Woman frustrated with internet speed. Some consumers are claiming that the Spectrum internet speed they receive is regularly far lower than the speed they’re paying for. Some have even turned to litigation, alleging that Spectrum falsely advertised their internet speed as much higher than what customers actually receive. If you have regularly experienced low Spectrum internet speed, you may be able to join this class action lawsuit investigation.

Companies involved in this class action lawsuit investigation for false advertising practices include Time Warner Cable (TWC), Spectrum, and Charter Communications. Spectrum merged with TWC back in 2016, and both now belong to the parent company Charter Communications.

Charter Communications Class Action Lawsuit

Two plaintiffs have brought a class action lawsuit against Charter Communications (along with Spectrum) alleging that they did not actually receive the high Spectrum internet speed they were paying for. Indeed, one of the plaintiffs claimed that he was paying for internet service advertised as 300 megabits per second (mbps), but he consistently noticed that the internet was much slower. He would call technicians in from Spectrum to test the speed, and he claims that the technicians never registered his internet speed as more than 130 mbps—less than half the speed he was paying for.

The lawsuit alleges that Spectrum/TWC “failed to live up to the promised speeds, reliability, and performances,” meaning that consumers overpaid for the internet speed they actually received. The lawsuit also claims that the company loaned or leased modems and routers that were actually incapable of supporting the high internet speeds the company advertised in the first place.

This lawsuit was originally filed in March 2017 in California federal court and was then sent to arbitration for more than a year. Now back in court, the lawsuit is asking for class certification that would cover up to millions of current and former TWC and/or Spectrum customers that may have been affected by similar false advertising practices.

Filing a Spectrum Internet Lawsuit

If you are a current or former customer of Time Warner Cable and/or Spectrum (both now owned by parent company Charter Communications) sometime between 2013 and the present, and you believe you may not have gotten the fast internet speeds that you paid for, you may be able to join this class action lawsuit investigation.

Some people may be able to file claims separately instead of joining this class action lawsuit and be able to seek compensation in the form of a cash refund, future discounts or credits, or awards in court, arbitration, or a possible settlement.

If you believe one or more of these allegations are true for your experience with TWC/Spectrum internet through Charter, you may have a claim.

The Spectrum Internet Lawsuit is Case No. 8:17-cv-00556-DOC-RAO, in the U.S. District Court for the Central District of California, Western Division – Santa Ana.

Join a Free Internet Speed False Advertising Investigation

If TWC, Spectrum, and/or Charter failed to deliver the internet speeds, reliability, and performance that you were promised, you may be entitled to seek a cash refund, future discounts or credits, or other legal remedies in court, in arbitration, or as part of a settlement.

I was promised full speed up to 5 gigabytes and before the 5 gigabytes was up, I received a text message stating that my mobile hotspot data has been used up even though I confirmed with spectrum customer service that I only used 4 gigabytes. The service is horrible and they told me I needed to reformat my whole phone in order for them to submit in a ticket to get it fixed or looked at. That’s Horrible. I should not have to reformat my whole phone just to get a ticket submitted in. I already got a new SIM card.

Spectrum is the worst service and operates like a telemarketing scam. They never fix a problem without trying to get you to buy something. Fees go up constantly and plans continually increase without explanation. Service is inconsistent and outages all the time. They are the only provider in my area or I would never deal with them.
Every month a week before the bill is due internet speed slows down. I called many times to ask why. One time I actually spoke to someone in training that looked into the issue and he confirmed that the speed seems to lesser at the third week of every month! Of course right before the bill is due. They condition you to fear you cannot complete your work, classes etc so you will always pay your bill on time!

I have charter/spectrum for so many years tv /cable there rates keep going up i was paying over 169.00 monthly so I went to basic cable tv they lowered my bill to 120.00 few months later it was back up to 180.00 so i ended up canceling cable tv and just had internet so now i pay only 59.00 then I had installed wifi camera s 7 of them and they could not work as well 4 will work fine so anyway I upgraded over 800 mbps and upload would be around 23 my bill is now 79.99 I ended up asking them if they can lower it to 70.00 they said NO so i asked them if i can take off the 20.00 upgrade they said okay and my bill went back to around 59.99 after 3 weeks my bill came in still 59.99 then my next bill came and it was 74.99 i called them asking them why was it back up they claim i was on a promotion and prices have gone up such a shady company so just yesterday I went to T-Mobile and got free trial for there 5g home internet I looked up on YouTube reviews and speeds even googling they say 100mbps to 300 i did several tests I got 361.90 download mbps and upload was 49.41 mbps @ ping 24 i tested all cameras no lags youtube 4k prefect if you do decide to do a free trial my advice is do it 20 day before your billing ends as i just did mine tonight and my charter bill is due in 2 days so really didn’t have a full trial but so far im satisfied so monday will drop off equipment to charter and cancel service and will feel good been asking them to lower it and they never do even when i tell them im cancelling but i know there shady games once i return it they will offer 49.99 for 1 year but to late charter homey don’t play that!

  5. Patricia Barnett says:

Spectrum is terrible. I work from home and signed up for the “fastest” package they have. I run frequent speed tests and the result is always “your internet connection is very slow”. We have to turn off Wi-Fi to other devices just to get streaming to work on one device. Spectrum was the only provider when I signed up two years ago, but thankfully Verizon is available now and at half the price! I’ve booked an appointment to switch to Verizon in a few days and cannot wait to cancel the overpriced Spectrum service. Please include me in the class action suit if possible.

  6. Beth Shelton says:

When Spectrum took over Time Warner Cable, things seem to deteriorate rapidly. Prices continue to raise constantly for worse service. Slowest internet speeds ever. Unfortunately only other option here is Frontier, which is worse. Trying to stream a movie and continuously get buffering. They also do not have the speed in my area they advertise. Trying to speak to them about problems is like talking to a brick wall. They also do a terrible job filtering robocalls as I get several a day. Overall their whole service sucks.

  7. Dawn Riley says:

Our spectrum internet is so slow. I work from home and need have had to call in several times do to speed issues or our internet wasn’t working. I’d have to call in to have them flush the lines so I could login to work. I have lost money do this. Extremely frustrating when you sign up for a speed and your not getting what you were promised. Also, the hidden fees is ridiculous to. Pay attention to your bill.

    1. Peter says:

I’m really fed up with Spectrum and the lies they get people to believe.
I often have to reset the modem they supplied as much as every 20 minutes. It isn’t due to ‘line faults’ or outages according to their monitoring but our older router which is total BS as the LAN never shows less than 70% and continues working when Spectrum shuts down the internet service.
It isn’t like we need a faster service, as long as grandson can watch YouTube kids he’s happy
You know there is a problem when they have to sent out updates to equipment every day (usually between 12:00am and 4:00am)

  8. Maria espinoza says:

    Yes Please add me

  9. Brian Clark says:

I am so frustrated. Spectrum internet constantly turning off during the night. Of course when they think people are asleep. I get scripted answers or that they have no record of my past outages but I have the paper trail. At least 4 times in the last two weeks for over an hour each time. If they do this to every customer I’m sure it is a big plus in their pocket. Tonight I was offered a credit. This seems to be a practice of Spectrum. Anyone else have this issue? Every time this happens my security system is compromised. I pay for 24/7 internet which I am not receiving.

    1. Emily says:

I have never gotten even close to the speeds that were advertised. I signed up for the highest they offer (1G), and I rarely get above 100 Mbps. Right now, it is at 20, which is consistently what I have been getting for the last few months.

    2. Peter says:

I’m pretty sure they do it to every non-commercial customer and probably even commercial customers after business hours.
Around 5:00pm on weekdays when service should get faster ours often completely cuts off or slows to the 14~17Kb range.
I’m really fed up with complaining multiple times a week and getting same response ‘we’ll send a tech out’,
The customer service reps just have the script to follow and majority are totally unaware of the various fines Charter Communication has paid over the last several years. They should lose their ability to run a ‘communications’ company that cannot and will not supply what they advertise.
I’m sure the techs are also fed up with the poor service but can’t really say anything to customers if they want to keep their jobs and benefits.
The few I’ve spoken to are also unaware of the $23 million fine in New York for failing to supply advertised speeds to business customers
