Zinus Green Tea Mattress class action lawsuit overview: 

  • Who: A California woman has filed a class action lawsuit against Zinus, the manufacturer of the “Green Tea Mattress.” 
  • Why: The plaintiff says the mattress can release fiberglass fibers which can harm users.
  • Where: The class action was filed in a California federal court. 

The popular Zinus Green Tea Mattress can release fiberglass fibers that are hazardous to human health, a new class action lawsuit alleges.

Plaintiff Vanessa Gutierrez filed the class action complaint against Zinus in July in a California federal court, alleging that flame-resistant fiberglass fibers in the company’s products can escape and cause health problems, including skin and respiratory tract irritation, and environmental contamination.

The class action lawsuit has roots in another class action against Zinus filed in 2020 in Illinois. Gutierrez filed her own class action after a judge removed non-Illinois residents, including herself, from the lawsuit in 2021.

In her lawsuit, Gutierrez claims that the Zinus mattress she bought for her daughter on Amazon for $400 ended up leaving scars on her four-year-old daughter’s chest and calves after releasing fiberglass.

The medical bills cost her nearly $20,000 in damages, including medical bills, she alleges.

Fiberglass commonly used in products as flame-retardant

Fiberglass can be used as a flame-retardant in some products. The fire-resistant material in its products is “standard in the mattress industry” and not considered hazardous by the Consumer Product Safety Commission (CPSC), Zinus told CBS.

In the Zinus class action lawsuit, some plaintiffs say they removed the protective outer cover, not knowing it was supposed to be left on. 

The CPSC said fiberglass use in mattresses should not be a hazard to consumers as long as the protective outer cover is not removed or opened. 

“Most consumer complaints about fiberglass being released from mattresses that have been reviewed by staff involved the outer cover being removed or damaged,” the commission told the Los Angeles Times

However, Gutierrez said she had never removed or opened the cover at the time she noticed her children’s symptoms.

She says she then discovered fiberglass particles throughout her apartment. The particles infiltrated her heating, ventilation and air conditioning systems, spreading through the house, she said, forcing them to live in a hotel for months.

Gutierrez is seeking recovery of damages related to her claims.

    Ever since we bought this mattress, we’ve been itchy and sick. Migraines, sinus issues, and I’ve had extreme chronic sore throats to the point I need to see a specialist. I’ve since removed the mattress but we’re still suffering the consequences. I’m afraid the fiberglass has released and is circulating throughout my house. I don’t have the funds to remedy this.

    Add me please. I’ve had the mattress for about 4 years, noticed some itching when I first got it but, did not think anything of it. Very early on noticed small fibers sticking out the mattress cover when I would go to clean my bedding. I always thought it was just fuzz from the linen. I Moved away for a year with a different mattress with no issues at all. I Moved back home in June, have had many problems with skin blisters, rashes, papules, small fiberglass pieces coming out of my face that look like long peach fuzz, scalp issues, hair issues as the threads have been embedded into scalp. I have gone to many doctors and been diagnosed with bacteria infections, dermatitis, etc. Nothing has ever worked. When I saw the articles about fiber glass in the Zinus green tea mattress I knew that must have been the issue all along. Even our dog developed a bad eye issue that we were told was allergies even though no medicine ever helped him. We know now it was the fiber glass from my mattress. We are in the process of a home inspection.

    I ordered one of these mattresses a few years back as a quick solution to save money after an expensive move. My partner thought he was having asthma attacks due to the cat sleeping In the room.
    After we changed mattresses, his symptoms mysteriously began to decline. I heard about this much later. I would never knowingly bought a mattress made like this. The title misleads you into thinking you’re buying something natural. Should’ve known the low price was too good to be true!

    I purchased the Zinus mattress on 4/21/2020. You can see the fiberglass on the side of the mattress just by shining a light on it. I also want to join this claim.
