According to comments and posts on the Top Class Actions Facebook page, Class Members who submitted timely and valid claims for the Provigil class action settlement began receiving checks worth as much as $4,939.14 on Feb. 5, 2018.

The $35 million Provigil generic delay settlement resolves a class action lawsuit alleging that Teva Pharmaceutical Industries Ltd., Teva Pharmaceuticals USA Inc., and Barr Pharmaceuticals Inc. intentionally delayed the sale of a lower-cost, generic version of Provigil, a medication prescribed to treat certain sleep disorders including narcolepsy.

Attorney Generals from 48 states and Washington D.C. filed the lawsuit on behalf of individuals who paid for Provigil, or modafinil, its generic alternative. The lawsuit did not contest the efficacy of either Provigil or modafinil.

According to Teva Pharmaceuticals and Barr Pharmaceuticals, these claims are untrue, and their conduct regarding the drug was legal.

Eligible Class Members included any resident of the following states who “purchased and/or paid for Provigil or generic versions of Provigil (modafinil) for consumption by themselves or their families during the period from June 24, 2006 through March 31, 2012”:

Alabama, Alaska, Arizona, Arkansas, Colorado, Connecticut, Delaware, Florida, Georgia, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Maine, Maryland, Massachusetts, Michigan, Minnesota, Mississippi, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Utah, Vermont, Virginia, Washington, West Virginia, Wisconsin, Wyoming and the District of Columbia.

Residents of Louisiana and California were not included in this settlement.

People who purchased the drugs for resale purposes were not included, nor were those who purchased the drugs directly form Teva Pharmaceuticals and Barr Pharmaceuticals. 

The settlement included all individuals from these states who purchased and/or paid for some of the drug, meaning that their insurance did not cover the entire cost of the drug. Specifically, the settlement covered:

  • Uninsured consumers who paid the full price of the drug;
  • Insured consumers who made a co-payment or a partial, out-of-pocket payment for the drug;
  • Insured consumers who paid the full cost of the drug out-of-pocket because they had not met the deductible on their health plan.

The deadline to file a claim for the Provigil generic delay class action settlement passed on June 25, 2017.

    Hello does anyone know if the second and final payment was put out I’ve received no information or anything. I had filed the second claim, called and they said just be patient as long as I’ve had a claim # it would be filed and I have waited to see as of yet nothing . Just wondering ! Thanks

    On Sept 28, 2021, someone named Scott said I had no red flags or notes attached to my claim to say there was a problem. He said I should receive my check in 70-80 days.
    Okay, where is it?
    I filed my claim in a timely manner- sent all the receipts, and needed information, before 1-15-2020.
    I called 877-241-7503.
    What do you say Gang? Let’s all call this number every hour, even if you have to leave a message, and see if we can get their attention!!! I live in The Heart of Dixie and we believe in justice and our rights.

    I filed all the paperwork with proof and on time, but never heard anything nor did I receive any settlement. I still have my case number.

    .I filed a Provigil claim in 2018 or 19. Before the cut off date. I have heard nothing.. how can I find out what’s going on with this case?

    I received notice that there was another suit brought in the Provigil/modanifil action that the administrator told me I was entitled to join although I received $1200 in the first one. This one ran through August 2018 or 19 I cannot recall. As I went back over my paperwork I realized the years I had to pay 800 a month as my
    Insurance wouldn’t cover it. I am
    Still taking it but it is much less expensive.. All they asked for was the filled out form with an estimate (mine was $22,000 over the 12 or so years I’d been taking it and at least one pharmacy receipt..I have not heard from the administrator or the courts. How can I find out what Is going on?

    Not very tech. savvy.So please bare with me. I know I filled out the paperwork I was sent for this case.Along with sending in copies of proof of payments that I could find & even a copy of the hard copy of prescription I’d just recently gotten that I couldn’t afford to have filled.
    They found me to send me paperwork twice for this case, but never received any paperwork/ notification of prior case. :(
    Wondering why..??.. I did all that was asked/required of me for this case & received confirmation that it was received. Wondering what the status is with this case & if there is a way I can get involved in the 1st one that I was not made aware of. Would appreciate any information/help with this matter!
