Champion Toilet Class Action Lawsuit Overview:

American Standard Brands manufactured and sold its Champion brand toilets with defective gasket and/or flush valves, a new class action lawsuit alleges.
Lead plaintiff Robert Weiss claims the defect causes premature failure which leads to water waste and makes the toilet require frequent repairs and monitoring. Weiss wants to represent a nationwide Class of consumers who purchased the defective Champion toilets.
Defective Champion Toilet May Flush Golf Balls, But Also Leaks
The plaintiff alleges American Standard Brand engaged in misleading consumers by advertising that the Champion toilet can “flush a bucket of golf balls without issue while maintaining minimal water consumption.”
Weiss says he was impressed after seeing the golf ball demonstration on YouTube and ended up buying three American Standard Brand Champion 4 toilets for his house.
“These representations are intended to convince consumers that despite the Class Product’s minimal water usage, the toilet is capable of performing well in excess of that which a toilet would need to flush,” states the class action lawsuit.
Weiss alleges the toilet uses more water than what the advertising represents and also fails to deliver on the flushing performance it promises.
The plaintiff says that he and other owners of the Champion toilet are unaware the valve is defective until they receive an unusually expensive water bill.
Champion Toilet Defect
The purpose of the flush valve in question is to keep water from draining out of the holding tank until the toilet is flushed. A defective valve will lead to leaking and periodically cause the toilet to flush on its own, wasting more water, the class action lawsuit says.
Weiss alleges the toilet caused him to incur damages including but not limited to repair and replacement costs, increased water bills, a diminution in value to the toilet, and overpayment at the original time of purchase.
American Standard Brand is aware of the defect but has failed to change the design or solve the problem, according to the class action lawsuit.
The plaintiff alleges that American Standard violated California’s Consumers Legal Remedies Act, false advertising, and unfair competition laws.
Weiss is requesting a jury trial where he is seeking damages, restitution, and/or disgorgement for himself and other members of the Class. Plaintiff also wants the defendant to be barred from further engaging in its alleged unlawful and unfair business practices.
American Standard Brand agreed to pay class action rebates of more than $800 to end a lawsuit accusing the company of selling air conditioners and heat pumps with defective parts.
A similar class action lawsuit was also filed against Fluidmaster in 2017 that alleged the company sold toilets with defective hose components.

I have 2 American standard toilets American Standard sent me new seals. The toilets still leak
We purchased three Champion toilets. We first notice water pump going off every 20 minutes. The plumber came back three times replaced inside seal and inside but still problems. Need to replace all three. Purchased a month ago . Cost each time called plumber. Had other American Standard toilet since 1978 and replaced only for less water usage. Should have never replaced them.
I repalced out a toilet with the American Standard toilet, inpressed by the golf ball test and it started to leak from tank to bowl. I tightened it up and later did the same. The toilet was clogged overnight a few days ago and now I have a 2k dollar ceiling repair to deal with because the tank kept emptying into the bowl until it overflowed throughout the night.
My story is the same as above. Bought 2 years ago, replaced valve seal, a week later it running again. How doninget added to the law suit?
I would like to be added . Mine is brand new, I replaced the fill valve and no ordered a replacement flush valve, that’s close to $100 in parts on a 3 month old toilet.
I am so disappointed in our American standard champion 4 toilet. It has been a little over one year and We are experiencing phantom flushing. I started searching online for repair remedies and found that we are not alone. These toilets appear to be defective. I would like to be included in a class action suit. We are a disabled elderly couple on social security and the water bill has increased rather than decrease with the “water saving” toilet that keeps ghost flushing.
We have purchased 4 American Standard tiolets about a year ago. Two tiolets are defective.
We purchased 4 American standard dchampion toilets at home depot and all three are phantom flushing. I replaced the seals multiple times ant they still leak. Water bills are about $50-$60 more a month.

I came here to see if there was a fix for my leaking American Standard Champion toilets. While I am disappointed that there seems to be no fix, I am glad to see I am not alone here. I have tried changing out the gaskets but that hasn’t worked. Was thinking of changing out the flush valve, but after reading some of the stories here, I am not confident that will work either. They are not old — just purchased them about two years ago. How do I get added to the class action> I hate these toilets and the amount of water they waste. I just want something that works.
I’m having the same problem but includes water damage to dry wall. I’ve tried changing the seal and was going to try additional repairs too, but now I’m going to replace the toilet.
