Actos bladder cancer

The presiding judge overseeing the  Actos bladder cancer multidistrict litigation (MDL) pulled together all parties in an effort to move along the massive collection of lawsuits.

The judge asked to be provided with specific details about each individual Actos bladder cancer lawsuit and Actos class action lawsuit filed under the MDL, as well potential Actos settlements and other motions and activity.

In numerous federal and state courts throughout the U.S., there are over 4,000 Actos bladder cancer lawsuits awaiting trial against the defending companies Takeda Pharmaceuticals and Eli Lilly Co. Many of these lawsuits were later consolidated in the Actos MDL.

These thousands of Actos lawsuits similarly allege that the plaintiffs suffered from Actos side effects, most notably the development of bladder cancer as a direct result of taking the Takeda diabetes medication.

Actos Bladder Cancer MDL Status Conference

In her orders prior to the Actos status conference, U.S. District Judge Rebecca F. Doherty laid out a series of orders that would require both plaintiffs and defendants to provide the court with details that will ultimately help limit the size and reach of the Actos MDL.

In one of Doherty’s orders, defendants were required to provide the court with a summary of each plaintiff’s fact sheet, individual plaintiffs’ Actos exposure, medical history, bladder cancer treatments and other bladder cancer risk factors aside from Actos.

In another order, the judge mandated plaintiffs and their counsel provide the court, for each Actos bladder cancer case, sales representation information, and an outline of any contact between plaintiffs’ physicians and the defending drug companies.

The last of two orders Doherty issued in preparation of the Actos status conference required update reports for the ongoing Actos bladder cancer state court proceedings and those state court cases resolved since November 2014.

According to the Actos MDL status conference orders, “The effective and efficient management of these MDL proceedings requiring that this Court and the parties remain timely apprised of the resolution of all Actos-related proceedings, including those in State courts,” Judge Doherty stated.

A follow-up Actos MDL status conference is scheduled to take place on Feb. 26.

The Actos MDL is In re: Actos (Pioglitazone) Products Liability Litigation, MDL No. 2299, in the U.S. District Court for the Western District of Louisiana.
