Zinus Green Tea Mattress class action lawsuit overview:

The popular Zinus Green Tea Mattress can release fiberglass fibers that are hazardous to human health, a new class action lawsuit alleges.
Plaintiff Vanessa Gutierrez filed the class action complaint against Zinus in July in a California federal court, alleging that flame-resistant fiberglass fibers in the company’s products can escape and cause health problems, including skin and respiratory tract irritation, and environmental contamination.
The class action lawsuit has roots in another class action against Zinus filed in 2020 in Illinois. Gutierrez filed her own class action after a judge removed non-Illinois residents, including herself, from the lawsuit in 2021.
In her lawsuit, Gutierrez claims that the Zinus mattress she bought for her daughter on Amazon for $400 ended up leaving scars on her four-year-old daughter’s chest and calves after releasing fiberglass.
The medical bills cost her nearly $20,000 in damages, including medical bills, she alleges.
Fiberglass commonly used in products as flame-retardant
Fiberglass can be used as a flame-retardant in some products. The fire-resistant material in its products is “standard in the mattress industry” and not considered hazardous by the Consumer Product Safety Commission (CPSC), Zinus told CBS.
In the Zinus class action lawsuit, some plaintiffs say they removed the protective outer cover, not knowing it was supposed to be left on.
The CPSC said fiberglass use in mattresses should not be a hazard to consumers as long as the protective outer cover is not removed or opened.
“Most consumer complaints about fiberglass being released from mattresses that have been reviewed by staff involved the outer cover being removed or damaged,” the commission told the Los Angeles Times.
However, Gutierrez said she had never removed or opened the cover at the time she noticed her children’s symptoms.
She says she then discovered fiberglass particles throughout her apartment. The particles infiltrated her heating, ventilation and air conditioning systems, spreading through the house, she said, forcing them to live in a hotel for months.
Gutierrez is seeking recovery of damages related to her claims.

I bought this mattress as well and now I have fiberglass all over my house. It’s ruined everything I own! Made it where I have a hard time breathing. Worst product ever!!
My family purchased several zinus mattresses and it has affected us. The cover I thought was washable never realizing what we have now been exposed to. My daughter and my apartment had this floating everywhere. I am sickened to be just learning what we have been exposed to. She tells me all the time that she can’t breathe. In and out of ER and now I know why. Definitely want to be involved in this litigation against this company.

I own one of these mattresses. I have been having respiratory problems for years. I didn’t realize till now it was the Zinus mattress. I have chronic sinusitis. My windpipe has been scarring up and closing up my airway so I can’t breathe. I can’t afford a professional clean up. I can’t believe they sell people these toxic mattresses with no warning.
I never removed the mattress cover and I found fiberglass all over my sheets. Please include me.

Please add me, my mom bought my brother the zinus full size green tea mattress and has has a terrible rash all over his legs for months. Bought December 2022. We have been sick sick ever since including my 2.5 year old and pregnant wife. We have proof and pictures of his legs. Also all our dogs have been non stop itching with no fleas or anything. Probably fiber glass all over our whole home.
I bought a zinus green tea mattress in early 2018. I also have noticed the itch it gives me, but I am a single mother and cannot afford to buy a new one. I have asthma and this is seriously affecting my health.
