Zinus Green Tea Mattress class action lawsuit overview: 

  • Who: A California woman has filed a class action lawsuit against Zinus, the manufacturer of the “Green Tea Mattress.” 
  • Why: The plaintiff says the mattress can release fiberglass fibers which can harm users.
  • Where: The class action was filed in a California federal court. 

The popular Zinus Green Tea Mattress can release fiberglass fibers that are hazardous to human health, a new class action lawsuit alleges.

Plaintiff Vanessa Gutierrez filed the class action complaint against Zinus in July in a California federal court, alleging that flame-resistant fiberglass fibers in the company’s products can escape and cause health problems, including skin and respiratory tract irritation, and environmental contamination.

The class action lawsuit has roots in another class action against Zinus filed in 2020 in Illinois. Gutierrez filed her own class action after a judge removed non-Illinois residents, including herself, from the lawsuit in 2021.

In her lawsuit, Gutierrez claims that the Zinus mattress she bought for her daughter on Amazon for $400 ended up leaving scars on her four-year-old daughter’s chest and calves after releasing fiberglass.

The medical bills cost her nearly $20,000 in damages, including medical bills, she alleges.

Fiberglass commonly used in products as flame-retardant

Fiberglass can be used as a flame-retardant in some products. The fire-resistant material in its products is “standard in the mattress industry” and not considered hazardous by the Consumer Product Safety Commission (CPSC), Zinus told CBS.

In the Zinus class action lawsuit, some plaintiffs say they removed the protective outer cover, not knowing it was supposed to be left on. 

The CPSC said fiberglass use in mattresses should not be a hazard to consumers as long as the protective outer cover is not removed or opened. 

“Most consumer complaints about fiberglass being released from mattresses that have been reviewed by staff involved the outer cover being removed or damaged,” the commission told the Los Angeles Times

However, Gutierrez said she had never removed or opened the cover at the time she noticed her children’s symptoms.

She says she then discovered fiberglass particles throughout her apartment. The particles infiltrated her heating, ventilation and air conditioning systems, spreading through the house, she said, forcing them to live in a hotel for months.

Gutierrez is seeking recovery of damages related to her claims.

    Bought a Zinus mattress in 2016 and in the last 7 months have been becoming very sick. A long lasting cough, bronchitis, rounds of antibiotics and inhalers and could not get better. I’ve been experiencing very bad eye problems. Been to the ophthalmologist on several occasions. Very red red itchy watery eyes. Steroid drops and several different eye drops.
    Recently discovered bed is covered in Fiberglass! Had to have a restoration company come out and this has cost us thousands of dollars. Any lawyers currently handling a class action lawsuit against Zinus?

    Bought 2 of the mattresses. Same thing happened. Fiberglass all over the sheets. They are dark blue and the fiberglass is very visible. This company needs to be held accountable.

    AMAZON sold me a ZINUS FIBERGLASS MATTRESS which made my dog sick, gave him oral lesions which bled profusely, aggravated my Asthma and caused skin irritation and swelling. However, they refuse to allow me a return – and they continue to sell the mattress!

    I called Zinus and they asked me to go back into the room and take pictures in the dark to prove that fiberglass was indeed present on the surface of the mattress. Also they believe the fiberglass they use is safe and this should not have happened and suggested I get someone else to take pictures for me as I was unwell. Zinus has no problems with getting yet another person gets sick!

    I have thrashed my sofa and linens and even the mattress in my spare room. I have sprayed the walls with water. I am however locked out of my bedroom.

    Purchased Zinus green tea queen size mattress 8/22 the smell only grows stronger allergies and hives if try to sleep on with 2 under sheets and a Mattress cover. after attempts with the company to replace it- sending all documentation- they said they could not help us.

    I purchased the Zinus 12-inch Green Tea Mattress back in April 2018. I have never ever unzipped the mattress case, yet small shards of fiberglass managed to leak out of the mattress. So many itchy, sleepless nights for the past several years.

      I had a sinus mattress give to me back in like 22 23 actually 22 it was already the mattress was cut to fit a camper so that’s why I got it I’ve had fiberglass I’ve been pulling it out of my face and forehead for months and months and months I left for work and came back a couple of months later and my bedding had been tore apart and all you know some other things my camper had been robbed anyway I slept on my bed when I woke up the next morning my face was on fire I began to clean it all up and you just couldn’t clean it up before I knew it I sparkled in the sun like a freaking vampire off of Twilight my face has been torn up for months everybody keeps thinking I’m using drugs and doing this and doing that and all the meanwhile I’ve been complaining about itching and burning and cutting of my face I thought I had shingles but it’s not my shingles it’s been 9 months how do I get some help Nicole Jones Oklahoma
