A judge has certified a class action lawsuit accusing Blue Buffalo of falsely advertising the content of its pet food products.

Superior Court Judge Calum MacLeod certified the Class on April 15, 2021.

The certification establishes a nationwide Class of purchasers of the Blue Buffalo products before September 2019. This applies only to the complaints of false advertising, not to complaints of the content of the products actually causing harm to pets.

The class action lawsuit, filed in February 2016, argued that Blue Buffalo’s labelling, advertising, and promotion of its pet food as a healthy alternative to other brands were false and misleading.

The lead plaintiff claims Blue Buffalo’s “True Blue Promise” that the products contain no poultry byproduct meal, corn, wheat, soy, or artificial preservatives, colors, or flavors has no scientific basis. 

In fact, the class action lawsuit states, the Blue Buffalo products actually contain “substantial amounts” of poultry by-product meal, as well as corn, rice, grains, artificial preservatives, and other ingredients that contradict the company’s “True Blue Promise.”

Nearly 4,000 Class Members already have registered with Class counsel, Judge MacLeod wrote.

If the settlement is approved, Class Members will be able to object to the settlement or to opt out of it, according to Judge MacLeod’s endorsement.

These Class Members will be entitled to “modest payments… without the need to submit a claim form or proof of purchase,” according to the endorsement.

A notice is expected to go out by April 30, 2021.

A hearing to approve the Blue Buffalo false advertising settlement is scheduled for July 29, 2021.

      My name is Kenneth F. Yanora. I would like to tell you my story about Blue Buffalo. I had a Westie and her name is Fergie. She was at the age of thirteen but in very good health. We always fed her Hill’s dog food and Vital and never had a problem with her. With Covid there was a shortage of Vital Food brand, so I ordered from Chewy some of the Blue Buffalo dog food to hold her over until Vital was more available. I made such a heart wrenching mistake. I thought I was doing something good for her. After a week my wife told me that Fergie was having problems while going for a walk, that she would keep panting and had no strength. I thought it might be from the heat so I would keep her cool and try to keep a eye on her. During the next week I continued to feed Her Blue Buffalo and even pick up more at Pet Smart. I had no idea I was killing my best friend. On Saturday May 22, 2021 I came home from my mothers because I wanted to make sure Fergie was ok. I brought her out to go to the bathroom and she went and laid under a bush panting heavily. I picked her up and brought her back into the house and put a fan on her and my wife came home and we took the air conditioner from the attic so she wouldn’t be so hot. She wasn’t doing good so my wife called a emergency vet clinic in Plains Pa. We rushed her to the Vet and on the way she died in my arms. I even tried CPR and she wouldn’t come back to me. I am crying right now as I write this. I’m not looking for money, I just want this stuff taken off the market. Something that could take away, something you love so much. And to leave you with the guilt, that you were the one that gave it to them. I have saved all of the dog food I purchased from Chewy and Pet Smart. Maybe this could help other people save their pet’s “Family, Best Friends”, in the future.

    My dogs have been eating Blue Buffalo for years because we were told it would be good healthy choice with limited additives. They are sick all the time with upset stomachs, diarrhea and allergies. We never thought it was the food. We spent so much money on food, treats, vet visits and medicines over the years.
    We were slowing killing our dogs. We have recently switched and they are so much better. Very deceived and mislead.

    I have been buying Blue Buffalo for over 3 years. My cat started scratching himself excessively. He had gained 4+ lbs and no vet ever said that it was Blue Buffalo. I would buy the wet and dry foods. About 2 months ago I started to read that diets could affect cats with the issue listed above. I have since switched foods and he is doing remarkably better. My family and I have noticed Blue Buffalo had changed the label and we were wondering why?

      I too am using wet and dry food from blue Buffalo and noticed my kittens scratching a lot. I would like to switch.

    I’ve been buying Blue Buffalo for my dog for years because I never wanted them to eat by-products or the corn and other grains. My dog has lost large patches of hair and has no energy. Horrible!

    I have been buying their wet and dry Wilderness brands for years for my cats and paying the higher price because of the ‘best ingredients list and no grains or corn! I’m very distressed to learn about this situation.
