Grubhub Hidden Fees Lawsuit Overview:

The District of Columbia is suing Grubhub for “unfair and deceptive” practices, including creating fake restaurant websites and pushing costs onto restaurants even during its COVID-19 “Supper for Support” promotion.
Filed by DC’s Attorney General Karl A. Racine, the lawsuit details eight specific practices that indicate Grubhub’s disregard of “consumers’ right to truthful information at every step of the process.”
The lawsuit sees Grubhub’s alleged behavior as “an apparent effort to optimize its revenue.” In 2020 alone, Grubhub generated about $1.8 billion in revenue, according to court documents.
Racine seeks restitution, civil penalties, other relief and “to permanently enjoin these deceptive business practices.”
Grubhub Allegedly Misrepresents Fees, Ordering Options to Consumers
The lawsuit calls out Grubhub’s “bait-and-switch scheme” in which it told customers that they would only have to pay Grubhub a delivery fee while “deceptively obscuring” its service fee and, if applicable, small order fee for orders less than $10.
Even Grubhub+ customers, who pay $9.99 per month and are promised “unlimited free delivery,” have to pay the service fee on delivery orders, according to the lawsuit.
Grubhub also “deceptively advertises” that customers can “order online for free” although this applies only to pickup orders.
The lawsuit also claims that Grubhub often displays incorrect local prices despite advertising local restaurants’ menus.
Grubhub Allegedly Fails to ‘Adequately’ Disclose Deceptive Practices
Grubhub also deceived restaurants. Grubhub lists over 1,000 restaurants on its platform that do not have a contractual relationship with Grubhub “without the restaurants’ consent and without adequately disclosing to consumers” the lack of relationship, the lawsuit says.
GrubHub also created “Routing Telephone Numbers” and hundreds of “microsites” each meant to look like a restaurant’s own phone number or website. Orders made through these outlets were still funneled through Grubhub, which then charged restaurants a separate commission “without adequately disclosing that fact to consumers,” according to court documents.
Finally, Grubhub took advantage of the pandemic-related rush to support local businesses with its “Supper for Support” promotion in which consumers were promised a discount on select orders. “Contrary to its advertisements, this promotion did not actually support restaurants as the restaurants, not Grubhub, were required to foot the full cost of the $10 off promotion,” the lawsuit says. The restaurants were also responsible for paying commissions on the full price before the discount.

On Dec, 30 2023 I placed an order through GrubHub, at the end of the order I noticed that the app didn’t ask for payment options so i called to see why app didn’t show me payment options and was told that the order went through, so obviously they kept my husband card details. So the lady went on to say that my order would be ready for pickup in x amount of minutes, I told her that it was delivery and she said that they don’t deliver, to make a long story short, this supposed manager cancelled my order and now I’m getting the run around about my refund of $83.03.
Add me please, I have numerous emails, text messages with information proving GrubHub deception, stealing money from customers and proof of refunding money. The. To find out they reverse the credit weeks later. Also proof of working with certain restaurants to frustrate customers when orders are not delivered and then you call the restaurant just be told it is not their problem to contact Grubhub, then to go back and forth between the two companies until a customer is finally sick of dealing with it.
I have the same issue and I think grubhub is complacent in fraudulent activity by delivery drivers and not taking disciplinary actions and not being transparent when directly asking what happens to these drivers. Mine today even sent a backed out photo
Grubhub took 375 from me over two years when I tried to reach out nothing happened my bank account got closed because of it ….. I need my money back , and I’m glad they finally doing something about it
How can I added to class action lawsuit?

I had a free one-year premium account with GrubHub that I got through Amazon. The day after my first order was charged and delivered, they added $3 AFTER they had already charged my credit card for the original amount stated. That is NOT legal! I immediately canceled my account (through Amazon, so it was easy and final) and I will never order through them again.
I purchased from Grubhub 1 time in Nov. of 2021 on a free delivery trial they offered. I Never used them again and noticed a charge on my card today for $10.69. When I looked further they apparently kept my card info and randomly started charging my card in June of 2022 until now.
Grub Hub stated delivery fees from a particular restaurant was $2,99 but then when I reviewed my receipt, they charged $3.49. They told me that is the minimum and it depend on distance. It does not say that, it shows $2,99 for this restaurant. This is bait and switch. I sent them a screenshot to show them exactly what I was talking about and they refuse to refund my money.
