money-mailboxPayments from two class action settlements started arriving in Top Class Actions readers’ mailboxes this week.

Through posts and comments on the Top Class Actions Facebook page, readers report they’ve received checks in the mail from the Adderall XR and WEN hair care products settlements.

Other checks may still be on the way, so Class Members who filed timely and valid claims in either of these settlements will want to keep an eye on their mailboxes.

Checks from both settlements began arriving on Tuesday. Class Members in the Adderal XR class action settlement have reported receiving checks as large as $828, and claimants in the WEN hair care products settlement report receiving payments of $25 each.

The $14.75 million Adderal XR class action settlement resolved four different class actions claiming that the drug’s manufacturers improperly delayed and lessened the availability of generic equivalents of Adderall XR.

In one of those class actions, plaintiff Monica Barba accused the manufacturers of filing frivolous patent litigation to delay the introduction of generic versions of Adderall XR. She also accused the companies of paying larger rebates to managed care organizations in exchange for preferred placement of Adderall XR over generic versions.

The deadline to file a claim for the Adderall XR class action settlement was Oct. 7, 2016.

Plaintiffs in the Adderal XR class action are represented by attorneys from Kanner & Whiteley LLC, Golomb & Honik PC, Milstein Adelman Jackson Fairchild & Wade LLP, and Ku & Mussman PA.

In the WEN class action settlement, plaintiffs claimed these supposedly premium hair care products promoted by celebrity hair stylist Chaz Dean actually caused their hair to fall out. WEN purchasers reported suffering significant hair loss, leaving them with bald spots, thin patches and damage to their scalp.

Defendants WEN by Chaz Dean Inc. and Guthy-Renker LLC continue to deny these allegations. Still, they agreed to pay a $26 million settlement to resolve these claims.

Under the WEN class action settlement, payments will be distributed in two tiers. Tier 1, the payments that have just started arriving, compensates Class Members who agreed to settle their claims for a flat amount of $25.

Tier 2 payments are more involved. This tier will compensate Class Members who submit evidence of the personal injuries and emotional distress they suffered as a result of WEN hair care products.

Claims in Tier 2 will be paid up to a maximum of $20,000. Checks for these claims are expected to be mailed by March 9, 2018, according to the settlement website.

The claim deadline for both tiers in the WEN class action settlement was April 28, 2017.

Class counsel for the WEN settlement are attorneys from Varnell & Warwick PA, Cuneo Gilbert & Laduca LLP, and Johnson & Johnson.
