Champion Toilet Class Action Lawsuit Overview:

  • Who: Plaintiff Robert Weiss lodged a class action lawsuit against American Standard Brands.
  • Why: Weiss alleges American Standard sold Champion brand toilets with defective parts, causing water waste.
  • Where: The class action lawsuit was filed in California federal court. 

American Standard Brands manufactured and sold its Champion brand toilets with defective gasket and/or flush valves, a new class action lawsuit alleges. 

Lead plaintiff Robert Weiss claims the defect causes premature failure which leads to water waste and makes the toilet require frequent repairs and monitoring. Weiss wants to represent a nationwide Class of consumers who purchased the defective Champion toilets. 

Defective Champion Toilet May Flush Golf Balls, But Also Leaks

The plaintiff alleges American Standard Brand engaged in misleading consumers by advertising that the Champion toilet can “flush a bucket of golf balls without issue while maintaining minimal water consumption.” 

Weiss says he was impressed after seeing the golf ball demonstration on YouTube and ended up buying three American Standard Brand Champion 4 toilets for his house. 

“These representations are intended to convince consumers that despite the Class Product’s minimal water usage, the toilet is capable of performing well in excess of that which a toilet would need to flush,” states the class action lawsuit. 

Weiss alleges the toilet uses more water than what the advertising represents and also fails to deliver on the flushing performance it promises.

The plaintiff says that he and other owners of the Champion toilet are unaware the valve is defective until they receive an unusually expensive water bill.

Champion Toilet Defect

The purpose of the flush valve in question is to keep water from draining out of the holding tank until the toilet is flushed. A defective valve will lead to leaking and periodically cause the toilet to flush on its own, wasting more water, the class action lawsuit says. 

Weiss alleges the toilet caused him to incur damages including but not limited to repair and replacement costs, increased water bills, a diminution in value to the toilet, and overpayment at the original time of purchase. 

American Standard Brand is aware of the defect but has failed to change the design or solve the problem, according to the class action lawsuit. 

The plaintiff alleges that American Standard violated California’s Consumers Legal Remedies Act, false advertising, and unfair competition laws. 

Weiss is requesting a jury trial where he is seeking damages, restitution, and/or disgorgement for himself and other members of the Class. Plaintiff also wants the defendant to be barred from further engaging in its alleged unlawful and unfair business practices.

American Standard Brand agreed to pay class action rebates of more than $800 to end a lawsuit accusing the company of selling air conditioners and heat pumps with defective parts. 

A similar class action lawsuit was also filed against Fluidmaster in 2017 that alleged the company sold toilets with defective hose components

    We purchased three American Standard Champion 4 toilets a little over one year ago. One has no issues. One has a “phantom flush” multiple times a day. And the third caused over $5,000 damage to my house. The toilet clogged, and the flapper did not properly go down, causing it to overflow. We did not notice it until water dripped from the ceiling in the kitchen below. Water even flowed through the walls to the laundry room below the kitchen. Two sparks were noticed, along with the smell of smoke. We now need mold mitigation and floors/ceilings ripped out. Needless to say, we are interested in joining the class action suit against American Standard.

    We purchased the Champion 4 toilet by American Standard because it claimed superior flushing power (4 inch flush valve, largest trap-way, and capable of flushing bucket of golf balls). Totally not true. Barely flushes urine alone. The flush valve is defective, sitting too high in tank and leaving 4 inches of water in tank after flushing. Very disappointed with American Standard. Were these toilets not tested before shipping? Was the design of the flush valve not questioned? Yet, they are still selling this defective product. We expect much better from American Standard.

    We remodeled our bathroom last May. Six months after the toilet{ American Standard Champion 4} started running all the time. I replaced the blue o ring and it was fine for a while but then it started again. I replaced the ring again thinking it might have been defective. Two weeks later the toilet still keeps running, We revived our water bill and it was the highest bill we ever had in the 35 years we lived here. The other problem is I’m a light sleeper and the flushing noise wakes me up every night. Need a solution fast.

    Purchased American Standard 4215S from Home Depot within the last 24 months.
    Had experiences with high water bill after several months.
    Found out online that several people complained about same issue and one suggestion was to purchase new large O Rings (blue) and replace.
    Did this on several occasions and found that after 6 months, the leaky seals returned. I can here it drip in the basement when standing under the toilet bathroom pipe.
    Still getting higher than normal water bills more often than not.
    Should I contact American Standard directly or how do I get into class action to resolve this issue?
    Is there a fix for this?

    I bought the American Standard Champion from Home Depot
    Since purchase I have replaced gasket twice indicator is leakage into bowl and tank fill randomly
    Wasting water and time

    We bought the first Champion 4, 1/11/2023 and the second 7/23/2023. The one bought in January has been working up until today 1/7/2024 until it started doing the same thing as the one bought in July which it starts to refill on it’s own. I thought this can’t be happening again. I just googled if there was a recall on these toilets and now see there is a class action lawsuit for these brand being defective. I am wondering why these weren’t pulled off the market in the first place knowing all these people were having problems. This is so very frustrating and will be calling them tomorrow to see if they will stand by their product.
