Champion Toilet Class Action Lawsuit Overview:

American Standard Brands manufactured and sold its Champion brand toilets with defective gasket and/or flush valves, a new class action lawsuit alleges.
Lead plaintiff Robert Weiss claims the defect causes premature failure which leads to water waste and makes the toilet require frequent repairs and monitoring. Weiss wants to represent a nationwide Class of consumers who purchased the defective Champion toilets.
Defective Champion Toilet May Flush Golf Balls, But Also Leaks
The plaintiff alleges American Standard Brand engaged in misleading consumers by advertising that the Champion toilet can “flush a bucket of golf balls without issue while maintaining minimal water consumption.”
Weiss says he was impressed after seeing the golf ball demonstration on YouTube and ended up buying three American Standard Brand Champion 4 toilets for his house.
“These representations are intended to convince consumers that despite the Class Product’s minimal water usage, the toilet is capable of performing well in excess of that which a toilet would need to flush,” states the class action lawsuit.
Weiss alleges the toilet uses more water than what the advertising represents and also fails to deliver on the flushing performance it promises.
The plaintiff says that he and other owners of the Champion toilet are unaware the valve is defective until they receive an unusually expensive water bill.
Champion Toilet Defect
The purpose of the flush valve in question is to keep water from draining out of the holding tank until the toilet is flushed. A defective valve will lead to leaking and periodically cause the toilet to flush on its own, wasting more water, the class action lawsuit says.
Weiss alleges the toilet caused him to incur damages including but not limited to repair and replacement costs, increased water bills, a diminution in value to the toilet, and overpayment at the original time of purchase.
American Standard Brand is aware of the defect but has failed to change the design or solve the problem, according to the class action lawsuit.
The plaintiff alleges that American Standard violated California’s Consumers Legal Remedies Act, false advertising, and unfair competition laws.
Weiss is requesting a jury trial where he is seeking damages, restitution, and/or disgorgement for himself and other members of the Class. Plaintiff also wants the defendant to be barred from further engaging in its alleged unlawful and unfair business practices.
American Standard Brand agreed to pay class action rebates of more than $800 to end a lawsuit accusing the company of selling air conditioners and heat pumps with defective parts.
A similar class action lawsuit was also filed against Fluidmaster in 2017 that alleged the company sold toilets with defective hose components.

December 2020 I replaced my 23 yrs. old toilet with an American Standard Champion 4 max toilet, it’s been nothing but a problem with leaking from the flap gasket. NOT HAPPY!
We did too! Waited 25 years to replace and thought we were getting a great new toilet! Sooooooo frustrating! May need to do a lawsuit also. My husband is a retired teacher, we are so careful with purchases. Can’t afford another plumber to repair. Maybe we need to do another lawsuit?
