Woman frustrated with internet speed.Some consumers are claiming that the Spectrum internet speed they receive is regularly far lower than the speed they’re paying for. Some have even turned to litigation, alleging that Spectrum falsely advertised their internet speed as much higher than what customers actually receive. If you have regularly experienced low Spectrum internet speed, you may be able to join this class action lawsuit investigation.

Companies involved in this class action lawsuit investigation for false advertising practices include Time Warner Cable (TWC), Spectrum, and Charter Communications. Spectrum merged with TWC back in 2016, and both now belong to the parent company Charter Communications.

Charter Communications Class Action Lawsuit

Two plaintiffs have brought a class action lawsuit against Charter Communications (along with Spectrum) alleging that they did not actually receive the high Spectrum internet speed they were paying for. Indeed, one of the plaintiffs claimed that he was paying for internet service advertised as 300 megabits per second (mbps), but he consistently noticed that the internet was much slower. He would call technicians in from Spectrum to test the speed, and he claims that the technicians never registered his internet speed as more than 130 mbps—less than half the speed he was paying for.

The lawsuit alleges that Spectrum/TWC “failed to live up to the promised speeds, reliability, and performances,” meaning that consumers overpaid for the internet speed they actually received. The lawsuit also claims that the company loaned or leased modems and routers that were actually incapable of supporting the high internet speeds the company advertised in the first place.

This lawsuit was originally filed in March 2017 in California federal court and was then sent to arbitration for more than a year. Now back in court, the lawsuit is asking for class certification that would cover up to millions of current and former TWC and/or Spectrum customers that may have been affected by similar false advertising practices.

Filing a Spectrum Internet Lawsuit

If you are a current or former customer of Time Warner Cable and/or Spectrum (both now owned by parent company Charter Communications) sometime between 2013 and the present, and you believe you may not have gotten the fast internet speeds that you paid for, you may be able to join this class action lawsuit investigation.

Some people may be able to file claims separately instead of joining this class action lawsuit and be able to seek compensation in the form of a cash refund, future discounts or credits, or awards in court, arbitration, or a possible settlement.

    Spectrum business practices are nothing short of deceptive and slimy. I was recently forced to upgrade from an approximately 10 year old contract (Legacy Charter Time Warner Account) to Spectrums new contract if I wanted to receive current services (updated modem, router, Wifi Extenders). Upside was promised by no less than three sales/service representatives, that my price would drop for 12 months, go back up after 12 months to the rate I am currently paying, and my internet speed would increase from 100 Mps to 200 Mps. Even Spectrum web sight advertised the same information. Turns out after they sent a service tech to my house, that they don’t even offer 200 Mps in my area even though I am paying for it. When I called to complain I was advised I could move to 300 Mps if I was willing to pay an additional $25.00 more a month. I urged their escalation team to “honor” both their written commitments (Web-Sight) and verbal commitments made by their agents regarding the higher internet speeds. Was informed that When (more like if) they increase their speeds to 200 Mps I would pay no additional charges. I offered two solutions to the issue (1) Reduce the price paid for a 200 Mps speeds to all customers receiving 100 Mps speeds until they could successfully meet their obligations, or (2) Increase speeds from 100 Mps to 300 Mps (offered in the area) to all customers receiving 100 Mps speeds until they could successfully meet the obligations. Both solutions rejected by escalation supervisor (Harley). Documented with the FCC and with Spectrums Exectutive V.P. In charge of Customer Service – Kathleen Mayo. I further intend to document the complaint of unfair business practices/false and deceptive advertising with the FTC, BBB, and truth in advertising. Sorry Spectrum but I’m like a dog with a bone on this one and you have done your customers very dirty!

      Our streaming services are always cutting out and wifi is so slow the computer constantly glitches. I’m ready to jump on board for a law suit

    I just found within the last month that Time-Warner was charging me a $35.00 “surcharge” that never should have been there! Spectrum continued with it when they changed over, PLUS Spectrum is charging me an extra $7.33 per month for the last 60 months! One representative told me this and stated that I was due a refund of $439.80 to settle. That does not include the extra $35.00 per month I’ve been charged since around 2013. I’ve tried to talk to Spectrum about this refund and once I actually got hung up on! Nobody else I’ve talked to at Spectrum knows anything about this refund – or they say they don’t. That first representative found it, gave me the overcharge amount of $7.33 and said it had been 60 months that I had been charged that extra fee. What do you do to fight the big companies? My internet gets so slow at night that I have to cut the computer off and go back the next day. My bill has been as high as $191.00 per month! They said they were going to re-evaluate my account and then told me it would cost me $217.50 a month!!! I really want to fight this!

    I am the customer fpor 2 years, and when I am so tired about their slow speed and bad customer service, I cancelled the service before the due date (july 1st) which they said it should be july 18th.
    and I find there was so many complain about spectrum and i decide cancel at 12th, I receive another month bill said I have past due (which I already pay for June 3th to july 3th), and next bill is july 18th to augest 18th. they use some tricky way to make customer stay if customer still want to cancel, they will charge another month. and when I discuss with them they will provide fake information to you. which include the fake internet speed, those speed can have speed cap, when you complain it they remove the speed cap, and leter on they will reinstall the speed cap. it is a terrible company.

    This is my second time trying to contact a lawyer about this lawsuit. I am and have been a customer of spectrum and I am absolutely disgusted and frustrated with how much money I am being charged for absolutely getting nothing like they promised. My wi-fi constantly drops and my internet speeds are pathetic. I have changed my plan 3 times paying MORE money for what spectrum promises faster speeds and better connections . My internet and wifi speeds and connectivity never changed. A spectrum technician admitted that Spectrum lies and wants you to be fooled thinking you can get better services if “YOU UPGRADE YOUR SERVICE PLAN” “GAURANTEED” The technician than gave me websites that I can look at with other offers..EX: to buy wifi routers and boosters instead of paying for nothing. Please contact me asap concerning this matter Thank You for your attention

    Reliability and uptime took a nose dive in the past few weeks. The Internet service goes down multiple times every hour. I work from home and these issues are causing me serious problems.

    Please add me. I have internet drops every few hours that drop me out of important meetings. Techs come, waste my time, and never fix the issue or get the speeds I pay for. It’s not just the lack of providing what I pay for but the time wasted with tech support trying and failing to fix the problems. They told me to buy a new router because the ones Spectrum provides and charges for are no good. I spent $300 and the problem didn’t resolve.

    They also scam people into keeping services they don’t want. I spent hours trying to cancel my TV without success. Wait on hold only to get a sales pitch and transfer to another department. They are holding me hostage to services I don’t want by making the process to cancel very difficult and time consuming.

    I am one of the millions not receiving the speed I am paying for. I have had the technician here and for a few hours I received the 100 mbps that I paid for.

    I have been complaining for two years about the speed, we pay $69 for internet and the speed is garbage and now my DVR is in limited mode and the rest of the boxes in the house is doing fine. How does that happen? Internet speed is not the only thing that is messed up, how in the world does the sales tax keep going up each month. It is never stable. They are good at putting the blame on the customer. It is so much drama with Spectrum and Time Warner Cable.

    Add me to the suit. I do not even know what my speed should be. I have had this lousy service for years.
    The internet service slows and then stops routinely. I believe they throttle people down on purpose.
    If you call a “technician” they read from a script and always say the same thing.
    The best speeds I ever get are 28 mbps download and 2.83 mps upload. They are the only high speed cable in my area. I would be better off turning my phone into a hotspot. I despise Spectrum.

      I would love to be added. As an electrical engineer that worked a Scientific Atlanta. I can tell you that no one gets the speed that they pay for. I switched to t mobile internet and can stream 7 movies from KEMO with no problem. Could not stream one with Spectrum Spectrum!
