. So they pulled the teeth and I went home with some dentures. The temporary set. Went to pick up the new permanent set only for them to tell me they were thrown away and I had to start over again. I never got an appointment set and only got $300 refund after paying close to $2k. I took a loan out against my 401k to get this procedure.

    I was charged $30,000.00 for my top & bottom dentures ,and there not that good. Care credit would only credit me for $20,000.00 so I have to pay $10,000.00 out of pocket to Aspen Dental .The bottom bottom dentures don’t fit right and hurt I can’t eat with them I had to get all my teeth removed because I needed a knee replacement and my teeth were Infected. I have no help with the price of things.

    I went to Aspen Dental when I lived in the BCS area in 2012 or 2013.
    I chose the $2000 dentures vs the $1k or $3k dentures.
    I was approved by Fortiva for 2K and everything was fine, even up to my final payment.
    Then after all the work was done & I had my dentures in place & happy, they charged my Fortiva account 3k.
    Fortiva sent them the “extra” since I paid off the $2k.
    I contacted Fortiva & told them the bill was paid in full & that’s when I leaned that Aspen charged me another 1K.
    To date Fortiva never got their money back so they charged me the 1K
    I refused to pay. I called & spoke with a Manager/Supervisor at Fortiva, named “Tom” who told me Aspen refused to send back that amount.
    I tried disputing via the credit bureau to no avail. It is still on my credit!

    Aspen dental willfully unbeknownst to me because I had a new insurance BCBS lied and said the weren’t with them. She offered me to put in for a Care Credit card to do my periodontal treatment, which she explained that I would only be charged 600. And the insurance would cover if it was in network. After calling my dental insurance representative, no claim was filed , my insurance would of paid my bill out because I’m high option. When I was on the phone with my insurance agent she called them but by this time I had already told the receptionist that I have to have surgery by a perio health professionals and that my mouth was infected with pus. So when my insurance representative called they hung up on her 3 times. I want my 1700.00 that they fraudulently charged me, this has to be a scam. Their story change all the time I’m fed up , I reported it to federal trade commissioner. My next complaint will be consumer protection holiness. This took place 2/8/2023

    Hello, I was a patient with Aspen Dental in Austell, GA. I wanted to have implants and snap ins. I was told that they could do this. They used Care Credit to use for payment. A year later, they still can not make my snapins correct because the doctor who put my implants placed two wrong. They are not paralle as I was told and they sent me to another dopctor (specialist with a different company) Now they are refusing to give my money back, I have filed 3 disputes with Care Credit and no help., Now I am left paying over $21000 plus another $7000 with the new doctor. I need help filing suit against this company in Cobb County, GA.

    I would also like to join the class action.
    Sept of 2021 I went to Aspen for my first check up and to inquire about Motto aligners. I was told I was a good candidate , but first I would need some teeth removed to make room and after that I will need implants or a partial to replace the already missing teeth in addition to what they removed. I do not know why I was stupid enough to go along with it, but they were the “professionals” not me. At first they were really working well, when I “completed” the treatment plan, I asked why some teeth did not seem as straight as they should be, I was assured the wearing of the retainer would solve that and complete the treatment. After constantly calling and asking when will I get my retainer, they kept saying it was not ready and to just wear the last set of aligners, After putting up a big fuss, they finally called me in to re scan my mouth. I do not know what happened to the information they already had scanned, but I complied. When I went in (with a few crooked teeth, they had the audacity to ask if I was satisfied with my smile. I said no, we may need to use more aligners to get it right. They scanned me yet again and I have been calling for the aligners for a few weeks now with no response. Now here it is March of 23 and I not only have a few crooked teeth, still missing the teeth and now my gum line is receding. So I am actually worse off than when I started. I want my smile back, and I would even settle for the one I had before I started. I just want my money I paid out of pocket back, reimburse my insurance, and cover the cost of a reputable dentist. I want my confidence in my appearance back. Please include me in this class action, they need to be held accountable.
