A $30 million false advertising class action settlement between Osram Sylvania Inc. and a Class of consumers who claim the company misled consumers about the superiority of its headlights has received preliminary approval.
Last week, U.S. Magistrate Judge Madeline Cox Arleo preliminarily approved the Sylvania headlight class action settlement, which will provide partial refunds to consumers who purchased certain headlights.
The Sylvania class action lawsuit was initially filed in 2011 and alleged that Sylvania misrepresented that some of its replacement headlights are brighter, provide a wider beam and allow drivers to see farther ahead than standard halogen headlights. Sylvania’s allegedly superior headlights cost roughly twice as much as halogen headlights. According to the class action lawsuit, Sylvania sold more than 60 million replacement headlights during the Class Period. The class action lawsuit also alleged that Sylvania failed to inform consumers about the shorter life of these replacement lights.
Sylvania denies any wrongdoing but agreed to settle the class action lawsuit to avoid the expense and uncertainty of trial. Under the terms of the class action settlement, Sylvania has agreed provide partial refunds to Class Members and change the packaging on the listed products.
Class Members of the Sylvania headlight class action settlement include all individuals and entities in the United States who purchased one or more of the following products since Sept. 22, 2005:
- SilverStar ULTRA, SilverStar, XtraVision or Cool Blue replacement headlight capsules;
- SilverStar, XtraVision or Cool Blue sealed beam headlights; and
- SilverStar fog or auxiliary lights.
Class Members are expected to receive at least $10 from the Sylvania class action settlement. The actual amount of the payment will depend on the number of eligible claims submitted. It is possible that Class Members may receive more than $10, depending on the number of claims submitted.
A final fairness hearing for the Sylvania class action settlement has been scheduled for March 20, 2015.

Settlement Update: Posted August 11, 2015
Pursuant to the Settlement Agreement, on August 11, 2015 the Settlement Administrator mailed 1,391,045 postcard checks to all eligible Settlement Class Members. You are an eligible Settlement Class Member if you received a postcard notice or submitted a valid claim by December 31, 2014.
These checks have an issue date of August 11, 2015, and will become void after 120 days, on December 9, 2015. If you receive a postcard check for this Settlement, please cash or deposit it immediately.

I now am in the possession of two Sylvania bulbs that I INSTALLED AND REMOVED IN A TWO DAY PERIOD. I would like to know if I am eligible for any restitution?
William – You would be better off taking the bulbs back to where you purchased them if you are within the 2 day window. Most places that sell them will honor returns and/or warranties within that short of a time period.
The People are claiming that they were not informed that life span of the bulbs are shorter. (look on the back of the packaging) I did in fact purchase the Xtravision bulbs and they have been in my 2005 truck with 160,000 miles on it now for 2-years. I think this suit is bogus and full of crap. Everyone’s eyes are different, the lens covers on their vehicle could be milky and sun glazed to the point where there is not a bulb out on the market that is going to help it. I do not feel good that I have submitted a claim form before finding out what the suit was about! so to the head cheese at Sylvania, if you get this take me off the list.
