Yet another patient has turned to litigation after being diagnosed with incurable medical conditions likely related to his prior exposure to asbestos, a situation he claims occurred in his workplace.

Plaintiff Jerry S. has filed this asbestos related lawsuit against CBS Corporation and numerous other companies. The asbestos lawsuit argues that the asbestos and asbestos-containing products generated by the defendant companies were unsafe and defective for their intended purposes because they exposed the plaintiff, in addition to consumers, bystanders, workers and others to the possibility of asbestos exposure.

The lawsuit alleges that these exposed individuals were never properly advised about the substantial risks of using these products.

Jerry says that over the course of his career, he handled, used or was otherwise exposed to asbestos containing products and that he sustained permanent injury as a result. He says he has been diagnosed with malignant mesothelioma, allegedly tied to exposure to asbestos containing products and equipment.

The plaintiff says that he has suffered a variety of consequences in addition to the severity of his medical condition, including loss of income, profits, wages and commissions.

Asbestos fibers are rarely used in construction materials today. But in renovations or construction sites of the past, asbestos fibers released into the air could cause a variety of different health issues decades later. Some of the most common health issues connected to exposure to asbestos fibers include lung cancer and mesothelioma, both of which can be fatal.

Mesothelioma is a form of cancer associated with the lining of the body’s internal organs. It could begin in the abdominal cavity, around the heart or in the chest cavity. Malignant cells associated with mesothelioma can quickly damage nearby tissues, and the cancer can also metastasize to other parts of the body. By the time the cancer is discovered and diagnosed, it typically has progressed to an advanced stage.

The five year survival rate for a person diagnosed with mesothelioma only covers between five and ten percent, and many individuals who have been diagnosed with mesothelioma will pass away due to respiratory failure linked to pneumonia.

Many individuals who have been diagnosed with mesothelioma allege that it is directly related to their exposure of asbestos fibers that could have occurred decades before. Pleural mesothelioma is the most common form of this cancer which is characterized by cough, chest pain and shortness of breath.

Typically the victims who are diagnosed with mesothelioma are men over 40 years of age who worked in facilities in which they breathed in asbestos fibers. Secondhand asbestos exposure can also lead to mesothelioma, such as family members living inside a home who breathed in these materials when an employee came home from work.
