Champion Toilet Class Action Lawsuit Overview:

  • Who: Plaintiff Robert Weiss lodged a class action lawsuit against American Standard Brands.
  • Why: Weiss alleges American Standard sold Champion brand toilets with defective parts, causing water waste.
  • Where: The class action lawsuit was filed in California federal court. 

American Standard Brands manufactured and sold its Champion brand toilets with defective gasket and/or flush valves, a new class action lawsuit alleges. 

Lead plaintiff Robert Weiss claims the defect causes premature failure which leads to water waste and makes the toilet require frequent repairs and monitoring. Weiss wants to represent a nationwide Class of consumers who purchased the defective Champion toilets. 

Defective Champion Toilet May Flush Golf Balls, But Also Leaks

The plaintiff alleges American Standard Brand engaged in misleading consumers by advertising that the Champion toilet can “flush a bucket of golf balls without issue while maintaining minimal water consumption.” 

Weiss says he was impressed after seeing the golf ball demonstration on YouTube and ended up buying three American Standard Brand Champion 4 toilets for his house. 

“These representations are intended to convince consumers that despite the Class Product’s minimal water usage, the toilet is capable of performing well in excess of that which a toilet would need to flush,” states the class action lawsuit. 

Weiss alleges the toilet uses more water than what the advertising represents and also fails to deliver on the flushing performance it promises.

The plaintiff says that he and other owners of the Champion toilet are unaware the valve is defective until they receive an unusually expensive water bill.

Champion Toilet Defect

The purpose of the flush valve in question is to keep water from draining out of the holding tank until the toilet is flushed. A defective valve will lead to leaking and periodically cause the toilet to flush on its own, wasting more water, the class action lawsuit says. 

Weiss alleges the toilet caused him to incur damages including but not limited to repair and replacement costs, increased water bills, a diminution in value to the toilet, and overpayment at the original time of purchase. 

American Standard Brand is aware of the defect but has failed to change the design or solve the problem, according to the class action lawsuit. 

The plaintiff alleges that American Standard violated California’s Consumers Legal Remedies Act, false advertising, and unfair competition laws. 

Weiss is requesting a jury trial where he is seeking damages, restitution, and/or disgorgement for himself and other members of the Class. Plaintiff also wants the defendant to be barred from further engaging in its alleged unlawful and unfair business practices.

American Standard Brand agreed to pay class action rebates of more than $800 to end a lawsuit accusing the company of selling air conditioners and heat pumps with defective parts. 

A similar class action lawsuit was also filed against Fluidmaster in 2017 that alleged the company sold toilets with defective hose components

    My toilet is fairly new. Less than 8 months and it has started leaking. The water company indicated 8 GALLONS PER HOUR!!! My next bill is going to be huge as I was out of town when the leak began. I have dealt with toilet leaks before but never 8gph!! It refills approx every 5-10 minutes. Very discouraged to read many have replaced parts for those parts to not remedy the problem. How can I be added tho this case?

    I bought 2 toilets when I moved into my house and have replaced the valves in them multiple times. I have resorted to turning them off. Please add me to the case.

    Have one with issues in California; will be replacing toilet

    I just want them to pay the price for another one and the install?

    Is there any way of checking for the model numbers or if I do install and I have the model number photo to be included with this? Also in replacing with a similar one what model numbers to avoid

    I plan to replace it.

    How do I know which model numbers have the issues?

    Mine just has to flush a gazillion times to actually be effective Which defeats the purpose?

    Btw mine is a round tall

    I have a American standard champion toilet. My water bills were pretty high in 2022 until I discovered the toilet had a leaky O-Ring. I have two of these toilets in my house and one in another rental house.

    I’ve dealt with leaking flapper gaskets and O ring issues on this AS Champion toilet. I replaced both parts several times. I’ve resorted to keeping the water turned off until needed. I will replace it. Please add me to this litigation. Thank you.

    Also having trouble with mine. The bowl only fills about a quarter way with water, leaving waste to hit bare porcelain instead of water. Self Cleaning? Ha. More like constantly cleaning after every #2. Worst toilet I’ve ever used. An embarrassment when company is over

    Replaced the O gasket according to instruction and still leaks. American standard sent whole new flush valve and it still leaks. Looked at past water bill and since i keep the water shut off to this toilet my monthly usage is down.

    What can I say that hasn’t already been said? Bought Champion in 2021, I replaced the entire center section in Feb 2023, but it still leaks. A large water bill even after we came back from vacation was my first clue. No reason for this to not be rectified already.
