Mondelez Sugary BelVita Breakfast Biscuit Class Action Lawsuit Overview:

  • Who: Consumers who bought Mondelez International Inc.’s belVita breakfast biscuits sued the company.
  • Why: The customers alleged the company fraudulently marketed their belVita biscuits as healthy when they were full of sugar. Mondelez has agreed to pay $8 million to end the class action.
  • Where: The settlement will apply to biscuit buyers nationwide.

Mondelez will pay $8 million to consumers and stop using the word “nutritious” to describe its belVita breakfast biscuits if a new proposed class action settlement goes ahead.

In a motion filed Nov. 15 in a California federal court, plaintiffs in the class action lawsuit filed against Mondelez International Inc. asked a judge to approve their proposed settlement.

The belVita class action lawsuit was filed in November 2017, claiming that Mondelez International Inc. fraudulently marketed their belVita biscuits as healthy. Instead of being a nutritious breakfast option, the belVita products are full of sugar, the plaintiffs said.

Over the years, Mondelez sought to dismiss the belVita class action, prompting plaintiffs to fight the case at multiple junctures.

BelVita Class Action Settlement Includes Rebates, Label Changes

The settlement, if approved, would benefit Classes of biscuit buyers nationwide who purchased the product between November 2013 and the date that the court grants preliminary approval.

Class Members without proof of purchase can make claims for $0.21 per purchase of the biscuits, up to two per month, and those with proof of purchase can claim for an uncapped amount.

The three named plaintiffs will seek $5,000 each, and lawyers are seeking $2.67 million, the motion states.

Mondelez has also agreed not to use the term “nutritious” on its products, or substitute the words “healthy,” “balanced” or “wholesome” for “nutritious” on its Steady Energy products, including belVita biscuits.
