A Lipitor diabetes lawsuit was filed by a Kentucky woman, joining hundreds of similar cases consolidated in a multidistrict litigation.
Plaintiff Deborah Ramey, 57, filed the Lipitor lawsuit alleging she was diagnosed with type-2 diabetes due to her use of the statin drug Lipitor.
According to the Lipitor diabetes lawsuit, Ramey was prescribed and took Lipitor from December 2000 until December 2011. The plaintiff was reportedly diagnosed with type-2 diabetes by a local Kentucky physician on Aug. 6, 2001, just a few months after she began taking Lipitor.
According to the Lipitor diabetes lawsuit, Ramey “has suffered severe and permanent physical and emotional injuries including, but not limited to, the development of Type 2 Diabetes as a result of her ingestion of the prescription drug Lipitor (atorvastatin calcium).” Besides allegedly suffering bodily injury, emotional distress, and other physical and emotional damages, Ramey also claims to have suffered economic loss because of Lipitor diabetes.
She accuses Pfizer of negligence, negligent misrepresentation, negligent design, strict products liability design defect, failure to warn, breach of express warranty, breach of implied warranty, fraud and misrepresentation, constructive fraud, unjust enrichment, and punitive damages.
The Lipitor Diabetes Lawsuit is Ramey v. Pfizer Inc., Case No. 2:14-cv-03666-RMG, in the U.S. District Court for the Southern District of South Carolina. The Lipitor lawsuit is part of the MDL In re: Lipitor (Atorvastatin Calcium) Marketing, Sales Practices and Products Liability Litigation.
Type-2 Diabetes and Lipitor Users
Over 4,000 women have alleged they developed type-2 diabetes after taking Lipitor. In August 2011, the U.S. Food and Drug Administration (FDA) published a public health notice requiring Pfizer Inc. to update Lipitor marketing, advertisements and drug labels to incorporate and reflect the growing number or Lipitor diabetes cases and medical reports.
These same reports also demonstrate that of the majority of Lipitor consumers, those most at risk for developing type-2 diabetes are women. Pfizer Inc. in February 2012 updated Lipitor’s drug advertisements and product labels.
Lipitor Side Effects
Many women have reported experiencing a number of other disconcerting side effects after using Lipitor, including:
- Muscle problems, pain, or weakness
- Fever and tiredness
- Liver problems
- Nausea
- Diarrhea
- Upset stomach
- Joint pain
- Rhabdomyolysis
- Myopathy
