Slimfast Keto Fat Bomb Class Action Lawsuit Overview: 

  • Who: Kasama Brand filed a class action lawsuit against Slimfast Foods Company.
  • Why: Brand claims Slimfast misleads consumers about the amount of calories in its Keto Fat Bomb chocolate snack cups and ketogenic snack gels.
  • Where: The class action lawsuit was filed in California federal court.

Slimfast misleads consumers about the amount of calories in its Keto Fat Bomb chocolate snack cups and ketogenic snack gels, a new class action lawsuit alleges.

Plaintiff Kasama Brand claims Slimfast labels the front of the Keto Fat Bomb products with “Zero Added Sugar” or “zero sugar” to deceive consumers about their actual calorie count. 

Brand claims further that, since the products do not meet the regulatory definition of being low calorie, Slimfast is required by federal regulations to include a disclaimer acknowledging they are not meant for weight control.

“The failure to include this disclaimer makes the labels’ claims false, deceptive, inaccurate and/or misleading,” the class action lawsuit states. 

Brand claims a single six-ounce serving of a Keto Fat Bomb chocolate snack cup is around 90 calories, more than a Reese’s Peanut Butter Cup of the same size.

In addition, Brand argues Slimfast also sells Keto Fat Bomb Shot ketogenic snack gels, which are labeled as “zero sugar” but still contain around 100 calories per 1-ounce serving. 

Slimfast Attempting To ‘Capitalize’ On Current Consumer ‘Craze,’ Class Action Claims

Slimfast markets its Keto Fat Bomb products in a way that makes them appear to be low-calorie so it can “capitalize” on the current consumer “craze” for food that is high in protein and low in carbohydrates.

“But contrary to common-sense consumer expectations, these snack cups are far from low-calorie foods,” the class action lawsuit states. 

Brand claims she and other consumers relied on Slimfast’s marketing claims when purchasing the Keto Fat Bomb products, which she says turned out to be “inadequate product sold under false pretenses.” 

Brand claims Slimfast is guilty of unjust enrichment and in violation of California’s Consumer Legal Remedies Act and several of its Business & Professions codes

Brand wants to represent a California class of consumers who have purchased Slimfast’s Keto Fat Bomb products. 

Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with compensatory, incidental, consequential, statutory, treble and punitive damages for themself and all class members. 

A similar class action lawsuit was filed against the makers of Arnold Palmer Lite Iced Tea over claims they misled consumers about the amount of calories the drink contained.

    Keto has nothing to do with low calories! This nitwit should know it’s more high fat, medium protein, low carbs if she claims to “be keto” therefore purchasing products designed and marketed for the keto lifestyle. I haven’t eaten them numerous times of the last year, maybe one a day every couple of days and it didn’t effect my weight loss or ketosis numbers one bit. Stop the frivolous lawsuits and follow the keto knowledge

      This has nothing to do with the diets itself. This lawsuit is happening because Slimfast falsely stated nutritional facts information and it’s packaging. Which has caused them to break a bunch of consumer/product/FDA laws. That is why they are getting sued.

    This is so stupid. They say the calories in the label. They are FAT bombs and fat has more calories. They are specifically for Keto. You have to be an idiot to sue over this. It says no sugar not no calorie. In fact the front of the package says not a low calorie food right on the box.

    I’m sorry but this is a ridiculous lawsuit. Keto is low carb/high fat, not low calorie. This is a Coconut Cream Dark Chocolate Fat Bomb, it should be obvious what it is. Make sure to read the nutrition information if it is a concern for your diet, not just the front of the box just like all products.

      I completely agree! I don’t count calories, only fat/net carbs/protein and still dropped 152# in less than a year. Anything to make a quick buck at the expense of someone else.

    I have always trusted the Slim Fast products. I’ve purchased these multiple times over the last 2 years. Im disappointed to know it’s not as I thought it was

      What did you think it was? It literally says fat Bomb on the package. It’s claims are true, it has no sugar but it never claims to be a low calorie food. These are meant to be used in a low carb higher fat diet.

    I have purchased these multiple times and find this to be a frivolous lawsuit. These Keto Products don’t claim to be “low calorie” because the Keto diet is not a low calorie diet. It’s low carb, not low calorie.

      Thank God there are other smart people out here… I read this thinking these are not low calorie foods, keto is not low calorie what are they thinking suing… I eat these to get my extra fat for the day and never think twice about calories. I’m down 30 lbs and ticking…
