A new State Farm class action lawsuit says the insurance company wrongfully values total losses in vehicle accident claims.

Plaintiff Larry Relf says despite the fact that State Farm markets itself as an honest and reputable company, the insurance carrier regularly denies providing total losses to claimants after vehicle accidents.

The State Farm class action lawsuit specifically accuses the insurance company of colluding with another company, Mitchell International Inc., in order to receive Work Center Total Loss Vehicle Valuation Reports.

As alleged by the plaintiff in the State Farm class action lawsuit, Mitchell contracts to determine the settlement and market value of vehicles once any policyholder deductibles have been applied.

The State Farm class action says that the insurance company is involved in a scheme to artificially deflate vehicle loss claims to make payments to first-party insureds lower than the pre-loss value of the vehicle when the car is defined as a total loss.

The State Farm class action lawsuit accuses J.D. Power, Mitchell, and State Farm of violating their contractual obligations to consumers in additional to unlawful conduct violating Georgia law.

As explained in the State Farm class action lawsuit, the valuation methodology used assigns actual cash values for total loss vehicles in a manner that is much lower than other valuation models such as those included in Kelly Blue Book and NADA.

The process by Mitchell and accepted by State Farm for assigning cash values includes locating comparable vehicles, adjusting comparable vehicles, calculating the base vehicle value and loss vehicle adjustments, and calculating the market value.

The State Farm class action lawsuit accuses the companies of using old and inaccurate methodologies to determine the amount paid out to a claimant on a first party insured loss.

According to the State Farm car insurance class action, the methods for making adjustments on options, mileage, and equipment are invalid from a statistics standpoint.

The plaintiff also argues that all of these flawed methods of arriving at a claim value are not based on industry-accepted standards and causes the claimant to receive an underpayment on their total loss vehicle.

The defendants in the State Farm class action lawsuit, according to the plaintiff, have been able to make millions of dollars by consistently engaging in the process to undervalue accident claims.

The company is accused of using this WCTL valuation method for the vast majority of claims brought by first party insured policyholders in Georgia following an accident, leading to a regular pattern of denying policyholders fair value.

    I have statefarm the use to be really good but not anymore i had two total loss claims and in both claims i had to do all the leg work they did nothing then it took the 2 week to get me a rental both time and i had to pay for my rental out of pocket because they claim to not have a full coverage rental policy but thats not true because they use to have it we have been with statefarm for over 20+ years please add me th the claim alot has changed and they are not informing the customers at i haven’t received anything.

    I have had State Farm almost since I was driving 30 years ago. I have loved this company until recently. That are very hard to work with now. My agent is great but he no longer deals with claims and you go through some office in another state and work with a team.
    They are very difficult to work with.
    I hate to consider changing after all these years for I feel loyal but I am not very happy.

      I had state farm as well for many years and then they turned on me. I got a second car, a 2008 Dodge car–older model and they started charging me 260 a month just for that car. They said it was a new policy. I left them and went with Geico- now I pay 126 a month for 2 vehicles, same coverage.

        Is the 5 years a statue of limitations as my dad also had state farm and was in a one vehicle accident and was killed. They made me pay to have the title transferred to me before they would pay and I don’t remember them paying anything except fair market value but that was in 2013

    I need to have some clarity.
    We are having some serious bad luck for the last 2 1/2 years.
    My car was totaled in July 2018 and we have State Farm Ins. and the person who totaled my car had Geico.
    The year prior July 2017, my husband was a passenger in a fatal car crash with his best friend, who past and the above accident happened two blocks from his best friends home. Talk about spooky.
    I would really hope that State Farm Ins wouldn’t screw us knowing all that we have been through but can you please check.

    Bank of America took my money cash rent checks 2 days later one was not cashed but my money was gone now it caused me to loss my apt and manager disputed for me said it was a mistake but main office still haven’t talked to me I have print out the blocked my account on mobile then they couldn’t tell me which one cashed or which was returned 1460 avalible balance gone only 2 check wrote on account they took over 1600.00 cash money over this paid wrong fpl account there was a dispute of 999.00 and 99.00 wasn’t me I told them that and this branch is being shutdown

    Total loss State Farm they never paid hertz car rental I owe 1200.00 on my card 2 weeks ago going to settle bodily there check on desk now that I got lawyer to sign off there no check and won’t send paper to doctor regular medical records then never let me get things out of truck all tools diamond tool did it without title took over month to pay on truck 7000.00 I lost my job I’m still having headaches pain in lower back arms in pain neck crushed and need to keep lawyer she lied to me 10.000 check not on her desk for me

    I was hit In the rear by a non licensed driver and was critically injured/ on December 6 2018/I still have not received anything for my injury or for my hospitalization.

    They have denied my claims despite the money I have paid. The first was in 2015 regarding a storm that came through
    The second was car injury when someone hit me from behind. They denied me 10K I paid for in the plan for health issues that I continue to have since 2017.

        Where is the link please. I had state farm and my car was totaled almost 3 years now. How do i find out please. I did not get compensated for sales tax or title fee which i paid of course when i purchased my vehicle
